Hello, my name is Elizabeth Padilla. I am the daughter of Ruben and Irma Padilla, current tenants in your 700 W. Sierra Ave. Woodlake, CA 93286. They are in apt. 35, have been tenants for over a year. My father is on disability and my mother is on a small pension under $200.00 a month. I wanted to get in touch with someone higher than the apartment manager , Vivianette Rivera, as she is not handling things legally in the Woodlake apartments. My parents have received a rent increase letter from management on November 28, 2023 stating that rent would be increasing 17%, which is illegal as there are rent controlled rules on this. Vivianette stated that all notices had gone out in August of this year, this is not true as no other tenants received anything either. Also, the letter states that there are 60 days for the rent to be applied, but when Vivianette handed the letter to my parents on November 28, 2023 she said that the rent would increase starting December 2023. She has also told all other residents that this was the case for all and if the increased rent was not paid by December that an additional late fee would be applied. When I address Vivianette with this data she went ahead and said that this was an error, but only after I had addressed it through email (which I have). She then replied that the rent would only go up a 10% increase. Which is still higher then the other tenants, my mom is friends with two other tenants on the property that have only been increased a 7%, obviously the higher management can investigate this to be true. According to the rent regulations a regular 5% increase is allowed and then a cost of living would be added which in that county is about 2%. I want to know why my parents are being increased a 10% instead? Is it a retaliation to the mold problem that was present a few months ago in the apartment? Basically what happened was that there was a water leak from the upstairs unit and leaked through my parents apartment in the bathroom. The leak was not being handled when my parents had reported a few times. This water leak has now been properly fixed but only because I had to email Vivianette about it. Mold was present and my parents had just recovered from a mold exposure from a previous home.

I am the person that handles things for my parents as they have been taken advantage of many times before. My parents have given written authorization to Vivianette of this. As of this morning 11/30/23 @ 8:45am, Vivianette knocked on my parents apartment and handed my dad the forms I had requested through email. She also told him that she would no longer be answering my emails, and to get a hold of another manager if needed and to let my attorney know everything.

If someone can please reach out to me as this situation is very stressful for my elderly parents. Both my parents suffer from a chronic disease and I do not want this situation to cause them any more trouble.
