The collusion and subterfuge of the civil and possibly criminal actions being taking against me continues to thicken and escalate. After the Initial consultation Appointment this Friday, January 18, 2019 at 1:00 pm, Keating Law Office, Daniel Gerald Keating, 170 Monroe St. NW Warren, OH 44483, Toll Free: 866-268-1315. Two of the plaintiffs listed in my civil lawsuit legal action have been purposely misleading me since day one of our very first meeting. Robert F. Burkey and Lois Dearth kept telling me constantly and continuously that Robert F. Burkey was my personal trust lawyer. Misleading me purposely, this gave Robert F. Burkey the opportunity to meet with me personally in my private home for supposed consultations concerning my personal welfare. Robert F. Burkey used these personal meetings with me in my private home specifically for the sole purpose of manipulating me, influencing me, controlling me, and attempting to make me take the exact desired actions that Best Management, management firm for Lake Pointe Homeowners Association. Company Agent of Best Association Management, Inc. is TINA M. HALL. I still firmly believe and affirm the notion that Robert F. Burkey was retained my Best Management and Tina M. Hall to be their personal real estate attorney for Lake Pointe Homeowners Association and that he was receiving monetary compensation from Tina M Hall for acting upon Lake Pointe Homeowners Association's behalf.

When talking with Daniel Keating, he revealed to me the total legalities of my personal situation to me. He informed me that Robert F. Burkey was not my lawyer at all but was Lois Dearth's personal attorney hired specifically by her. Therefore, Robert F. Burkey was not personally involved with me, personally in any legal capacity, whatsoever. Also it was brought to my attention that Robert F. Burkey was delaying and influencing Lois Dearth's decisions to release money from my father's trust fund to specifically alleviate financial hardships I am suffering in my life due to my personal lack of any money at all other than SS Disability check from the federal government. Daniel Keating informed me that Robert F. Burkey's only legal capacity involving my father's trust is to determine how the money in the trust fund is to be invested and report the investment activities of my father's trust fund to the probate court in an annual most recent accounting report that is specifically reported every April. Robert F. Burkey has no legal rights at all involving my father's trust fund other than these two duties I just mentioned. Yet, he is apparently influencing the decisions of Lois Dearth, the trustee for my father's trust, as to when and for what reasons money is to be released from my father's trust fund to alleviate financial hardships I am suffering in my personal life. As I just mentioned Robert F. Burkey has no legal rights to do this at all. The determination of for what reasons money is to be released from my father's trust fund to alleviate the financial hardships I am suffering in my personal life are solely the responsibility and determination of Lois Dearth, trustee of my father's trust, and solely her determination and responsibility and absolutely no one else at all.

I was also informed by Daniel Keating that Robert F. Burkey and Lois Dearth were specifically trying to keep me from knowing absolutely anything at all involving the legalities of the law pertaining to my father's trust fund. Daniel Keating advised me to personally go to the probate court Monday morning and obtain any and all legal documents pertaining to the operation and legal specifics of the law pertaining to my father's trust fund.

I have already been advised by several attorneys that my particular legal case is going to be a long drawn out bitter, bloody fight to the very conclusion of this legal matter. I can only deal with the largest of law firms because of the humongous amount of time, energy, and resources that will have to be invested in order to bring this legal action to its natural conclusion. Injuries suffered:

Lake Point Homeowners Association and Best Management, the Management Firm for Lake Pointe Homeowners Association have been harassing me constantly and continuously, nonstop, for the past five years. Best Management even got their personal law firm, Law Firm Kaman & Cusimano — Doucet & Associates Co., L.P. A of Cleveland, Ohio to contact me and aid them in their efforts to get me to do exactly what they desired for me to do. The individual lawyer who contacted me from this law firm, Garrett B. Humes Lawyer - Kaman And Cusimano, issued an extremely, dire, severe, personal threat upon my person. I did a full and complete background check upon this lawyer, Garrett B. Humes. This background check revealed that this dishonest, unethical and unscrupulous lawyer who issued the dire, severe personal threat upon my person had at least ten physical complaints filed against him from different individuals who had associations with this dishonest, unscrupulous, unethical lawyer Garrett B. Humes. This dishonest, unscrupulous, unethical lawyer had a long checkered, colored history of using severe, dire personal threats to frighten and scare individuals into taking the desired actions that this unethical lawyer desired for them to take upon his behalf. I hope the court is beginning to fully realize for itself that Best Management, the Management Firm for Lake Pointe Homeowners Association, and their personal Law Firm Kaman & Cusimano — Doucet & Associates Co., L.P. A of Cleveland, Ohio are both dishonest, unscrupulous, and unethical business organizations and that they should both be severely punished for their actions under the full letter of the law. This is pure speculation and thinking outside the box upon my part but I also am quite positive and sure that Best Management retained the services of Robert F. Burkey of Burkey Burkey and Scher Co LPA to aid them in their efforts to manipulate me, coerce me, and intimidate me into taking the desired actions that all of these constituent desired for me to take upon their behalf. If my speculations are proven to be pure fact then that means that Robert F. Burkey of Burkey Burkey and Scher Co LPA is also a dishonest, unscrupulous, and unethical business organization as well and that this law firm should be severely punished for their actions under the full letter of the law as well.

