Collection Attorneys Bishop, White, Marshall & Weibel, P.S. The first contact I had with this firm was around the first of June 2010. They informed us that we had an outstanding debt owed to Household Finance Corp of appx. $5500 and that they would work with us to resolve the debt if we made a good faith payment of $50, which we did. The second contact we had with them was on June 16th, 2010 when we recieved court papers stating they had obtained a writ of garnishment judgement against us in the amount of $6984.75, and never found out what happend to the 50 bucks! Within days we were notified by our bank (Chase) that all funds were seized in the amount of $4, 124.90 (2 mortgage payments, childrens savings, etc) My paychecks were then garnished for an average of $550 every two weeks for a total of $2006.92. The next contact we had with them was when we recieved a 2nd writ of garnishment for the amount of $2, 649.88 because they mistakenly filed for an incorrect original amount. My paychecks were again garnished in 2001 for appx $550 per pay period, totaling just over $2, 100. On April 20th we recieved notice that this firm has again applied for a writ of garnishment for the amount of $2, 797.70. I have repeatedly tried to get an answer to justify these additional charges but always rudely told they they do not have to disclose anything to me. On May 2nd I recieved a notice from this firm (Karla Harris) that I can settle this debt immediately. I called and spoke with ms. Harris who is apparently the account mgr. She said that if I paid her $2, 530.54 (which is different than the court judgement of $2, 797.70) she could settle this case. When I asked about the funds garnished from my paychecks since 2/11/11 she had no record of any of those monies being applied. Who is monitoring these collection firms!? Why are courts casually signing off on these judgements without any explanation of charges!? These people have learned how to game the court system and no one gives a rip! Someone has to put an end to this firms predatory, unethical treatment of hard working people.

I Fought Back, you are my rock star today. I am currently fighting them and have completed a bankruptcy filing and required debt counseling in preparation for them obtaining a writ of garnishment. All my other debtors have accepted Debt Reduction Services' proposal for payment, except DiscoverCard (and on their behalf, Biship White Marshall & Weibel). If they garnish my wages, I lose my house; I can barely afford the Debt Reduction Services payment. They have been accepting DRS's payments to them every month while not actually accepting their proposal, and keep threatening to sue, like I can materialize money out of thin air - especially in this economy. They are completely unreasonable. Your advice is going to be put to use! Thank you!

BWM&W brought a claim against me for an alleged Discover Card debt. I responded to their summons with reference to the 154 Wn. App. 722, DISCOVER BANK V. BRIDGES case since my case was charged in a Washington State court. When the date came for my hearing, I showed up at the court, but BWM&W did not show up. I spoke with volunteer attorneys after my case was not heard and found out that the reason BWM did not show up is becuase they knew they had no case. I subsequently filed a Fair Credit case against them in a WA federal court. When the found that I was filed a claim they eagerly settled for a significant amount.
The moral of my comments is do not do nothing. File your response with the court and reference the Bridges case. Also, there are volunteer attorneys who can help you. They will not charge you anything, and if you have a case against them, you can beat these crooks at their own game. I was amazed at how many people did not defend themselves when I went to have my case heard. Because the defendent did not defend themselves, BMW automatically won, and unfortunately, the court allows them to drain your bank account and or garnish wages.

Completely agree with the above-posted complaint. This company has flat out refused to negotiate any payment that I can actually keep up with. When I told them I couldn't possibly keep up with the monthly amount they were demanding (and I counter-offered a payment that was more than double my initial request), they said there was nothing else to do but end the call. So we ended the call.

They also far exceed the legal limit of no more than three phone calls per week, calling AT LEAST once per day, usually twice per day, using different phone numbers. That constitutes harassment but there is little recourse.

They successfully garnished my bank accounts, even taking child support which is supposed to be exempt but the burden is on the consumer to prove it in court.
