Property Preservation Landlord will not refund deposit

My family moved out of her home on August 31, 2009. The house was cleaned and in better shape than it was when we moved in. I called Tina Hart the first week of September and informed her that we had moved out and what did she want me to do with the keys. I also asked about how long before our deposit would be refunded. She told me that she was unsure but as soon as her husband inspected the home she would know something. October came in and we still had not heard from Tina regarding our deposit of $800. My husband began calling her and leaving messages she would not call us back. My husband stopped by the office in late October and she talked to him on the phone, crying and saying that she did not have the money to pay us back and she would when she got it. My husband was very disgusted and disappointed because we really need our money. I called Tina back that same day and we talked about installment payments. I asked her to give me a call at least weekly and let me know about the status of the house being re-rented so that I could get my money when they paid their deposit. She has not called me. I drove by the old house and there is no longer a for rent sign. I called Tina about this she said she doesnt know where the sign is but the house has not been rented. It now has been over a month since the sign has been down. I know my deposit should not be contingent upon her re-renting the house but I was trying to be patient. I called her the week before Thanksgiving and she told me that I was harrassing her and if I wanted to, to just go ahead and sue her because she doesnt have the money. I am so frustrated because I paid my deposit in full and my rent on time each month for almost two years and they didnt want to fix anything. I thought that deposits are supposed to be put in trust to draw interest, not just be spent so that tenants who do what they are supposed to do arent left footing the bill. Whats messed up is that I dont have the extra money to even go to small claims court anytime soon to try to get my money that way.
