Florida Club Apartments

Fraud- Lies- Misleading Advertising- Unethical Practices- Irresponsible Labor- Water Leaks- Fire Department Noise - Florida Turnpike Noise- Boynton Beach Blvd. Noise! Noise! Noise!

Before you even visit the Florida Club Apartments please read this article about my experiences with living under a Florida Club Apartments.

1. (Fraud) (Misleading Advertising) ... I was told by Jaynee Belzer and Kelly Shearer who work in the Florida Club Apartments that the 2 bedroom 2 baths apartments were 1200 square feet. Not only do the Florida Club Apartments print up the wrong square footage on their floor plans they hand out but also list them on the Internet. The purpose of this fraud is for them to benefit financially.

In June of this year, I took a measuring tape and matched it up to the measurements of the printed advertising material and found that the apartment was approximately 1016 square feet.

I spoke with the Florida Club Apartments Attorney Darren J. Ayoub, at the Law Firm Barfield McCain. (561.650.8139) he advised me there is nothing wrong with the Florida Club telling potential residents the incorrect square footage as long as the Florida Club doesn't put the incorrect square footage in the lease. However, Florida Statue 509.032 states, the division of Florida Department of Business Regulation shall be responsible for ascertaining that an operator licensed under this chapter does not engage in any misleading adverting or unethical practices.

2. (Lies)... Before I moved into my apartment I was very concerned that the Fire Department property was 20 feet from my apartment. I ask Jaynee Belzer and Kelly Shearer representatives of the Florida Club if the noise from the Fire Department was loud? They assured me that it was not a lot of noise and that they had an agreement with the Fire Department not to turn on their sirens till they reach Boynton Beach Blvd.

I’ve never seen the agreement with the Fire Department and I doubt that there is even one. I can assure you that the Fire Department does turn on their sirens before they go out the gate and have videotaped it on my phone. My neighbors can also attest to this fact.

I never had to wear ear plugs while sleeping because of the noise levels before moving here. However, one month in I was losing so much sleep from these huge fire trucks coming in all through the night. On top of that you have the Florida Turnpike International Raceway where you can feel the truck drivers down shifting their gears. One more thing Boynton Beach Blvd is the closest to the building I live in so that adds even more noise. The combination of all three noise makers does not allow me to even on a cool day to open up the doors as the noise level is that loud you can't really enjoy anything!

My apartment from what the neighbors told me was vacant for more than a year. Jaynee Belzer and Kelly Shearer will say anything to get someone to lease an apartment. On top of that they were such in a hurry to move me in on Jan 28 2013 instead of February 1 2013, so that they can make the quota that they forgot to check the a/c which did not have coolant in it and both showers were broken so I had to take 4 showers out of the sink.

3) (Irresponsible Labor)... When I moved into the Florida Club Apartments they advised me that I needed to get $100, 000 personal liability coverage to cover anything I might damage. I purchased that plus $30, 000 in personal property coverage for my personal property through the company that the Florida Club Apartments recommended. The company was eRenterPlan policy# [protected].

In May 2013 the Florida Club Apartments sent workers they hired on the roof to clean off the algae and or dirt off the roof tiles. These workers had machines that looked like a floor buffer machine.

Before they were on the roof in 4 months of living here at the Florida Club Apartments I had no leaks in my apartment. On May 22 2013, less than a few days after they worked on the roof we had a rain storm that caused the water to flow (not trickle) into my closet where my clothes were saturated and a painting valued at $2200 was ruined. I immediately called Jaynee Belzer the Property Manager and told her what happened and they sent out the roofers out to fix the problem they caused. Since May I have had to call them 2 other times due to the rain leakage in my bedroom.

I ask them if they had insurance to cover their irresponsible actions. I was told that I needed to file a claim with my insurance company.

Even though it was a rain storm that caused the damage it was the Florida Club's hired labor that caused the damage.

I called my insurance company and a representative of the company came out and after reviewing the situation advised me that it is the Florida Club Apartments that is responsible for the damage to the roof that caused the flood in my apartment. I wasn't the only apartment that had damage as my neighbor and others told me the same thing.

In fact due to the constant leakage I had moved my desk and computer out of my bedroom because the water was falling within inches from my computer and I knew the Florida Club could care less about my property.

When I notified the Florida Club Apartments Attorney Darren J Ayoub of Barfied Mccain (561.650.8139) stated that the Florida Club is not responsible for any of my personal property. He quoted the lease agreement paragraphs 8 and 24 entirely. However, nowhere in the paragraphs does it mention that they are exempt from liability from their own hired labor causing the damages.

Just so you know if you move in that your personal property will not be covered due to the irresponsible actions of the Florida Club Apartments even though you may have Insurance covering everything.

I have already filed a complaint with the State of Florida Business Regulation regarding the fraud regarding the square footage.

I have already filed a complaint with the Better Business Bureau regarding the all of my complaints.

Some justice will come from me speaking the truth on the Internet that will inform future residents to beware of the lies, fraud, misleading printed advertising and irresponsible actions of the Florida Club Apartments. I have the every right (Freedom of Speech) to inform the general public of these very unethical practices
