The complaint has been investigated and resolved to the customer’s satisfaction.

They will offer this free trail of smoke free Electronic Cigarettes to quit smoking all you pay is shipping & handling $5.95, then in 2 weeks
a charge will appear for $24.95 and 2 weeks later another $24.95, which is a support program that the program signs you up to that
charges these fees every 2 weeks until cancelled, when you call them and cancel you will consider this matter over, then
within a couple of weeks you will be charged $99.67 for the orginal kit, the whole time calling the phone number you have and they show you cancelled and then within a couple more weeks a charge of $69.68 will appear with a different phone number and when you call
they will confrim your order and what they have charged your account and refuse the 1st charges of being theirs(because it's a support program) and you have never cancelled with them for the product and they donot give refunds, even though we had not even received the 2nd order in the mail it was already shipped and they do not give refunds, so by the time you figure out what is going on with this scam they have already took a couple of hundred dollars from your account. This should be against the law! Sorry people are not any better then drug dealers who prey on people's habits to scam hundreds of dollars, as a matter of fact they are lower then dealers...You have not heard the last from me!

This is a total Rip Off, they just billed my credit card, and I never gave permission for them to do this 114.00 now I'm in the hole and have to pay 65.00 plus the 114.00 Please these people need to be stopped, this is so wrong on a fixed income, and they take advantage of people, wrong wrong wrong, Need to quit smoking but with this stress, it won't work

I too was scammed 10/11/2012. The site I went to said it was free just pay $4.95 shipping and handling. I think I was also taken to a different site. I received my package on the 17th. When I called them they told me I was past my trial period I told them it was free I just had to pay shipping and handling and I noticed they charged my account another $114.95. They offered to refund me $35 what they call a partial courtesy credit. That is not partial. I filed a claim with the better business bureau and I would urge all of you to do the same.

This is the disclosure on the 2nd page of their order form. Note that it is dim gray letters on a white background. The eye does not gravitate to this text. Instead, you are looking at the rich colored text and graphics. After an hour on the p[hone, they eventually agreed to refund all monies once they receive the product back. I will be shipping it tomorrw. We'll see if there is really a refund forthcoming. I additionally filed a complaint with the Better Busienss Bureau. you should do the same. at bbb.org/us. The companies legal name is Lux Electronic Cigarettes, but file if with the BBB under No Flame e-Cigarettes (there are additional complaints under this name too). Their address is 6538 Collins Ave #95, Miami, FL 33141.

OMG WHAT A RIP OFF I'VE BEEN CHARGED 69.00 A MONTH FOR 3 MONTHS. I DIDN'T EVEN KNOW WHAT FOR UNTIL JUST NOW. I CALLED THEM GOT THE SAME SPEECH YA'LL DID. SO NOW SHE SAYS ILL GET A 40$ IN MAIL. I now have to admit that there was very small fine print. I got screwed 2 ways. First came the unexpected $114.95 charge to my account. But because I was counting on that (being totally dependent for money from Soc. Sec.) to pay bills, when the charge hit, it created 3 overdrafts. My bank is great. They paid the checks, but did hit me with a $35 charge for each overdraft. There's a substantial likelihood I will eventually get the overdraft charges refunded. As far as I'm concerned -- and my bank is concerned -- this is getting the "Merchant Error" treatment. The thing that is really ticking me off is that it's actually one of the better e-cig products I tried as a menthol smoker. If you've got a good product, why set it up so that a lot of customers miss "the fine print."

well, they got me tooo. The bank suggested to cancle card and despute th charges . so that is what i'm doin .we'll see if i still get stuck with the bogus charges.

Advise too one and all! The only way to avoid the charges from coming in monthly is by changing you're credit card number, I've tried everything else already... Then you must dispute it! Dis-putting it will help to not have to pay the bill. Very irate. No where to be found did i see that you had 14 days. I got charged 69.98 for something did not authorize. They say it cancelled but come on we all know they wont... It is the lowest nicotine possible 1.1 really come on... You can buy them at a local cigarette store for 24.00 for higher nicotine. You would be a fool to buy into this scam...

