* * *MY THOUGHTS ON FRAUDULENT BILLING* * *
I litigated a case where Cynthia Tracy was opposing counsel. Although I prevailed for the most part, there are resounding issues which the public should be notified of:
* Cynthia Tracy encourages litigation by refusing to entertain viable avenues to litigation. In short, in stead of simply returning a call to resolve minor issues, Cynthia Tracy forces the opposing party to go to court, which in turn forces her to bill her client to go to court for something simple which could have been handled with a phone call. In one instance, 4-5 letters were sent to Cynthia Tracy to resolve very simple issues to avoid court and keep costs down--but this doesn't feed the hours Cynthia Tracy needs to bill due to the fact there's no money if there's no litigation.
* Cynthia Tracy was offended I attached letters demonstrating I made efforts to resolve issues with her prior to filing a motion. Cynthia Tracy wrote a letter threatening sanctions due to lodging the letters as part of the court record, but forgets---an opposing party has no obligation to keep his or her own letters confidential which are written to opposing counsel, especially those making efforts to avoid litigation! In my opinion, I believe Cynthia Tracy does not want her client or the court to know she simply ignores issue after issue to force her to go to court, which in turn forces her client to pay for her to go to court.
*Cynthia Tracy appears to bill her client for 'professional services' but simply uses family to do much of her work, where you would think, in theory, if you pay for a paralegal's time, that paralegal went to school to learn how to research and draft law---but Cynthia Tracy appears to use her own kids but bills her client for the use of a legally educated staff. Due to the low quality and excessive errors made, there's no doubt in my mind the kids did not attend paralegal school or any form of higher education.
For example, I am aware she uses family "Sabrina Tracy" aka (Bina T on MySpace) and "Darryll Tracy" are assigned the title of "Legal Assistant" when they are simply her kids likely billing at $125 an hour. Personally, I believe having the kids do work for mom is cool, but billing your client for a "Legal Assistant" is ridiculous especially when the legal assistant perpetuates error after error.
* Considering the above, now consider this---billing for work which Cynthia Tracy doesn't even review. For example, I am personally aware Cynthia Tracy had submitted paper work for a case where she asked the court to divorce the parties, but in reality the parties were never married, but simply dealing with visitation issues. Cynthia Tracy appears to use ProDoc or similar software for attorneys where you simply plug in basic information (case number, names of parties, etc) and the software prints out the form pleadings. It appears Cynthia Tracy is either grossly incompetent and forgets who is married and who is isn't as she fails to review what she files, or simply has the kids spit out and file paper work but bills the client for her time. In some places, this is called 'over-billing' and in others it's called 'fraud' since you bill for work but don't actually do the work!
* Cynthia Tracy went so far as to bill her client to pursue records retained by MySpace and FaceBook even though those records cannot be produced under the Electronic Communications Privacy Act ("ECPA"). The ECPA is a federal statute that prohibits Facebook from producing any "content" without notarized user consent or a Search Warrant. Further, the consent form she wanted signed did not appear to have a location for a notary as required, therefore even IF the form was signed to give consent, Facebook and MySpace would have sent it back. No doubt, her cutting edge legal assistants could have figured this out by billing the client to learn the bare bones basics of the law and how to propound discovery properly.
The list goes on and on. In sum, my opinion about Cynthia Tracy is based on first hand knowledge of dealing with her office, or should I just say 'the Tracy family'. She certainly makes the TV Show 'Texas Justice' appear very sophisticated when compared to the backwoods law office she runs with her kids.
The complaint has been investigated and resolved to the customer’s satisfaction.

Well... My opinion of Cynthia Tracy is less than good.i am going to tell you my story and then you ll judge based on the result.
I first contacted Cynthia Tracy for
1/ child support proof of payments after my ex, Suzanne Winfrey, reported me to the OAG for non payment of CS.
2/ modify parent child visitation as I am living in a different state. My goal was to bond with my kids and keep this relationship special.
After $80, 000 spent with this attorney and 3 years of battling we went to court... Verdict? (Please dont laugh when you ll see this)
1/ judge Ramos stopped my visitations with my kids until I go see a parental realtionship facilitator
2/ NONE i said NONE of my CS payment made directly to my ex were considered... Over $60k!
After 3 days and worse outcome ever i decided to no longer retain as she admitted to me that she didnt know what to do anymore! Is this an attorney that doesnt know how to defend me?
She then billed me for another $20k for 3 days in court!
I looked for another attorney: Shonda Jones. Very reasonable in fees and overturned a fake document filed by Tom Conners... But when the 308th court started to disrispect a black female attorney and allowed a white man who was funding the judge s campaign, attorney Jones Advised me to seek representation with a white male with influence: this is when i used Daniel Lemkuil. During medition he pulled all kind of articles of law which made opposing counsel bow down.
Verdict: not $60k in "back child support" but $20k (of unproved payments because I didnt have all the receipts and the time I lived with my ex didnt count as She denied it... It would have cost me more by spending time in court to prove my case) and unreimbursed medical expenses that she had kept for 12years and dumped all at once! ... All this for $5, 000 attorney fees!
Now Cynthia Tracy is sueing me for the $20k I didnt pay her for her lack of competence.
My opinion? Do what you want but all what she did for me was... Take $70k, do nothing and now sueing me for an extra $30k... This is what you get when you retain her.
A total thief. First of all I NEVER even got to talk to the attorney nor meet her in person. She will take all your money and keep taking and never do anything yet send you a billing statement for detailed work that is not worth what they bill for. If you send any info to help, stating a law, then she gets offended and bills you for hours of having to review the info. She literally took everything I had and then quit on me the weekend before my court date on Monday morning all because I couldn't pay anymore. I gave her $6500 and she caused my grandchildren and I to become nearly homeless having to stay from house to house with family and friends.
Ignore the statements against brave, competent lawyer Cynthia Tracy by the felon Darren Chaker.

One of many competent attorneys & firms I've dealt with. All fees & billing practices fully disclosed prior to providing service. Billable hours consistent with indrusty standards. All work was flawlessly done the first time, and this prompted our business to become repeat customers.
The "complaint" described above is petty, and is no doubt written by a disgruntled person who was on the wrong side of the law. Attorneys provide mechanisms for conflict resolution by allowing the legal system's wisdom to prevail. His post is simply "sour grape"ing but ignores the nuances of the law which ruled against him; but rather than take a judicial ruling like an adult, he attacks the messenger. He lacks the maturity to recognize the reality of the law, and has demonized a firm that helped deliver justice.

Do not listen to this person, my name is Nicole I'm the one Darren chaker is posting about my daughter is also his daughter and he lost in a bitter custody battle and is being a sore loser. He is just upset that I wouldn't let him control me so he tried to do it through my daughter. I acquired an attorney crynthia Tracy and she took his behind to the cleaners. Needless to say he did not get what he wanted like he is used to. The judge ordered him to never be unsupervised with my daughter. So now because he has no other way to make our lives hell he is coming online trying to slander my name and the name of my attorney. I'm a good person who is raising her daughter and got rid of the garbage in my life. Cynthia tracy is an amazig attorney is not one about the money but is about what is right and keeping the best interest of the child(ren). This BS about fraudulant, darren chaker has never seen a bill from the Tracy law firm the bill is being paid by me and my family even while he keeps filing motion after motion. She removed herself from the case bc Darren came online slandering her firm and caused damage and couldn't afford to keep me. So if you come across any of this mans posts and there are many and under different aliases take his words like a grain of salt. They all start out the same * my thoughts on fraudlant billing*
