Sale representative at Parramatta made misleading misrepresentation that all the Hybrid watches were $149. She spent half an hour talking to us about these watches as we were narrowing down which of the hybrid watches we wanted. She said all of them were $149. We were ready to purchase it and she went to get a new one. As she could not find one, I asked if any other store had it. She checked and found that QVB in Town Hall had it. I told them that I needed it within two days time so I would be going into QVB the next day just to purchase it. She called the other store and put it on hold. Just before I left, I asked her once again what the price was for that watch she had put on hold for me. She said "It's $149 there as well. All our stores have the same promotion."
The next day I made the long journey to QVB as it is far from where we live. My watch had been put on hold but the manager there said it was $199. She called the manager at the Parramatta store who said it was a "miscommunication" by the Sales Representative. QVB refused to give it for $149, and said that Parramatta would also refuse. I explained that I had been misled and induced into coming to Fossil QVB specifically for that purpose. There were many chances for the Sales Representative to check what the price was - it was something we asked at every stage of the interaction. In fact, all the hybrid watches were $199 - nothing she had said was true. The company did not want to accept vicarious liability for the misleading actions of their employee. Buyer, beware.
