Dear Gentlemen,

This is the beginning of our losing $300,000 in a scam involving the following companies and Mexico.

At this point a lawyer working with Montoya and Associates has told us that there is no way we can recover any monies from the Mexican government. We are sending this so that no one else will lose their retirement fund. Below are some brief emails of the promises we believed and some of the stories and lies we received from these individuals.

Mr. and Mrs. Taucher,

My name is Ethan Hughes with Realty and Estates. I am contacting you on behalf of the Boutique Private Residence Club who is now and as of October 2020 the sole owners of Vallarta Gardens. It has been brought to our attention after contacting many other members that have purchased from January 2016 to March 2020 may have been dealing with PILA or Arrow Marketing with zero positive results and or promises kept. It has also been noted some members during the sales process may have even traded in or exchanged a previously owned time share and have been awaiting payment or credit. We truly hope that’s not the same group you fall into.

However it does show in your sales contract you did pay for the ability option of sales or lease.

I have attached to this email a current offer for your available weeks this year of 2021. We are currently working on filling 2 acquisition order contracts from neighboring resorts looking for additional accommodations.

I will also relay this to you on the available voicemail service.

I have just verified with the Mexican Government (SAT) and you never paid for your IVA taxes. I have a fiduciary duty to have the buyer reimburse this out of pocket expense. Which I have already requested, please find attached reimbursement addendum and bank wire instructions for you to complete your payment. If you have any questions feel free to call me or get in contact with your agent.

We spent the next couple of months being asked for more money with the promise once they receive it our funds, which were in escrow in Mexico, would be returned. Nothing happens for at least a year, except more demand for taxes, etc. Then we get this:

From the American Escrow Company

I hope all is well, I apologize for not being available for you since I had to go on a preventory leave due to covid. When stepping into the office this morning I was met with the request notice attached. It seems that Banxico is requiring an erase of records certificate before they can release your funds out securely. I spoke with our representative in Mexico who did not have very positive information. I was hoping that this erase of records certificate would be something we could file without much issue. Unfortunately there is indeed a cost that is associated with obtaining this certificate which entails and guarantees that all your requirements in Mexico have been met for this transaction. It will carry a total cost of 8% based on the transaction amount and equals to $7,336.66 USD. I certainly was not expecting there to be a requirement for this certificate much less a cost, especially after we were set to finalize. However in a sense this completely assures your requirements with Mexico are concluded. I will give you some time to review the information and will make myself available for you.

Once your payment for reinstatement has been made we will proceed accordingly. I have included a copy of this document for your reference as well as the bank wire instructions needed to complete the pending payment.

Then later Montoya and Asociaste in México contactad us:

Dear Mr. And Mrs. Toucher, We have received your request for the “Liquidation” of your agreement. THE FOLLOWING IS THE NECESSARY PROCEDURE FOR LIQUIDATION: You have been assigned a “Liquidation Verification Number #LVN-02665” this internal number represents your case in our system and history for the total amount of your liquidation. Please allow 24-72 hours for the full review of your history to determine the total amount assigned for your liquidation. After the total amount for liquidation has been assigned accordingly. You will receive the total amount assigned via email as an acceptance and will require your authorization, attached you will receive a disbursement form that requires to be filled out properly and within a reasonable time frame, for “Arrow Marketing Group” to schedule your disbursement of your liquidation to any national bank within its territories. Best regards, ARROW MARKETING GROUP ACCOUNTING DEPARTME

Subject: Bank Application

Sr. Taucher,

Here is the bank application form, this will allow us to activate an account and secure the funds in the amount of $224,100.00 USD. Please fill out and dont forget to send a copy of a unexpired, government issued, photo I.D., If you have any questions feel free to give me a call. The next step is to schedule your payment, when you are ready for payment I will schedule you in my system, and I will send you the bank wire instructions for the activation fee of $6,723.00 USD.

Once we complied with this the bank was to send this as a settlement with Arrow, however, they made a mistake on the numbers on the transaction and it was held by the Mexican Government. At that time they told us we were being investigated for fraud and had to pay $25,000 for the investigation by Santander. That was supposed to be returned upon the completion and we were cleared from fraud but the money was added to the other amounts

Again after the investigation we were told we would be able to receive funds but only after we opened a 30 day account at the bank for another $6,723.00, which we did. This final time the monies were sent the Customs in Mexico told us we needed to pay !8% capital gains. We originally only want back the original monies we put in which was around $150,000. The additional $225,000 was a settlement with Arrow.

We know at this point we will never see this money again, however, our hope is to stop any others who may be taken in by these companies. We did do a search on BBB and they seemed responsible

They asked for another $15,000 to give to customs as a good faith that we would pay the capital gains after we received this amount. Well they said no after they got their money and our lawyer and the bank said that there was nothing else they could do and cut us off completely.

We unfortunately drained my retirement account and our savings, we will be ok but our future of retirement looks very different then we planned.

We asked them to use the funds for the poor but are sure the cartel will get all of it.

. What we really are looking for is the return of the $103,000+ that we invested out of our own savings and retirement. As we have told you time and again, we do not have any other resources to draw upon and certainly do not have the $36,000 to pay as capital gains.
