I paid $3500 for assistance with a loan modification. When he was unable to secure this mod. he refused to refund my money per the contract that we had signed. Beware of this man he will steal your money.

This is David Newman speaking

Notes through out transaction

PARAGRAPH 1 Sean Mykleby entered into David Newman and Associates in October 21 of 2009 in December I told Mr. Mykleby I was Changing companies and he had the choice to stay with Yvette Hernandez or come over to the company I was going to start working for. Sean said “seeing my file is all ready started I want to stay working with Yvette”. I let him know that David Newman and Associates would be no longer responsible for his file if he wanted to stay. On February he called me up frustrated about how Yvette was handling his file and was wondering if he could work with our new company. I told him that Mitch Mathews would take on his file as an independent contractor seeing Sean was not willing to sign another contract.

PARAGRAPH 2 Sean started off by being very difficult to work with and Mitch was getting very frustrated on how stubborn Sean Mykleby was being. He asked Sean multiple times to get all of his paper work in and 15 days later got the paper work we asked for.

PARAGRAPH 3 Loan modifications takes time we have not had one fall through yet not even Sean Mykleby. Mr. Mykleby chose to no longer work with Mitch on his file and decided to withdraw from the program. He was never denied.

PARAGRAPH 3 Mitch worked the file with his servicer Chase from February 17 through May 6. During that time the complete modification was submitted and was being reviewed by Loss Mitigation. We also sent a Qualified Written Request to Chase and the Federal Trade Commission with Certified receipt numbers as follows.

Chase - Mailed QWR on 3/8/10, Mail # [protected]

Federal Trade Commission - Mailed QWR on 3/8/10, Mail # [protected]

Important Dates if needed:

2/17/10 and 2/22/10 the 3rd party Authorization was faxed into Chase at [protected] and [protected] ATTN: William Top
2/25/10 - 38 page Modification package was faxed into [protected] ATTN: Loss Mitigation

PARAGRAPH 5 Throughout the above dates given, additional docs were needed throughout the process and every doc Chase requested was turned in by Client and submitted to Chase. As of 5/6/10, more docs were needed for his wife; his wife gets a weekly pay bonus pay and chase said this everything that you have submitted so far will work however we need a paystub year to date. Sean told chase they could not get it and chase said this is not true you can call human resource to get it. Sean then told us I don’t want to move forward because chase will deny us. Again this was Mr. Mykleby decision.

PARAGRAPH 6 When Mr. Myleby calls I answer unless I am on the phone and when I am off he always gets a call. I have never in anyway promised Mr. Myleby money. I have been doing business under David Newman and Associates since 2003 and I have never had a complaint! I hope you find this information helpful anything else you may need me to do please let me know.
