How does Bidrack Work?
Register for a free account. Get a free spin on the bidwheel to earn bonus bids. Purchase a bid

pack for more bids which never expire! Each bid costs on average $0.50, depending on which bid

pack option you choose. Once purchased bids are placed into your account every time you place a

bid your bid credit will go down by 1 and the price of the product will go up by just 1 cent. The time

of the auction will increase by 15 seconds every time a bid is placed. If no one else places a bid,

when the clock hits 0 you win!

Once you win its time to pay for the auction. You pay the ending auction price plus a $1.99 to

$19.99 shipping fee depending on the product (Gift Cards are only $1.99 while items delivered

instantly, such as bid vouchers, incur no shipping charge). If you do not win you still have a chance

to buy the product at a discounted rate! Simply use our Buy It Now feature. The Buy It Now

feature allows you to apply any money you spend during the auction placing bids to the Buy It Now

price. So for example lets say you spend 25 bids trying to win a $100 product and you did not win.

Your 25 bids are worth $7.50 (25 x $0.30), simply click buy it now and the $100 price will have the

$7.50 you spent on bids deducted from the price! Please note that we calculate the average bid

value here to be $0.30 due to the free bids given out on the bid wheel

I couldn’t help but note that Delaware is not on the current list of states that DO NOT require licensing. Do you believe like I do that ANYONE who has been adversely affected could make an inquiry with the Delaware Governors Office of Consumer Protection for specific information of the licensing requirements of that state that BidRack.com has a registration?

Very good reply to that ellen67, very calculated and professional. I have enjoyed meeting you ellen67, and I am almost sorry that this Bidrack smash and grab is winding down so fast. Sorry that we will not chat more, but glad that fewer people will be exposed to this abuse. All but few affiant offers are removed from the engines and most all the banner ads, pop-ups, sponsored search terms, and unsolicited e-mail are gone as well, so this one has runs its course. Maybe we will meet again when the next penny auction makes star status and is in need of your talents. It won't be hard for me to tell which auction site is next to come to life, I just need to open my gmail daily and watch for information as to where I can find 1000 Amazon Kindles Selling Today Only for $21.67 each. One Per Customer Only. Hurry Before They Are All Gone ! lol

Thank-you ellen67 for giving me an inside glimpse of your reasoning to comment so frequently, most kind of you. If you read my comment again, you will see that I never referred to you as speaking with obscenities nor would I ever. You have a class act going here and I know you wouldn't spoil it. If you were not aware of this before now, it takes at least two people to pull off a good cop – bad cop routine.

I am glad though, that you made references to "if you agree to a contract, you are responsible for it. If information is provided and you don't read it, that is the consumer's problem. Hmm, you already sound like a consumer service representative. So, okay let’s talk about the "contract" that you deem a personal responsibility. I always thought a contract was a written agreement of a "meeting of the minds" where two or more parties agree to specific terms and conditions for a transfer or exchange of products or services. This contract should be mutually beneficial to all the parties involved. What has your “own share of mistakes in life” taught you in real terms that govern your daily actions? Did you learn that a one sided contract that doesn’t represent a “meeting of the minds” is binding simply by someone signing it. Tell me further, ellen67, if you learned anything about the legality of any contract that is obtained through fraudulent means, omissions of pertinent information to the contract, or if any of the parties to a contract fraudulently misrepresent material terms or conditions.

If that is too vague for you, perhaps you can look through any of your old contacts for employment to see if perhaps there are places for both parties to identify themselves legally, truthfully and that information is sworn to and signed in the presence of a lawyer or notary. What do you think of that contract standing up in court if it contained any false information or if one of the parties did not sign it?

ellen67, I really enjoy your manner and your fireside chat approach to do your business but I find it really hard to reason why any sane person would be here defending a company that they do not even have a membership or use as you state by this comment "I stopped short of putting my credit card info because I realized they were going to charge it" and further you add "So I have no love for this company". So why, ellen67, do you spend so much of your time commenting so often on companies that you do not have a love for? I especially like this good cop - bad cop thing you got going on today. Nice touch, but spouting four letter obscenities from the same mouth that throws around terms like "ad hominem attacks" is a bit of a stretch of that old routine.

Any class action takes much time, can never guarantee that you will get any of your money back, and the scam will be packed up and moved on to a new one long before it gets to trial, if it survives the first year of pretrial BS to be actually heard by a judge and jury.

The details of the penny auction site that allegedly acted in similar fashion as BidRack, can be found in charges that the Federal Trade Commission just laid in May of this year, a full year and a half after that penny auction began its pioneering actions of charging huge membership fees without proper notification or authorization. This penny auction mentioned in this FTC complaint folded on its own account and before the end of 2010.

FTC Charges Online Marketers with Scamming Consumers out of Hundreds of Millions of Dollars with 'Free' Trial Offers
“The defendants allegedly contracted with affiliate marketers whose banner ads, pop-ups, sponsored search terms, and unsolicited e-mail led consumers to the defendants’ websites, and the defendants paid the affiliates for each consumer whose credit or debit card was charged. The defendants allegedly made false claims about the total cost of products, recurring charges, and the availability of refunds. They also buried important terms and conditions in fine print, the FTC alleged.
The complaint charges that the defendants’ penny auction offers falsely indicated consumers would receive free “bonus” bids, but those who provided credit or debit card numbers to facilitate future auction buying were hit with charges they did not know about, including $150 for introductory “bonus” bids and $11.95 per month for ongoing “bonus” bids. The FTC also charged that Willms and his companies made false weight loss and cancer cure claims for their products, and touted bogus endorsements by Oprah Winfrey and Rachael Ray.
The FTC further alleged that the defendants provided merchant banks with false or misleading information, in order to acquire and maintain credit and debit card processing services from the banks in the face of mounting chargeback rates and consumer complaints. Willms and his companies also allegedly violated the Electronic Fund Transfer Act and Regulation E (issued by the Federal Reserve System’s Board of Governors) by debiting consumers’ bank accounts without their signed written consent and without providing consumers with a copy of the written authorization.”

