DATE OF INCIDENT: 17/3/2017
ISSUE: Deposit of €3000 on Static home not returned by Phillip Kirk to Sharon Gilmartin. No Receipt given, although assurances was made on the phone that I would get one.

INCIDENT DETAILS:
I was interested in a Statik home that I seen on done Deal for sale. It was available for viewing in Derry. Phillip Kirk was the man that had the advert placed on Done Deal and he is whom I had all the dealings with. He is from Dundalk. See attached a copy of the advertisement on Done Deal website, which you can see was clearly being sold by Phillip Kirk. He introduced himself to me as property developer from Dundalk, Co Louth and he told me he also owned the Ramada Hotel in Dundalk, where he is hoping to erect more houses on the site of the hotel. He also told he was a singer and he suggested I look him up on you tube.
When myself and my husband Derek Martin arrived in Derry, we met Phillip Kirk near Derry airport and he escorted us to the site at which the static home was placed. There we met Noel McGee, whom Phillip introduced to us as a business partner of his. Both Phillip Kirk & Noel McGee were selling the static home. But all my dealings were with Phillip. I gave Phillip Kirk €3000 deposit. A few days later I decided not to buy the home and I requested my deposit back. He has not returned my deposit. Prior to me viewing the home he told me I'd get a receipt of the deposit as well as assured me it was refundable in the event that I changed my mind. Phillip did not give me a receipt when I gave him the deposit.
Since this Phillip has been rude to me and verbally abusive on the phone. I taped a few of our conversations. Phillip eventually agreed that if he gets the static home sold that he would return my deposit. However it’s almost 5 months since I have him this large deposit and its time he started paying it back. What’s even more annoying is that he has money to go on holidays and has not the decency to return my deposit.
TODAYS DATE: 3RD AUG 2017 ( 4.5 Months later, I still have not got my deposit back.)
TEXT ON 3/8/17: Today I text Phillip stating that I could not see the Statik home on done Deal and I asked him if he had it sold. He rudely responded that he was on holidays and told me to have manners and go away and
DESIRABLE RESOLUTION: I would be grateful if you could speed up the process of getting my deposit returned