i tried the trial thing for 4.95 and nothing was said about any other charges. but i bet my bank statemet and find that 69.62 was taken out on me. there was no phone no or any thing i found out the no to call on line and called them. they said they could not refund my 69.62 but would cancell my account. they also gave me conformation no that it was cancelled. also for my trouble they said they would give me 100 credit to go on line and buy things from some company and also send me 2 packs of refills since mine did not work on the trial one. i told them that i needed my 69.62 put back in my bank account. well when they said that they could not do that but i would not be billed any thing else i told them that if i was billed any thing else i was gonna go to the better business bureau and told them i am not playing their games and this was a scam. i am talking to my lawyer now about this. i have the copy of the trial that i got from the computer and i also recored this conversation with them today on the phone. they are not gonna get by with this. also stopped all payments on my debit card and bank account. getting new bank account no and a new debit card. so they can not get any more money from me. ron and marcie

No point in being redundant, all the previous is true. I'm more fortunate than most I guess, in that I used a store purchased debit Visa, and not a credit card. Still lost $109.00 though, of which I'm sure I'll never see again. What I had left on that card I withdrew immediately. What disappoints me most is the endorsement by the so called "Doctors", you know the TV show. When I saw their jpeg picture on the website along with a verbal "good deal", I felt this must be a great offer. Oh well, live and learn. Good luck to all with this----------Bolt

one more thing to add, my husband does work the USPS and he said this is a fraud using the US Postal Service and he is thinking on turning it over the the Postal Inspectors.

I also got caught up in this Scam, thankfully I used my bank's visa debit card. My Bank recommended that I close out this card and have a new one issued so the charges will not be allow to go through. Yes I am out of the prior fees but I will take that as a lesson not to get into a scam such as this again.

I have yet to try the e-cig, after receiving it. Somehow, the e-cig had disappeared, I never even got to open up the package. All other packages received have been cartridges. Still waiting on my e-cig! For all I know, the package that had disappeared may have been more cartridges. Meanwhile, I am getting shipments of cartridges at least once a month. I called 2 weeks ago, told them of this information above, and was told, because it was a lifetime guarantee on the ecig, that they would ship me one out at no charge. I am still waiting for it, I was giving a tracking # to take to the Post Office, as Lux E said that they showed it was delivered. All I got was 2 more packages of cartridges. After sending 2 packages of cartridges back unopened, "returned to sender", I have yet to get my account settled. Argh! Frustrated in TX.

i got scammed too they took 69.00 out of my bank 2 days before i got the pkg in the mail I called and got a person who could hardley speak English I told them I did not want these and she said something about sending them back and she would refund my money so I send them back and she doesn' t refund then I have no e cigs and am out almost 100.00 dollars. I called my bank and change my bank number and my bank charged me 25.00 to try to get the money back plus 5.00 for getting a different card number. I do not know why people are so mean. I got the trial pkg for my brother who is going into the hospital. Anyway I knew better will not ever do this again.

I was lead to the Emerald Lux FREE Starter Kit from an MSN News report about the success rate of e-cigarettes. Paid just $4.95 for shipping this kit and gave it as a Christmas gift. I thought: this is great! A reputable website referenced me so this has to be an honest and reputable company to buy from. I was so wrong... In early-January I received a package with refill cartridges that I did not order. I checked my bank account and found that it had been charged $69.90 for the refills. I then also learned they had charged me $109.95 for the "FREE" Starter Kit. I contacted customer service requesting a shipping label for the cartridges, and a refund for the charges. I was shocked at the customer service reply that essentially said "too bad, you signed up for it". I explained that I was NOT aware that by choosing an Emerald Lux "FREE" starter kit I would be charged for that kit (how is it FREE then?) and automatically charged/shipped refills. I am giving them 2 business days to apply the refund & send a label before I contact my credit card company to dispute the charges. Based on how many scam-reports I have seen with this company, I don't foresee any problems. What a scam!

I got ripped off too. Is anyone leading an effort against this company and this kind of practice? If so, I'd like to join. I can't believe that it is legal for a company to do this without any penalty. This is clearly deceptive advertising. In addition, there ought to be a way to bring pressure to bear on the credit card companies that are pretty much 'giving' our money away. If enough of us join together, we can stop this.

Me too! I was told I would get a 30 day sample of the product (not a trial), all I had to pay was shipping and handling of $4.95. After 14 days they charged my account $59.95 which put my account into the negitive and now I am stuck with overdraft fees. Basically this company lies to get peoples money and it is sad that they do not even care. When I called the company I was given the run around and they would not even let me speak to a supervisor. On top of that I was also promised a $100 Wal_Mart card which has not come and more than likely it will not come.