These charges were laid in May, and it is now July without any public notification that this Motion has been heard by a judge or granted. At this time all charges are simply allegations of wrong doing and therefore the named defendants should be considered to be innocent of all charges until such time as they are proven in a court of law.

You are right when you say that you believe that registration page has changed from when you first signed up. I also was drawn to that website 2 weeks ago by advertisements that keep creeping into my gmail account. Some days there were 3 of them placed in the top, bottom and side areas of my reader? When I first looked, I filled in my email and bidder name desired but was then transferred to a second page that had a small disclosure of bid pack purchases available and one was already pre selected and I was unable to change that default to any less expensive pack. I will say that page 2 is very busy with bells and whistles and videos playing, all to distract your attention from areas of the page BidRack didn't want you to notice. I don't like any of these deceptive practices used to lead or steer people on any website so I did not complete that form to register for "Free".
I did check back to that same "Free" registration last week. It has changed from my first visit just as you describe.

I agree with the complaint above and your comment, JKDE, up to the point of "When you accept their "terms and conditions", you agreed to be ripped off by them". I would agree with you on that point if those "terms and conditions" were made with a legitimately registered company or website that is not fraudulently withholding vital information of their true identity or location. Would you feel that you are bound by any "contract" with a say, John Smith of Oklahoma City, when you later find that you were deceived by a flimflam man, aka Matt Bunko, from Seattle WA.? Does BidRack disclose in their mighty "terms and conditions" document, who they are accurately, truthfully, or even at all?

A second point I would ask in the area of contract law is "When was the last time you ever read a printed document of contract that states that one party has the right to modify the terms at any time and at their discretion? All contracts are between two or more parties and fully outline the terms as they exist at the time of signing, and can only be modified afterwards by agreement of all parties to that contract. That alone is reason to file that TOS rag with your used tissues in the round receptacle.

I would love to continue this battle of wits with you all, but I am somewhat apprehensive of getting into a fight against unarmed wo/men. These idiotic comments you all place everywhere to defend the many penny auction rip-off discussions is only your narrow minded and perhaps, monetized, viewpoint to so many requests of refunds for something the people feel they were tricked into and clearly DON”T want. Everyone has the right to deal with any merchant they choose and have the equal right to not deal with any merchant that they decide NOT TO. Everyone has the right to cancel any contract and withhold payment from any merchant. Once the contract is disputed by a third independent party, such as a court of law, that is a decision that is binding on both parties, NOT a decision reached by some banker to protect their interests and to boost profits.

What makes you think any merchant has the right to force a consumer to deal with them or keep the money after they have discovered they have been duped? Can you spell S C A M ?

I don't think it is very fair that 80% of these complaints are about people making mistakes and blaming it on companies. This complaint is under bidrack.com. Bid Rack is a scam, Zbiddy, and so is Quibid. Your "friend" got free bid points for referring you and getting you to sign up.

And new one's are popping up every week on TV looking for suckers who think they can get a Ford Mustang for $120.00 or an Iphone for $27.00, or an Android for $19.95.

They cover their butts with the terms and conditions. They are not hidden. When you accept their "terms and conditions", you agreed to be ripped off by them.

Contact your CC company and your Attorney Generals Office and file a complaint.

This Co. should and will be shut down. They have taken money from my account without my permission, I had to close my account. I tried getting ahold of their 24/7 suppoet, that was a joke and a waste of time, I was either put on hold for hours or hung up on. You must work for them along with the other people who have made positive comments.

Oh, how disappointing. Am I reading this correctly!? Please correct me if I am wrong. Is this post from scambook.com trying to form a class action suit? Now I feel like an idiot. It seems as scambook is using their complaints to for law suits and gain money. This can't be true. How super crappy if so. Talk about ethics!? And again, correct me if I am wrong did they say bidrack.com and then say Quibids. How many companies are they doing this to.

I'm sure this post will be deleted in no time.

If you believe you have had Unauthorized Credit Card Charges, been a victim of Deceptive Marketing, or otherwise unfairly treated by the online penny auction - BidRack.com you must deal with these matters immediately with your credit card company or bank in case of debit card use. You MUST notify these financial institutions in writing and state the reason for your request to "Charge Back" any of these transactions. Also continue with your reporting of your experiences with that company as you have done here and by all means file a report with the Better Business Bureau and Federal and State consumer protection agencies. Call your credit card company and request they charge the merchant back, or do whats called a chargeback, dont even bother dealing with bidrack they will only refund if you complain 20 or more times, just call your bank, tell them you were charged $99 and never agreed to it, and you want them to initiate a chargeback for you so you can get your money back, if the bank says no or tells you to call bidrack tell them your next call is to your local attorney general and BBB office if they dont do the chargeback or ask for a manager. They are required by law to open an investigation in to the charge they tell you no so they dont have to deal with the work
