9/22/22-Contract sighed for screen porch

9/23/22-$3500 deposit sent via Zelle

9/25/22 - Received sketches of porch to see to HOA

9/26/22 - Mr. Anthony told us he would apply for work permits

10/18/22 - Confirmed with Mr. Anthony that porch was approved by HOA. He indicated that we would see him soon.

10/24/22 - Was told by Mr. Anthony that he had started another project

10/26/22 - Mr. Anthony texted that he would be dropping off building materials the next day. "Looking forward to finally getting started on your project". Requested $3000 for materials.

10/26/22 - $3000 sent for materials

10/27/22 - Mr. Anthony did not show with materials

10/28/22 - Asked Mr. Anthony if he was still planning on starting tomorrow. He responded that his current project was taking longer than expected: "this project ended up taking a couple more days to finish up...I failed to do my job and make contact. I did stay on top of taking care of getting the material ordered and ready to roll"

11/4/22 - Contacted Mr. Anthony asking when he would be starting (still had not seen him or materials)

11/9/22 - Texted Mr. Anthony asking why he had ghosted us and not responded to any calls, texts, or emails. Stated to him that if we did not hear from him by 5pm that we will consider our contract null and request our money back. Mr. Anthony responded later that day, "I apologize for not communicating with you. I was inju" We assumed he meant he was injured.

We responded that we were sorry to hear that he was injured and that if he did not think that he could get to the porch to let us know.

11/12/22 - still had not heard back from Mr. Anthony. Asked for him to return our money and to respond to the text. He did neither.

11/15/22 - Request sent via Zelle to Mr. Anthony to have refunded $3500 deposit and $3000 for materials11/15/22 - Mr. Anthony responded saying that the project would start before Christmas.

11/18/22 - Told Mr. Anthony that we would not be pursuing the project with him and to return our money.

11/22/22 - Texted Mr. Anthony and asked him to return our money via the Zelle request

11/28/22 - Sent text to Mr. Anthony giving him a deadline to return our money or we would file a claim with the BBB. He finally responded saying that the funds had already been used for materials and that he had already cut it up.

Asked him to send receipts for the lumber and return the remaining funds.

1130/22 - Informed Mr. Anthony that I had again sent a request via Zelle for our money.

Second request sent via Zelle to Mr. Anthony to have our $3500 deposit and $3000 for materials refunded - request denied by Mr. Anthony

12/2/22 - Mr. Anthony texted that he would get the receipts and could he pay the remaining balance in installments.

12/3/22 - We agreed to installments

12/5/22 - No receipts or installment received.

12/12/22 - Informed Mr. Anthony that we would be filing a complaint with the BBB.

Yes, we were too trusting and should never have given him any money until the project was completed.

Desired outcome: We would like the $6500 money returned to us via Zelle.
