Our firm of Attorneys were instructed to attend to the registration of the transfer from the Seller/Transferor who bought the property through Habitat for Humanity South Africa. The said Seller/Transferor had decided to sell the property to the new Purchaser/Transferee, however; on perusal of the holding Title Deed, we note that there is an onerous condition noted against the property. This condition restricts the Seller/Transferor from selling/disposing of the property.

We had on the 13 April 2022 written to Habitat for Humanity of South Africa requesting for their consent to the deletion of the onerous condition from future Deeds.

We have been liaising with them telephonically and via emails on several occasions and have been promised by Gugulethu Fakude that the requisite consent will be forthcoming, but to date hereof we are still not yet in receipt of same.

The Seller, Estate Agent and myself have been to their offices in Durban, but it seems as though that their offices are not in operation.

Upon contacting Ms Gugulethu Fakude telephonically via her cell whereof she had agreed to assist us but when following up with her she then became rude, abrupt and was giving us attitude.

Desired outcome: To get the signed consents in order we can finalise this transfer.
