Beverly-Hanks Realtors - Agent did not do job well

In 2006 I flew into North Carolina to find a home. I hired an agent from Beverly-Hanks Real-Estate Company in Asheville. When we found a home, I left instructions for the real estate to investigate the property we were interested in. She was to look into the right of way, I had a question on. The sellers said there there wasn't a right of way. I also left the agent to follow up on the rest of the disclosure and hire the right people to do inspections, closing & ect. We got an inspection and she was to see that the work was done. When we moved into the house the found out that the house we had was not the house on the contract. The agent let us down. The right of way was on our property. We had a fixer upper when we made it plain we did not want one. We don't feel the agent did her job and she hired others that did not do their job. Paid too much for the home, now have to fix it. WE had to go after the sellers and they are neighbors. This has been an finanical disaster for us. This has devastated us in every way possible. We can not live in peace. We were let down by the agent and the company does feel they owe us a thing. They told us things happen. It is hard to suck it all up with a smile. Left 110% holding the bag. Between a rock and a real hard place.

Dear Rockandroll, We hired the agent, she was the buyers agent. Our agent not for the sellers. We had a closing attorney. WE had an inspection. The sellers signed a contract agreeing to fix the problems. They gave a disclosure that was not true when they could have said no representation. Then we would have been a bit wiser. Hoe do you know when you enter into a contract that the others lied and will not honor the contracts. We honored our side. We thought we had everything and everyone in place to protect us. But if the other side lies and the law will not make that responsibility then what were we to do. We are nearly insane. We were not lazy by our lawyers take on the laws. Yes we could have been ignorant for thinking that a contract was binding. We have complainted all these years and it never did a bit of good with the companies involved but as long as we have to spend time and money on this perfect house then I am going to get the word out, in case I can help one other person. Our agent let things happen and never involved us to make sure we were okay with it. We were out of the area when the house closed so we sent off the paperwork to our agent who we hired to look out for us and who did not. I think the whole nine yards here is crooked. So buyer always beware, we got a home that was not in the contract. The one in the contract that was perfect did not and had not existed, but soon will. We are going to fix it. We never dreamed our retirement would be this way. Old age is enough to deal with and crooks that know how to get around the laws should have to go to jail or pay all the money back. Nothing these days is binding.

Always, always do a walk through before closing. If the contract is not satisfied, then delay the closing on those grounds. At the time of closing all the agents care about is their commission. You have the power to delay closing in order to get them to do their jobs. Don't tell me, "Well, we had to move in." If you say that, then you get what you get. Your first mistake was engaging with a Beverly-Hanks agent. I am currently working with a tag-team of 2 agents as a buyer. I have bought and sold many properties in many states, and I can say without backing up that these 2 Beverly-Hanks agents are horribly incompetent, unorganized and stupidly lazy, apparently with no leadership from within Beverly-Hanks. I'm walking away from Beverly-Hanks and should have too.

2006 was 7 years ago. Did you hire the agent? If not, they work for the seller, so basically, you let the fox guard the henhouse. Pure insanity, laziness, or ignorance. When buying a house always hire a lawyer and get a home inspection. Comaining 7 years later does nothing.
