Ameriplus review: GAP insurance

I bought a 2017 KIA Soul Ser.# KNDJP3A50H7418105 on 9/25/18 at Fazenda Inc, Elder Mitsubishi 901 S Bell Blvd Cedar Park, TX 78613 tel. 512-250-2000 who added GAP. The car was in an accident and totaled on 11/22/19. My primary ins. ROOT paid what they concluded was their part directly to Ally Financial, I never saw the check or their estimate for that matter. They turned the outstanding balance over to Ameriplus. It took several months of trying to find out why the GAP Ins. had not paid. I called Ally and finally received a letter informing me that apparently Gap was not paying so I was responsible for the balance. I received a phone call from GAP asking me to send a copy of the check that ROOT sent to me and since I never saw the check I called ROOT and asked them to send it to AMERIPLUS. They advised me that they had already sent one and they probably had it on a desk somewhere as they were good at that. I waited a while longer, giving them time to receive the second check and pay. Finally, nearly a year or so of this back and forth, I decided to call Ameriplus myself and find out what the hold up was, when the lady looked up the claim she was surprised that it hadn't been paid yet and said they would get it out ASAP. She then put me on hold only to come back and tell me that Ameriplus had refused to pay. She stated that the claim was considered fraud and a felony as drinking was involved. When I questioned her as to why nothing had been said to us about this she said it was in the mandatory disclosures, acknowledgements and acceptance on the contract I signed. I have copy of this page of the contract, and it says nothing about that. I have read the contract from top to bottom and have not found one word about fraud, felony or anything else like that. This balance is now on my credit and has brought my score way down due to the fact that I simply can not pay it.
