It begins on May 03, 2023 when I tried to search in google an agency for Australia. I saw Pathways visa that day and send an inquiry. Richelle Mendoza send a message in my whatsapp number asking some personal information. I send to her my CV for assessment but since I’m pregnant that time, I inform her that instead of me, my husband will do the application. My husband is a skilled worker (Welder/Machine Operator) in South Korea for 11 years and I know that Welder is in demand in Australia because my brother is working in Australia as a Welder. She again assess the CV of my husband and inform that he is qualified in Australia. She also informed that the processing time is 6-8 months maximum. So then I asked her how much is their processing fee. She told me its AED 8,000 and that is a 50% promo because the original price is AED 16,000. She also told me that day is the last day of promo (May 05, 2023) so, even though I need my money for my check up, still I paid AED 3,000 (down payment) to Pathways on that evening to avail “their promo”. My husband sign for Australian Contract and submit all initials requirements. Ms. Amita, the case manager start to communicate to my husband. She required documents for our Australian application. We also did translation since the previous company of my husband was in South Korea. We completed all the required documents as per their advise. While completing the documents, we are paying also the remaining balance and finally we completed the payment last August 2023. June 02, 2023, Richelle told me that my husband need to start PTE training and she recommend another kabayan. I paid AED 1,700 to Ms, Mia (the trainor), but she didn’t give us a receipt. Suddenly, Ms. Amita send us an email informing that the occupation of my husband has been out of demand and eliminated in Australia. This is very frustrating from our side since we already paid the total amount and completed all the required documents. We request to cancel our contract but they inform that it’s not possible. They offer us to transfer the application of my husband in Canada. But I refused because I know the Canada requirements and processing since I also have application in Canada. I told them that they cannot change suddenly our contract because from the beginning we inquire for Australia not in Canada. But they insist that we cannot refund our payment. So, I chat Richelle in whatapp and ask why and what happen to our application. She told me that she was also disappointed and ask her about the refund but she didn’t reply. Ms. Amita send an email that they will transfer the application of my husband to Canada which I didn’t agree. So, I decided and reply to them instead of my husband, they can try to apply me since I have the required documents in Canada (as I have also application on the same but in different agency). They agree and I send all my documents to Amita on August 21, 2023. Amita applied me in Saskatchewan (SINP) and upon checking my online application, I noticed that they put CLB 8 and higher (20 points) in my language eligibility which is wrong because my IELTS is only 6.0 band and CLB 8 is around 6.5-7.5 band. I ask Amita about that and she told me that she need to put increase my IELTS score to get the minimum score of 60 points in SINP. Which is totally wrong.

In overall, they are just playing with us. First, after fully payment and completed the documents for Australia, they will informed that the position of my husband is out of demand and eliminated. They want to transfer his application in Canada, why? Because if my husband didn’t comply with the requirements (WES, IELTS required band), it will be fault from our side not in Patways. Now, they applied me for SINP (express entry) even though they know that my IELTS if not qualify, just to let us know that they are doing their job. Then what? If in case my profile will be selected, they will then inform me that I need to take another IELTS to get the required score. If I didn’t get the required score, then it will be again our fault not theirs.

Moreover, why I told Richelle a liar and cheater? Since day 1 of my inquiry, she already lied to us. I received an email to Pathway info that they consultancy fee is only AED 5,999. But see, why I paid AED 8,000 which is already 50% discount? She reply that due to new campaign of Canada government that’s why they decrease their processing fee. They decrease their processing for AED 10,000? From AED 16,000 to AED 5,999? That’s impossible right. Where is their honestly and reliable. They cheated also when they apply me in SINP. I am not expecting to be selected on that program since I know that my IELTS is not qualified. They should be honest to their client all the time.

Until today, October 21, 2023 they refused to give us our refund. That’s why I decided to file a complaint. I have all the evidences like emails, invoice, contract, whatapp messages that I can share. Please note that they didn’t give receipt on my 1st payment (AED 3,000) but it was included on the contract mentioning PAID and also I have my payment confirmation which I will attached as well.

We are looking forward to receive a positive response and action with regards to our complain.

Thank you.

Diana Sabino

Desired outcome: We want our refund please
