I had signed a roofing contract with Frank Seeber Roofing and was told that for whatever reason I could cancel before 10/9/12. I called Frank Seeber Roofing the morning of 10/9/12 and told them I would be cancelling and what steps I needed to do. I was given the run around that day. I called several times and no answer. Never got any returned phone calls. Finally, got the email from Frank Seeber Roofing that the cancellation was received on 10/9/12. I called the next day to see when I could pick up my $805 deposit check and was again given the run around and never given any answers until the next day when they sent me a email stating that I could come pick up my check on Friday but there were fees that they would be taking out of that money. That is the most ridiculous thing I have ever heard. The cancellation letter states "You may CANCEL this transaction, without penalty or obligation". This means that I will not get penalized by backing out and I have no obligation to the contract. They claim they paid $300 at the city of dania beach to submit the permit. I called the city of dania and talked to the permit department and was told that was a "lie" and that Frank Seeber had only paid $75 for a Plan Review Fee Charge. No other fees were paid by Frank Seeber Roofing. Furthermore, no where on the cancellation notice does it state that I would get charged any fees. It clearly states that I may cancel no later than 10/9/12 and without any penalty or obligation. Called Frank Seeber Roofing again and explained what the city of dania told me and they don't care or want to resolve this issue.

I have the email from Frank Seeber roofing on October 9, 2012 that the cancellation notice was received and cancelled. I never once said for them to "Rush" my job. Where in my contract that I signed does it say to "rush" my job? These are all lies that Frank Seeber Roofing has been making up since the beginning. They are making up all these excuses and fees to try to justify them stealing my money. The bottom line is they only paid the city of Dania Beach $75 for the plan review. I have all the documents from the city on what exactly was paid. Their response that Frank Seeber Roofing "always" waits 72 hours for the cancellation deadline to file the permit is another lie. If that was the case, why did they not wait the 72 hours in this case? Always in the dictionary means "At all times; on all occasions". I also contacted the City of Dania and they were not told to "rush" my permit as Frank Seeber Roofing stated. These are more "lies" made up by Frank Seeber Roofing. The cancellation notice states that if I cancel by October 9, 2012, there will be no penalty or obligation. They are not doing the proper thing and refunding my money.

We Honored Daniel Chesto’s Cancellation Without Required Certified Mail Original Written Form – Refunded Deposit Minus Fees Inccured Due to Mr.Chesto’s Request To Rush His Re-Roof Job!
Frank Seeber Roofing was more than fair with Daniel Chesto, allowing him to cancel his contract without receiving the Cancellation Notice by the deadline. The only fees charged to Mr.Chesto were the RUSHED permitting processing fees and cost that were incurred. Mr.Chesto came to our office on October 3, 2012 and signed all documents pleading us to RUSH his job, we had to rush the permitting process in order to accommodate Mr.Chesto’s request and at that time he was placed on the work schedule to be started on October 12, 2012. FSC always waits until the 72 hours cancellation deadline to file the permitting process so there would be no fees to the Homeowner, however, when Mr.Chesto requested us to RUSH his job, that required us to RUSH the entire permitting process, therefore fees were incurred of $300 as follows, not just for the City of Dania as Mr.Chesto stated:
*Inner Office Permitting Preparation RUSHED for Building Department includes completion of the following forms:
Permit Application, Single Family Re-Roofing Affidavit, High Wind Velocity, Mitigation Form, Property Appraiser, Introduction Form, Completion of Section A form, Completion of Section B form, Completion of Section D form, Shingle Product Approvals, Shingle Fire Page Form.
Inner Office – RUSHED Completion of Notice of Commencement Form.
*Submittal of Permit – Permit Runner for the Submittal of the RUSHED permit to the City of Dania. Submittal Fee Paid.
*Notice of Commencement – RUSHED - File at Governmental Center, and then delivered to City of Dania. Filing fee paid.
*Tuesday Morning, prior to Mr.Chesto’s phone call to our office, the City of Dania called and said the RUSHED permit was ready for pick up.
*Daniel Chesto’s RUSHED job was scheduled for tear off on October 12, 2012 and all material was ordered and job account was opened.
Mr. Chesto called us on the deadline date of October 9, 2012; he asked us to match another roofer’s price and sent the other roofer’s proposal to us. Mr.Chesto demanded an answer immediately because he was changing from Shingle to Tile and when we did not have an immediate answer to matching the price, he demanded cancellation, in which we honored his verbal cancellation even though we did not receive the written cancellation notice as required on Cancellation Notice Form. We went way and beyond to accommodate Mr.Chesto including allowing him from Rushing permit process, providing him with 1 week start date, permit was submitted on October 5, 2012 as per Mr.Chesto’s RUSHED request. FSC ordered material, scheduled delivery of material and paid for all permit processing fees incurred (inner office, building department & governmental center). Mr.Chesto was NEVER told the City of Dania Beach was paid $300. In fact, Mr.Chesto insisted that we never paid a penny to the city. We were more than fair with refunding Mr.Chesto the $505.00 even though he did not follow the required process of cancellation. We never received and original certified Cancellation Notice. His cancellation notice was received via email only on October 10, 2012.
