Upon our mother's death, I contacted Guardian Savings Bank for my three siblings and myself to determine the status and to close any "payable upon death" (PUD) accounts we would inherit. I set up a time that all four of us could be present with the necessary documentation to support our identity and connection to our mother. We set the appointment with the at-the-time Branch Manager for more than a month later.
When we arrived at the agreed upon date and time, we changed the address associated with mom's accounts to mine as mom was no longer alive or at the address they had on file. We were reassured that the address would be updated and I would receive all future statements and/or mailings.
The same Branch Manager with whom we scheduled, was unable to pay us the amounts due from mom's accounts. He told us, we would need to return and that he would have a check for each of us at that time. This was annoying as we rearranged our work schedules to meet his demands. To arrive and then have to return (out of town) to collect the funding that was legally and rightflully ours, due to an "oversight" on his/the banks part, was incomprehensible.
We have since received the funds, but not without significant concern that something nafarious was happening in our mother's- and quite potentially, other elderly customer's- accounts (Senior Financial Fraud). I reported our concerns (suspicion of Senior Financial Fraud) through the Guardian Savings Fraud report. I never received a reply. Nothing to provide reassurance that the bank was on the up-and-up.
Several months later, Guardian continued to charge our deceased mother's checking account (left open to pay any outstanding medical bills) a monthly "return to sender" charge while mailing all bank statements to her previous address- the very address we changed when we arrived for our initial, unsuccessful visit to receive our PUD checks to close all the other accounts. When questioned about the unfair charges due to their mistake, Guardian reported that they were not going to refund the account.
Upon follow-up to see if mom's account was still being incorrectly charged for returned mail sent to the wrong address, the VP at the branch reported the original Branch Manager (the one who failed to provide the PUD funds initially, and the one whom I reported on suspicion of potential fraudulent access to our mother's accounts) had "decided to stay home with his family". However, at a later visit to the same branch, the new Branch Manager reported that she was replacing the previous manager who is "working at another financial institution". Sounds like a cover up in my book. I do not trust Guardian Savings Bank and am seeking legal representation/advisement on behalf of our mother.

Claimed loss: Travel and work expenses for unsuccessful collection of PUD funds; refunding of all "return to sender" charges and any legal fees incurred to clarify suspicion of fraudulent access to our deceased mother's account(s).

Desired outcome: Legal advisement; update on reported suspicion of senior fraud; reimbursement of expenses and explanation of charges for failure to update address as supplied.
