My husband and I purchased 2 weeks of 2-bdrm. triple lock-off at the Playa Del Sol (or PDS) Grand, Nuevo Vallarta, Mexico, on Aug. 21, 2006 for a total amount of $51, 300. The amount paid at purchase was $23, 629.50. The following day, we tried to cancel our purchase and were told that we would lose all of the money we paid out thus far. Fearing the consequences, we decided to give the resort a chance. We paid off the balance on Sept. 25, 2006. We have run into nothing but problems ever since our purchase. We have not been able to book our weeks when we wanted to travel even though our purchase was paid in full. I was faced with roadblocks every time I requested a week at our resort. After threatening to bring in my attorneys, they finally "worked" with me on placing us in one of their resorts, not the one we actually purchased, PDS Costa Sur in Puerto Vallarta. Costa Sur was not at all comparable to the Grand, it was barely inhabitable with mold growing on all of the walls in our room. We complained and were moved to another room which was only a slight improvement. After complaining and requesting to be moved to the Grand, they eventually granted us a room at PDS Grand for the remainder of our stay. We faced a lot of resistance in trying to exercise our rights. We have now found out that the Rental Program, which would have allowed us to give back our weeks to the Resort for an equivalent of 1 to 1.5 times our maintenance fees, has been discontinued in 2007. No notice or acknowledgement was given even though this Program was included in our Contract. Their Customer Service department in Santa Rosa, California, is staffed with the rudest, most unhelpful, unwilling to provide any information or work with any requests that we may have. Their standard answer is always the same, everything is always booked, there is never any availability in the time and the type of rooms we own. Names of people we have dealth with this company include Eric Hompe, the salesperson, Jan Thomson, Michelle Doyle, Director of Member Services in 2007, whom no one at the call center seems to know, Brad (last name undisclosed by him) at the call center who could not give any names or information on how to remedy our issues. It seems that we have been dealing with a phantom company. Please help us get the word out. This is a horrible company practicing fraudulent activities and they must be stopped.

On July 4, 2007, and after 2 whole bottles of champagne which the saleslady gladly provided, I purchased a 2 bedroom triple lock off for $37, 500. After going back to my room to ‘sober up and sleep it off’, I awoke the next morning to realize I’d made a huge mistake. I immediately called our sales person and told her I wanted to cancel the contract. She asked that we meet for dinner where I again told her that I wanted to cancel the contract, and was told in no uncertain terms that I COULD NOT CANCEL THE CONTRACT! I was heart sick. She told me that if it’s about the money, she’d give me the name of a company, EMREM, who could rent the timeshare for 1.5-2 times what it would cost me. This service cost me $549.00 and I never received even one offer for anyone to rent my unit. I believe that PLS and EMREM were in cahoots to get this added outlay of money.

A few months passed and I just kept thinking that this situation was not right. I had been given a huge amount of alcohol, and the sales person knew I was absolutely in NO shape to enter into an agreement, then when after less than 24 hours I tried to resend the contract and was told I couldn’t. So, in October of 2007, I began talking to a lady at PDS (Tracy Santos), who said she was so upset that the salespeople continue to use such heavy-handed sales tactics. She could see that I was taken advantage of, that i was oversold, and that i should have been able to cancel the contract one day later, so on 10/15/07, she advised me to send her an email demanding my money back. She further advised me to call the credit card, Interval International, to dispute the charges and demand a charge back. I did this, but the I I credit card would not do a charge back, but my American Express which one payment was on, did do a refund after they heard the story.

I followed her instructions and PDS contacted me and told me there was no way I would get my money back, but they would down-size my contract to be for $20, 400 and would have the unit on a bi-annual basis.

I know that I should have been able to get my money back from PDS when I contacted them the following day. Because they did not honor my appeal to cancel the deal, which I've since found out they were bound by law to do, I believe I am still owed my refund of $20, 400. What they did was illegal and unlawful, and I should not be out the money on such a fraudelent deal.

With all the problems that Mexico is currently embroiled in, I would think that their government would want to right these wrongs that were made by unethical companies which are still operating there.

I'd love to know if anyone has had success in retrieving their money for PDS?

This company should not be allowed to do business anymore. Our story is very much similar to yours in which we were told we would be able to rent our units out for 3x's the maintenance fee making it a good investment. We relented and purchased a 2 bedroom for $18, 000. We have not been able to rent it out much less try to exchange it through Interval. There is NEVER availability at the properties we request or the destinations we would like to stay at and if there is availability the property is sub-standard to what we are trading.
Playa Del Sol is now requesting that we pay them more money to do upgrades on the properties. We are so fed-up with them that we are thinking about just walking away. Does anyone have any advice on what to do? Your help would be much appreciated. Thank you!
