We were introduced to Premier Consulting and Construction (aka. Terry Construction, LLC) through BuildZoom.com in 2020. I'd begun the process for our build on my own, ordering soils/perc tests, engineered plans, pulled permits and paid fees and then became overwhelmed by the process, so I reached out to BuildZoom.com. We invested under $2k to start the process of finding a builder and were introduced to 3 construction companies that were in our area. Of the 3 companies recommended, we met with 2 and hired Premier Consulting and Construction to build our home. T. told us he had a Class A license, had several contracts with the local military bases and promised us he could build us a high quality home, within our budget. He built a great relationship with us and went out of his way to be available by visiting, calling and texting with updates and follow-up. We had such confidence in him that we decided we wouldn't need the other services provided by BuildZoom.com, so we canceled our subscription with them. We signed our contract with Premier in September 2020 and due to finance delays began construction in January 2021. T. told us not to tell BuildZoom.com that we had hired him. He said that the fee for the referral was around $13k and that our build budget could not afford that. We have since found out that fee was his to pay.

The Borrower & General Contractor Sworn Statement and Description of Work line items seemed off and not everything was included for the build, but T. assured us and the bank that everything was covered. Once he was vetted and our loan was funded things got weird. Contrary to our signed contract, which states that the contractor will pay for all materials, equipment and labor, required for the job, and then submit invoices for reimbursement, we began receiving invoices from T., before work and materials had been completed or ordered. He told us that in order to get on schedules and for materials to get ordered, we had to pay upfront. So trusting what we were told was the process, we paid the first invoices submitted by T. in February 2021. Once we'd paid over $150k, everything started to fall apart. Communication stopped unless I contacted him. T.started saying: "I'll call you tomorrow." and "I'll stop by tomorrow." and "I'll be there in 30 mins." Then he wouldn't call, wouldn't show up or instead of 30 mins, he'd arrive 2 1/2 hrs. late smelling of alcohol. When we'd email, text or even talk in person, he'd promise to get us more information or update us on a situation, but never did. Because of the delay in the start of our construction, we needed a new contract with new start and completion dates, we never received that. We received material and service quotes, and although the bank and I pressed T. to proceed, he continually said either the other party wouldn't respond or that he would "get to it". We missed several deadlines and prices went up. So we paid more, had to cut back on materials and had to cut into different line items, from the Description of Work, to cover costs. The last time we met with T., he was full of promises, very animated and was difficult to keep on track discussing our project. Soon he stopped emailing and texts became short, vague and aggressive saying "show some patience", accused me of persistent texting (6 texts in 12 days) and said to give him time to recover (because he said he had Covid-19). In March, our project came to a complete halt for no apparent reason and no information provided. Then we found out, 2 months later, one of the subs was going to put a lien on our property because they hadn't been paid. When the foreman contacted me, very upset, he was shocked when I told him we had already paid T. over $150k. Once we paid all of the subs directly, we found out that T. had charged us an addition $34k over what the subs had billed for materials and labor.

We've asked T. multiple times to return our money to the bank and the bank has reached out to him too, without success. We've continued working with the foreman and his subs and will get our build to a "dried in" state before we run out of money on our construction loan.

Desired outcome: Reimbursement of loss and damages

Christopher Terry is now working as Premier Consulting and Construction or PCnC Inc.

He is still ripping people off, he hired homeless people to work and never paid them. The Denver DA investigator is getting ready to prosecute. My roof is leaking causing ceiling damage and he’s added 30,000 above his estimate and a month past when the contract said he’d be done. The job site (my house) is a mess, nails all over. Like everyone else said he shows up periodically, he lies and doesn’t care. All he wants is money.
