I opted in to dependent care and medical flexible savings accounts for 2021 through my company, DigitalSpec. The company also provided transportation benefits through Zenefits. I left the company in September 2021 and checked my Zenefits balances to clear them out. Zenefits showed an amount for transportation but $0 balances for dependent care and medical. At the time I assumed I must have been mistaken and missed the deadline to sign up and didn't pursue it - that was my mistake. I did try to use the transportation balance and had issues I attempted to contact Zenefits about for assistance. I waited over an hour on their phone line, so I wasn't anxious to repeat that.

I received my W2 from DigitalSpec and in March 2022 when preparing my taxes I realized funds had been deducted for both dependent care and medical FSAs, so then started asking questions of both DigitalSpec and Zenefits. After several communications Zenefits told me that they had not received funds for my accounts and I needed to take it up with the employer and request a corrected W2. The employer's initial response was that it was past the deadline to use any funds. As these funds hadn't been available to me before the deadline I continued to pursue this and finally just today (6/8/2022) had a teleconference with the personnel and finance directors of DigitalSpec. The end result is the same - they say that I should have raised the issue sooner and it is too late to do anything about it so I am out nearly $5000. They also mentioned there had been a few other instances of this problem and they were no longer using Zenefits.

I have all emails between myself and Zenefits and DigitalSpec if needed for reference.

Desired outcome: I would like the funds deducted from my pay restored, either directly and a corrected W2 issued if required, or into another account that has the same tax advantages.
