Stallion Carpet LLC's activity appears to have been conducted under several other different names. I have also identified the same telephone number being associated with several of these businesses. At the same time, the names I have identified do not appear to correspond to separately registered LLC entities.
The combination of multiple business names, the absence of corresponding LLC registrations, and the repeated use of the same telephone number raises a question as to whether these businesses were operating as separate entities or were different names used in connection with the same underlying business operation.
This is particularly relevant when determining who actually operated the business during the periods in question, who was responsible for its obligations, and under which legal or assumed name its activities were conducted. The shared telephone number provides a potentially identifiable link between otherwise differently named businesses and therefore warrants examination alongside state business-registration records, assumed-name or DBA filings, financial records, contracts, advertisements, and other documentation identifying the individuals and entities behind each name.
In my view, the significance is not simply that different names were used. It is that multiple names appear to have been connected through common identifying information while the corresponding legal structure remains unclear. That pattern makes it important to establish the actual relationship among the businesses and whether the changes in names represented legitimate changes in branding or business structure, or instead had the practical effect of making the continuity of the underlying business more difficult to trace.
This conduct has been reported to the Texas Attorney General's consumer-protection system because of concerns that multiple business identities may have been used in connection with the same underlying business operation and may have had the effect of obscuring the identity of the entity responsible for the business's activities and obligations.
The report concerns the use of approximately four different business names, the apparent association of the same telephone number with multiple businesses, and the absence, to my knowledge, of corresponding LLC registrations for those names. Taken together, these circumstances raised concerns about whether the different business identities were being used merely as legitimate trade or assumed names, or whether they were being used in a manner that could deceive consumers, obscure the identity of the business operator, or avoid responsibility for prior conduct and obligations.
I reported these circumstances to the Texas Attorney General's consumer-protection system for review rather than presenting my interpretation as an established finding of fraud or unlawful conduct. My concern is that the repeated use of different business identities, particularly where common identifying information appears to connect them, may make it difficult for consumers, workers, creditors, or other affected parties to determine which person or legal entity is actually responsible for the underlying business activities.
I believe the relevant business-registration records, assumed-name filings, ownership information, telephone numbers, addresses, advertisements, financial records, and other identifying information should be considered together to determine whether these businesses were legitimately operating under different names or whether the pattern constitutes deceptive or otherwise unlawful business conduct.