This constant and continuous nonstop harassment for the past five years has caused both extreme and severe mental, emotional, and physical damage and injuries to my physical person. I just saw my primary care physician Monday, January, 14 2019 and my blood pressure readings were absolutely through the roof. My personal physician had to double the dosage of my blood pressure medication that he is currently prescribing to me. This is physical proof of how absolutely all of this mental and emotional stress these people have been inflicting upon me over the past five years has taken its toll not only upon my mental faculties but also upon my physical body. Lake Point Homeowners Association and Best Management, the Management Firm for Lake Pointe Homeowners Association recently two and a half years ago obtained the services of Robert F. Burkey of Burkey Burkey and Scher Co LPA and Lois Dearth, private individual and Trustee for my Trust Fund and Legal Guardian to aid them in their harassment efforts and their constant and continuous nonstop efforts to force me to cave into the selfish demands absolutely all of these listed constituents were making upon my physical person. Absolutely all of these listed constituents had absolute full knowledge and awareness that I am an individual who has suffered from mental and emotional disabilities my entire life. Any intelligent individual with any common sense at all would be entirely aware of the fact that this constant and continuous nonstop harassment over the past five years would only cause more damage and injury to an already fragile and vulnerable individual who already suffers from severe mental and emotional disabilities. I am seeking legal action to ask the court to compensate me for these extreme and severe mental, emotional, and physical injuries all of these listed constituents have inflicted upon my physical person over the last five years.

Violation of fiduciary duty between attorney and client. Robert F. Burkey was supposed to be my personal lawyer. But, Mr. Burkey violated his fiduciary duty to me. Robert F. Burkey was supposed to be representing me. But the entire time Robert F. Burkey was representing Lake Pointe Homeowners Association. Robert F. Burkey's law firm and Lake Pointe Homeowners Association were colluding together to force one single individual, me, into taking the desired actions that they both desired for me to take. I am not an expert on the law at all, but such extreme deceit and subterfuge on their part should be a criminal offense. If it is not a criminal offense then the laws need to be changed. Absolutely all of these allegations I am making are extremely, extremely serious violations of law and ethical conduct.

Burkey had the direct ability to meet me in person in his capacity as my personal trust lawyer. This is merely supposition, speculation, conjecture, and thinking outside the box upon my part, but I am almost 100% positive and certain that Robert F. Burkey's services as an real estate lawyer was obtained and secured by Lake Pointe Homeowners Association. Robert F. Burkey was using his right as my personal trust lawyer to meet with me in person. These personal meeting opportunities gave Robert F. Burkey the opportunity to manipulate me, influence me, and coerce me into taking action to satisfy the selfish demands Lake Pointe Homeowners Association have been making upon my person continuously for over the past four years. We are talking about extremely serious allegations of violation of trust issues between attorney and client because Robert F. Burkey was working for two different individuals who have been in constant conflict together for over the past four years. There was another serious violation of trust issue between attorney and client when Robert F. Burkey called a mental health organization and sent them to my front doorstep in a last ditch effort to remain in personal control over me, because he knew full well that he was losing control over me. We are also talking about extremely serious allegations of conflict of interest allegations as well. This is not only unethical conduct by a lawyer but may also be against the law which will allow for the filing of criminal charges against Robert F. Burkey as well. Robert F Burkey's services were both being paid for by both me and Lake Pointe Homeowners Association. Robert F. Burkey was collecting two different employment checks from two different individuals who have been in constant conflict continuously for over the past four years. If this is not a serious conflict of interest claim, then I do not know what would be considered a serious conflict of interest claim. There is currently a civil law suit for harassment over the past four years with a restraining order also attached to the civil lawsuit action preventing future harassment upon my person in the future, making further harassment illegal under the letter of the law and punishable by criminal charges if violated in any manner, whatsoever from Lake Pointe Homowners Association.
