As a commission only agent. I am supposed to be paid 3 days after Romix receives any payment from the client. However I am still waiting for my commission on a project completed is 2008. Romix has been paid a 3rd of their total costs to date.I am therefore entitled to a 3rd of my commission due. What bugs me is the CEO just says it is being used for legal costs.
What Mr. Archie Richardson does not explain is that he has failed to collect the entire contract amount from the Customer, as required from his Agents Agreement, which has subsequently expired. It is true that Romix Industries (Pty) Ltd. received only one third of the contract price from the customer. The payment did not even cover the cost of producing the products, let alone the costs the Company incurred in completing the project. Mr. Richardson was responsible for collecting the ENTIRE amount due on the project before he would be paid any commission. To date, his customer has still not paid the outstanding amount, and the Company had to incur major legal expenses to collect the outstanding amount he was to have collected in the first place. Mr. Richardson is now representing a breakaway Company - Polymer Pavements CC which was formed by a previous Director of Romix Industries.
The legal costs of recovering the payment from the customer, plus the loss of interest incurred by the Company, far exceeds Mr. Richardson's claim to commission which he never earned in accordance with the signed agents agreement. In addition, he has jumped ship and expects my Company to pay him commission for a job he left undone.
Mr. Richardson will have to try somewhere else.
