Berg Roofing review: Roof leaks 2

I signed a contract with Berg Roofing to do a complete re-roof of our house in September 2009 and the work was finished in October 2009 and paid in full. The sales guy named Marty (without a last name on his business card) assured me that we were protected by the contract and they would come back to fix problems afterward, if any. At that time before their work, I had no leaks on roof and had interior and exterior paints done by a professional painter in April, 2008. I was shocked when I saw water stains in the ceiling of family room under a vent chimney on the roof on 12/25/09. I called Marty immediately and was told due to weather conditions they would come to take a look when weather was permitting. Not until late April, 2010 when I called him again, did he show up to see the stains and said they had come and fixed something, without my knowledge, and promised me to cover the painting repair too. Since then, I had photo records to show the leak continued and got worse with water stains coming down from ceiling through a wall to the floor level. Marty never returned my calls again until mid June, 2010, a guy named Don called and claimed that one of their staff had come a hour ago to fix something while knocking on our door without response. We were at home all the time that day and had no knowledge that anyone knocked the door nor we heard anyone working on the roof. Don and Marty simply lied. And of course the roof leak continued (photos again). With no hope from Berg, I therefore reported Berg to Better Business Bureau (BBB) on 6/14/10. A guy named Al responded through BBB that their contract does not cover "CONSEQUENTIAL DAMAGES WHATSOEVER" by their work and refused to fix anything or even take a look (I had no record that they ever tried to fix anything since December, 2009). We reserve the right to sue them in Court. My recommendation is that DO NOT SIGN A CONTRACT WITH BERG since they would try hard to promise you and sell, but would not honor anything what they promised. As a final note, when I signed the contract with them, I didn't see even the most basic requirement that the roofing job shall include caulking all possible holes to prevent leaks, and hence I asked Marty to add a statement in contract that they shall "Caulk all roof penetrations", that should cover chimney penetrations as well, which Al simply denied it through BBB. Now I regret profoundly that I had trusted Berg and their guys as decent people, but they are not. AGAIN, DO NOT SIGN CONTRACT WITH BERG, or you may experience my hardships.
