As part of our agreement to purchase at the time share presentation in Puerto Vallarta, a two-year program, "Ice Platinum Rewards Membership" (IPRM) was made available in the "purchase acknowledgement" at no charge for two years. On separate letterhead an addendum signed by the Raintree Vacation Club (RVC) sales manager, RVC acknowledged that "...unlimited use of the Platinum Rewards Program is authorized". It was our understanding since it was explained and presented as such, that the unlimited use implied unlimited us of the IPRM and website at no additional charge. We did not sign or verbally agree to incur any additional cost for this benefit. The final negotiation of the purchase hinged on us being able to use the services offered on the IPRM website, which are at a significant savings, therefore convincing us to purchase the timeshare.
We were contacted by Robyn with the Ice and Platinum Rewards Program and was advised of an additional annual fee of $299.00 (for the IPRM after the two year period), or another option was a $1498.00 onetime fee called the “lifetime plus”, which is good for 35 years. She also advised us that the annual fee would be increasing within the year. She indicated it is not uncommon for people to be mistaken about the "unlimited use" verbiage in the addendum. This leads me to believe that this is a predatory ploy used to falsely convince potential buyers of an enormous savings without informing them of additional cost.
The only fees outlined in any part of the agreement require either default or other action on our part such as transfer of points or requesting preferred membership benefits, etc. (Besides our promissory note $6, 625.75 (promissory note does not include our down payment of $1, 169.25 paid), maintenance fee $629 every other year, $111 multi resort membership fee every other year, and administrative fee of $699 paid at time of purchase)
I have tried to use three other "great deal" vouchers they gave us during negotiations. Not one of them is what it appears. I can find better deals for the same places either direct or on the internet. Another ploy.
We are disgusted with RVC's egregious misrepresentation and feel we were lied to and tricked into this contract.
In our conversations with RVC, they have indicated that we have no recourse and they are prepared if we wish to pursue legal action against them.
At this point, we would like to be back in the position of where we were before the agreement was made.