I am the representative payee (in Iowa) for a long-time friend whose psychiatrist advised him to not try to stop smoking again, but that e-cigarettes would be better for him than smoking (because of his COPD). I agree 100%! on the day you place your order starts the 14 day trial! so if you don't get it untill the 14th day you are screwed. They got me for $109~~ what a shocker! I tried everything, I kept calling back and I kept getting a Julie...they only have one employee? The cartridges taste like an ash tray. Nothing like the other ones I ordered. I usually use paypal to check out on the internet, this time I didn't. I will never do that again! THIS IS A SCAM!

I agree fully now. I placed my order on 4-19-11 and i have not got my product yet. This is day 8 everytime i call them they make excusses and offer me a free product. One rep told me it was never shipped. I called monday and they promased i would get it today. Well i called today they said i will get it today or tomorrow its always tomorrow with them. I paid $7.95 they cannot give me a tracking # ever to prove shipment. Did yall get your e cig? If so how long did it take and what all came in the box? And fake nicotene? Anyway i reported fraud to my bank and i called and reported credit card fraud to the FBI and better business beau. Is the scam takeing your money and not sending the product? Its been 8 days i not got mine yet and they say its 3 to 5 days max for delevery. How long did it take yall to get it? Im in NC btw. I reported them to FDLE as well. Get in touch.

I don't care about the fine print or the contract I agreed to! They were deceiving each and everyone of us and they knew we did not agree
to pay for these charges. Seeing how we know they knew we were misled with a tricky advertising web site should be enough for the credit card company's to cancel all charges involving this low life company! Hopefully the attorney general of each state involved will get refunds back in their hands soon. This is the kind of thing that makes you want to throw up especially when they point out where you went wrong during the order process. They have a lot of nerve to even keep this con going right under the noses of the authorities. I would never have agreed to buy 160.00 + of fake nicotene cartridges and neither would have you! Fight don't let them have a cent! I don't care what they point out in their advertising scam, I was under the impression it was a total of 4.95 period and nothing more!

I just recieved a phone call from the Support Dept my caller ID showed Pro Support and he said he was the verification dept. He went over my account and was giveing me prices diffrent from what the website showed. He knew the last part my my card # but wanted to to confirm it while he was repeating to me this is not a scam! I gave him the first part of my card to confirm it was my card. But there is no money in it so i know he cannot charge me anything else at this point. He seemed very odd and not sure what he was talking about. He was only worried about my card #. Well joke is on him he cant take anything off my card at all no matter how many times he tries. So we will see what product i get and if it is worth a ###. He said he is shipping it today and i should get it before friday yea right everyone else said it took 7 to 10 days to get theres he saying i should have mine in two days? He said the product is $149.99 when the website shows $109.00 . If i do like this product i will just use my prepaid WalMart card and only put enough on it to cover the device and refills. He also said there is no Nicitene in them when the site shows and states there is nicotene. He did not have info as to what would be in my package he said a ciggarette and a charger and a cartidge. The site shows a 12 cartridge supply a battery and a charger. He did not know how many cartridges was in it. Now i am a bit worried as you guys may be righT. Im not worried about them takeing money cause they cant but im starting to think this product is a ### hype product that does nothing prolly no diffrent then enhaleing from a straw. I may be wrong it may be what i need! But the rep was very fishy to me. Anyone who repeats this is not a scam must infact be a scam. Well see.

