I entered into a contract on July 25, 2022, for the installation of a solar power system with a kw capacity and a 7.6 kw inverter. The agreement stated that the installation would be completed within 90 days or less, along with an upgrade to the main electric panel (breaker box). The salesman informed me that we needed a 200 amp service instead of the existing 100 amp service.

However, after the system was installed, they failed to upgrade the service despite multiple calls requesting them to do so. Eventually, they upgraded it to a 125 amp box instead of the agreed-upon 200 amp box, and they left the drywall around the box damaged. It took nearly a year, until approximately June 5, 2023, for the system to be turned on.

Upon further inspection, I discovered that they had installed a 5kw inverter instead of the contracted 7.6 kw inverter. This lower capacity inverter will not generate enough electricity to meet our needs, as confirmed by their system designer. When I brought this issue to their attention, they seemed more concerned about who informed me of the discrepancy rather than acknowledging the mistake. Since my call with them approximately a month ago on July 17, 2023, I have not received any communication from them.

To make matters worse, they have now sent me paperwork to sign for the *** Shines program, which downgrades the system from 7.6kw to 5kw. This downgrade not only affects the size of incentives we receive from the state based on our electricity production but also impacts the price rebate we are entitled to. It is evident that they have no intention of installing the inverter specified in the contract.

Given these circumstances, I am planning to consult with a lawyer soon to address this matter.
