On the 31st January 2023 this forwarder agreed to ship my goods to Nigeria. The forwarder offered 25th March, 2023 as the shipping date, the arrangement which I accepted to give me enough time to deliver my goods to her warehouse. The forwarder also said that shipping to Nigeria is every Saturday. The forwarder didn't mention any conditions or deadlines for delivering for my goods to be delivered to her warehouse and there was no payment deadline to meet up with 25th March 2023. Because my goods are from different suppliers, some of the goods were ready and some were not ready. We agreed that I can send the goods that were ready to her warehouse waiting for my other goods to be ready. Though my suppliers were happy to keep the goods for pending when I am ready to ship.

The main issue here is that: On the 31st January 2023, the date we agreed that she will be shipping my good and agreed for 25th March 2023 as the shipping date, this forwarder did not give me any guidelines and conditions on the deadlines for delivery dates of my goods to her warehouse and payment deadlines for us to meek up with the shipping date on the 25th March. Also, we did not discuss, and we did not agree on anything concerning storage fees. These are very relevant information for me and my suppliers to meet up with the shipping date.

Surprisedly, I received chats on the 28/02/2023 and 01/03/2023 from the forwarder requesting me to pay for storage fees. I responded and informed her that she agreed for me to send my goods to her warehouse before 25th March, and we did not agreed that I will pay for storage fees. She responded and said that I misunderstood her and she was not asking me to pay. We settled that misunderstanding.

Some weeks after our agreement on the 31st January, 2023, on the 6th March 2023, the forwarder told me that she will want me to deliver my goods by 16th, more than a month after our agreement. I tried and delivered the goods before 16th as she had requested. Note, as at 6th March the forwarder did not mention anything about payment deadline for meeting up for 25th March shipping deadline. My supplier said that the forwarder’s warehouse signed my goods on the 13th in the morning time and my supplier sent me evidence of delivery. I chatted the forwarder to inform her that my supplier say that my goods have been delivered and signed this morning in your warehouse, she did not reply until 14th March. The forwarder chatted me on the 14th and sent proforma invoice for my suppliers to fill, again, this an important document she supposed to have forwarded to me long time to avoid delays. Got my suppliers and sent back the document back to the forwarder within thirty minutes.

Remember, my goods have been in her warehouse since 13th March morning time, and the forwarder did not issue my bill till 15th March. Again, the forwarder sent me a bill on the 15th Wednesday, and she said to me to pay the same day to meet up with the 25th March shipping arrangement. Honestly, how possible do you think I can make the payment and she will receive it the same day, since this is an international payment? I tried my possible best, I made the payment the same day on the 15th March. I paid extra charges for urgent transaction, my bank sent me payment confirmation note that the money was remitted to her bank the same day on the 15th March, I sent to the forwarder the evidence of payment. I chatted to confirm whether she has received the money, she said no, I contacted my bank, my bank again confirmed that the money had been transferred to her bank since 15th March, and her bank has not raised any concerns allocating the money to her, and my bank wrote her bank to confirm what is the true situation. Later she accepted she has received the money on the 17th March.

Another thing she started saying is that we have missed the shipping for 25th March and that I will pay for storage fees and if I do not pay she will take the shipping fees I have paid to her. In all the conversation with her today, has not mention how she will ship my goods to Nigeria. All she is interested is how she will charge me for storage fees, knowing quiet well it was not my fault we missed the 25th shipping arrangement.

My submissions:

1. On the 31st January 2923, the forwarder did not discuss with me when she will expect my goods and payment deadline and storage for me to meet up with the 25th March shipping arrangement. This must be done at the initial date of agreement, on the 31st January 2023 and not after some weeks or months later. These are very vital information which will help the customer decide whether he or she will meet up. But the forwarder dubiously engaged me into the arrangement in order to hook me and take advantage of me.

2. I am not sure that this forwarder is genuine, and honest. I have every evidence to believe that she planned everything to dubiously take money from me.

2. I do not believe that she had secured 25th March shipping arrangement for me.

3. She received my goods on 13th March and intentionally delayed communicating to me and delayed issuing the bill to me so that she will claim that late payment was the reason for missing the deadline for 25th MARCH SHIPPING ARRANGEMENT.

4, I believe that she had received my payment earlier than 17th March

5. it's obvious that she intentionally made everything difficult for me in order to take advantage of me and dubiously collect more money from.

6. It was not my fault. The forwarder gave delivery date of my goods to her warehouse by 16th March, I delivered on time, if the forwarder had given me the delivery date deadline earlier on the 31st January 2023, I would have delivered on time and had enough time to make the payment and the goods would have arrived on time.

The summary of the whole issue is that the late delivery caused the delayed payment. And the late delivery was because the forwarder did not tell me on the 31st January when she will need the goods for us to have enough time to make the payment and meet up with 25th March shipping arrangement. Honestly, it's not my fault and it is wrong for the forwarder to demand storage fees from me.

7. The forwarder is in the procession of my goods in 15 cases/boxes and worth $11,028 and shipping fees of $1647.65. For your information, I delivered my all my goods to the address she sent to me

Desired outcome: 1. I request the arrangement for shipping of goods2. I request that the forwarder waive the storage fees 3, safety of my goods and the shipping fees of $1647.65 I have paid already.4, The forwarder should compensate me

I made arrangement, my goods were delivered to another forwarder I got. You must open dispute against this forwarder now for seizing and holding your goods unlawfully. Find another forwarder and request this forwarder to transfer or release your goods to your new forwarder. Where and how did you find this forwarder? Report them and haras them with constant calls and emails. You can call this forwarder who helped me to ship my goods, they are from Nigeria and very good

Unfortunately

I had ship my products from them. Now my product have arrive in destination country but wont release my products. They did not give bill of lading i was so devastated. I have No product and have no money

Unfortunately

I had agreed with them to ship my products. Because they charge me 3000 for storage fee. But they hold my product in our seaport. they did not release the bill of lading to me so i could get it. I was really devastated. I have no products. I have no money to buy again.
