On 11/17/21, I purchased a home that was deceptively advertised on Zillow and MLS as being an "Increditable deal!".
The ad reads as follows and is still on Zillow, Incredible deal! After passing inspections and appraisal value coming in above list price, this move-in ready 2 bed/1 bath ranch is back on the market! The home has been carefully maintained and updated. Brand new carpet and paint throughout. Professional updates completed during current seller's ownership: entire electrical system updated, furnace/central air condition units with new ductwork, bathtub reglazed, exhaust fan and light in bathroom, refrigerator, washer. Detached 2 car garage behind the property includes a workbench and extra storage.
Nothing could be further from the truth. In my view, this is false advertising and deceptive trade. First off, public records indicate the seller paid his mother's LLC $10.00 for the house. Incredible deal I guess, for the seller. Further investigation of public records show seller borrowed $60k and $15k against the property he didn't own from his mother's LLC just before buying the property for $10.00 from her LLC.
After passing inspections? Relator added notes under Agent to Agent Remarks that would indicate the property went through mutual release three times. The reasons given do not indicate any offers "passed inspections".
Appraisals are done by square foot relative to sales of surrounding properties and not applicable to property description.
Move in ready is disputed as seller entered domicile after final walk through and removed items from property voiding final acceptance.
Professional updates were done by armatures that did not get the proper permits for work on the illegally half updated electrical system, not entire electrical system. Furnace system was upgraded without the proper permit. City inspector violated the electrical system to a point the house had to be abandoned. The house is no longer habitable, and I am out $90k.
I have a case against the seller that is slated for jury trial on the 12 of June, 2023 for lying on the disclosure.
Additionally, I intend to pursue charges against my relator for pushing me into this deal instead of protecting me it.