Oh my gosh i ordered the ecig from Lux last night before i saw this bored. Let me ask you this when you use it does it really make you feel as if your smokeing? Does anyone agree with that much? I always use a prepaid card so all they will get from me is the $7.95 they already took there is nothing else left on the card for them to take. I get a requreing $95 on the card each monday but they dont know that so ill with draw it as soon as it hits my card ill stand infront of the ATM untill it hits. I cannot comment on the lost funds however i did read the refund policy it clearly states you will be charged $109 after your 14 day trial ends if you dont cancel. It also clearly states a recureing monthly charge of $69.99 will be charged for refills. So no you cannot file a law suite the disclaimer and policy is clearly stated in fine bold english! If you did not find it or read it thats your fault but because it is clearly posted once you place your order you have just agreed to it rather you read it or not. They are not bound by law to tell you on the phone or warn you before you place the order its your job to read there policy. Im more worried it is a rip off in the sense that it wont make me feel as if i am really smokeing. But for $7.95 its sure worth a try. When i called they gave me an extended 7 day trial incase my product does not arrive this week. Eitherway they cannot charge my card again. If the product is not right for me ill cancle the card the day i try the product there wont be any cash on it till monday again noway. If i dont have the product by monday ill be at the ATM to take the money out they wont know what day or time my money will be there and they can only hit a card once a day is all thats allowed. Ill let ya know how it worksout for me. But as a 3 pack a day smoker i dont wanna die i pray this is the product that works for me nothing else does.

Emerald Lux E-Cigarettes Free Trial is a total scam and rip off. I fell into the same situation as described above. The money they snatched out of my bank account was meant
to pay my rent. My rent check bounced...so now I've got all those fees to pay on top of the $104.00 they stole from me. I had to put a hold on my bank account before they totally cleaned me out.
I've been trying to get a hold of someone at their company to no avail.Funny how fast they get back to you when they think they have another sucker on the line... and then won't respond to you
when they know you're on to them. I am calling the local news channel tomorrow to see if they'll run the story on their weekly Scammers Segment. And of course we can all post this on our FaceBook accounts
and hopefully help save others from this scam.

I just went through the same thing and am in the process of trying to get my bank to back me. And I had emailed them the minute I received the ECig and told them it was so nasty I didn't want it. And like you I was so hoping these would help me. There are a lot better and CHEAPER E Cigs out there.

i just got caught in the same scam after being sent a faulty e cig, so i thought it was the end of my dealings with them, but no i get a package of filters and find out they made two additional charges to my account totally aprox. 170, these people are sleazy and self righteous about it when you call their line.

I also was caught up in this scam. I called a toll free number [protected]. to order a "free" e-cig. The only thing I had to pay was shipping and handling. I declined the offer to have the refills automatically sent to me each month for a reoccurring charge. The girl on the phone was not happy about it and I explained to her that it does not make sense to set up an auto refill for something I don't even know I want yet. She agreed and ended the call. I saw the 7.95 charge on my card and about 10 days later there it was in the mail. I tried the product, I didn't like it and placed into a drawer. 2 days ago I see a charge for 109.95 from e-cig company. I called and they said it was because I did not cancel my account or return the product. I explained that I ordered on the phone, I told her that they said the conversation was being recorded for "my" safety. I said I did not authorize the charges I don't want the product and I will return. She came back to me with 3 offers.
1st offer was to give me a 100.00 credit, the2nd offer was for a 40.00 credit right then and when I said no she came back a third time with a 60.00 credit to settle this situation. I again said no. I explained that I was going to dispute the charge on me card and go to the attorney general...Then she said well if you return the product, pay the shipping and the 10.00 fee to do so I would see a credit in 4-5 days once returned. I am thinking seriously about trying these electronic cigarettes, but have dicided to research about all the possible scams reported. I must say I understand why everyone is mad, but the fault that they got scammed lies soley on themselves. YOU MUST read the fine print on any offer. They clearly state: "We are sure that you will enjoy your Deluxe Emerald Lux e-cig Kit, and that is why we offer you the satisfaction guarantee trial. The trial offer is designed to display the quality of the product. This gives you the chance to try this product for only non-refundable $9.95 S&H so you can come to a decision if this is the right product for you. After the 15 day trial period is over, your card will be charged $99.95. In order to offer you the best price on your cartridges and insure an uninterrupted supply, you will be shipped 30 refill cartridges per month for a cost of 59.99 (a savings of 14.26 monthly) plus postage and packing fee of 9.95. You may cancel your membership at any time by calling [protected]." Now not being able to contact anyone via phone or email is pitiful, and therefor I do sympithise with those of you who tried this product. However you knew, or would have known of the recurring charges.

They got me too. Just received a shipment of refills. No invoice or explanation of why they were sending these to me. Checked with the bank and they'd charged $69.62 to my account. Thanks to you guys, I got the phone number and called. I was told they already charged me $99.67 and then the $69.62. They said they would cancel my account and issue a refund. Hope it happens.
