I responded to a job listing posted on Indeed.com by Lucidus Marketing for a “Customer Support Representative” position. The listing described the role as a customer-facing support position involving handling inquiries, providing product recommendations, and collaborating with a management team. The listing stated the company was expanding its “internal customer service and sales division” and referenced “comprehensive training.” Preferred qualifications included a bachelor’s or associate’s degree and at least one year of customer service experience. The listing did not disclose the compensation structure, did not indicate the role was commission-based, and did not describe the position as independent contracting.
After applying and engaging with the company, the role as described in the listing did not match what was presented. The position did not involve handling customer inquiries or providing support in a traditional sense. The actual work involved direct-to-consumer sales and recruitment activity. The compensation structure was not salary or hourly wage but was dependent on personal sales volume and the recruitment of additional participants. This information was not disclosed in the job listing or during the initial stages of the hiring process.
The language used in the listing—including terms such as “outreach,” “market research,” “sales development,” and “service-driven sales strategies”—functioned to present a recruitment-based sales operation as a conventional customer service position. The listing created the reasonable expectation of a standard employer-employee relationship. That expectation was not met.
Additionally, Lucidus Marketing produced a document indicating that I had passed a drug test. I never submitted to a drug test at any point during my interaction with this company. No sample was collected. No testing facility was visited. No test was administered. A document stating that I passed a drug screening was created without any test having taken place. I did not authorize or consent to the creation of this document.
