Hi,

I have no idea if we did sent this email to the right person or department please bear with us.

We don't know what to do and where to go to file a complaint regarding a refunding a deposit that had been made at the time we went to Hyundai Country Hills.

We are under the assumptions that putting a deposit is a gesture that we are interested and committed to purchase a vehicle and it is needed in order for the financing process to go through. We are hundred percent sure that we did't commit on buying the vehicle right away since we are still have no clue on what will going to happen from the financing application. So on the next day, we went to the dealership and discuss the financing options. What they gave us is not what is exactly the numbers we heard from them from the first day, due to the financial risk or whatsoever they asked us for a reasonable amount of down payment so they can give us the vehicle on a lower payment amount.

We told them that we can't afford the price so they scrap the first vehicle and presented us a second one which we are do not like a bit and still the price is not affordable for us. So they showed us a third vehicle which we really like, but since they don't have the complete information regarding that vehicle and its time for their store to close so we decided to wait til tomorrow for the numbers. I told them go ahead to do your stuff figure the numbers let us know and we will see about it, Upon leaving the parking lot, the sales agent hurried back to us and asked my wife to sign something so I let my wife to go inside and I stayed outside. She signed the papers but without a full knowledge that it is a final purchase.

Now the next day the number they gave us still don't mach our budget. If we cannot both agree on the price and terms then the deal is off of course. We do not want to go on something that it will ruined our financial capability on the long run of course. So we told them that we cant afford it therefore we are not gonna purchase the vehicle. Hence, they supposed to return the deposit.

If they have a policy of no refund they should clarified it and verbally explained to their customers since from the start before asking for any deposits or signing anything. It is ours - consumer, the responsibility to read and comprehend the documents before signing but also they have the responsibility to educate us since they are the one who are experts on that particular field. They should completely and reiterate the policy to the customers as putting a deposit and signing a document is a very delicate matter. If they do really care about us and they have the integrity that they keep telling us then they should have ensured in any way possible that we are aware of that policy no matter what.

Why the Alberta doesn't have the law about this matter? it should be added in the Fair Trade Agreement. Consumers like us who are not completely educated about trivial matter should be protected. Why should I have to pay them $500.00 when the the deal is not completely made?

We have no idea what to do about this, We are asking for your assistance regarding this matter

The same thing happened to me.On Friday, 13 March, I met with Dana Lucio, the Fleet MGR at Country Hills Hyundai to inquire about Leasing a vehicle. After some pressured negotiations, we agreed on what I thought was a monthly lease payment. Dana left the office and returned with some papers, he then checked off ‘Finance” when I said I did not want to purchase a vehicle that I wanted to lease, he said” Brenda, we’ve gone through everything, we’ve given you such a great deal, let’s get the ball rolling and if you decide that this isn’t the way to go, after you bring your car back, we can look at something else.” (I did not have my vehicle with me as it was in for servicing). He then asked for a $2000.00 deposit, I asked why I had to leave a deposit if nothing had been finalized yet. He assured me that if the price they offered me for my vehicle was different, once they did an appraisal on my current vehicle, that we both had the right to cancel the offer. I then met with Billy from Finance and we went through the financial forms, I asked again if the deposit was refundable, if the price changed on my vehicle and he also said yes. When I left, at 11:35 to go pick up my vehicle, Billy had not yet heard back from the bank. Billy called me at 2:13 to say that I had been approved for financing.
Afterwards, I spoke with my Accountant and he insisted that in my line of work, ( I am a Sale Representative and leasing has its advantages and benefits). I then called Dana at the dealership and told him that I did not want to go through with the deal, he told me to come in and we could work something out. I returned to Country Hills Hyundai at 5:15 pm and met with Jarrett Schneider, the Sales MGR, he asked me what was going on. I said that I had spoken with my Accountant and decided that I wanted to lease rather than buying. He said that the only reason my Accountant had told me that was because he was lazy and did not want to figure out the depreciation of the vehicle! I was quite shocked that he actually said this. He also said that I had signed a legal binding document and that they could sue me for the price of the vehicle. I said that the deal was never finalized as when I left, Billy was still waiting for a finance approval. He said, “That’s not the way it works”. I have leased 2 vehicles in the past 7 years and have never been asked for a deposit. I then asked for my deposit back and was told, and I quote Jarrett, “Suck it up, that’s mine and I don’t have to give it back to you”! I said, “No that I was told by Dana and Billy that if I decided to cancel, that I could have my money back, ” he said, No. I then left and called Dana back and insisited I wanted my deposit back, he said he would have someone call me back and no one ever called me back.
On Tuesday, 17 March, I noticed that they had put the deposit through on my MasterCard and called the dealership, I spoke with Ryan, another Sales MGR, while I was speaking with him, I could hear someone in the background saying, ”she bought a Toyota, ” Ryan then asked me if I had bought a Toyota, I told him that I had not purchased anything yet. He asked if I was going to buy a Toyota, and I said that it was none of his business, he then said that if I threatened him, he would hang up on me and would not go any further. I don’t think that what I said was threatening in any way. He then said he would review my file, talk to Jarrett and get back to me, 2 hours later, when I had not heard from him, I called back and was told by Ryan that they did not have to give me my money back.
On Wednesday, 18 March, I called the dealership and spoke with Jordan, the General MGR, after explaining the situation, he said he would speak with his team and get back to me. After several hours I called back and was told by Jordan that the deposit was non refundable. I then said I would come by and wanted copies of everything I had signed. I arrived at the dealership at 6:15 Wednesday evening and was met by Jordan, who gave me a copy of the Vehicle Sales Order/ Bill of Sales and a Conditions and Terms of the vehicle sales order/Bill of sales. Copies attached. (I would like to add that I was not shown this information when I was there previously). I then said I would like copies of everything else I signed and Jordan said they did not have to give me that, I then asked for the financial agreement, and again was told he did not have to give me that. I then asked for my deposit back and again was told that he did not have to give me that. I then asked him where on this sales order was my $2000.00 deposit recorded, he said they did not have to include that.
I have talked to other car dealerships and many of them have stated that a deposit is refundable and that I am entitled to my deposit back. I have also noticed on the website, www.dealerraters.com that they have done this in the past. I feel that I am entitled to get my full deposit back as the deal was never finalized, that nothing was added to the vehicle and that I called back within 2 hours of leaving the dealership to cancel it and that they had just gotten financing approval.
If I would’ve been told from the start that the deposit was non-refundable I would’ve never given them $2000.00. All I want is my deposit back so I can start to look for another vehicle. I have also filed a complaint with the Better Business Bureau. I am hoping you can help me with this matter.
