12/14/12 approx 4:35 EST I heard my fiance speaking to someone over the phone as my finance entered our
room. The voice on the other line blared out intimidating, although I could not hear what was being said..
The call was between my finance and a representative of Cambece Law Office by the name of Corey Jordan. I told my fiance to place the conversation on speaker around 4:45pm. As soon as my finance pushed speaker, I made the rep aware I was now listening in on speaker. My finance stated repeatedly to Jordan he was not refusing to pay. He wanted in writing though that once the approx $3000 debt was paid, the debt would be removed from his credit reports. Jordan was angry, repeatedly telling my finance to pay the debt over the phone at that very moment, stating Wells Fargo would settle the debt now for $1000 less. Jordan repeatedly stated my finance had failed with promised payments, which is untrue, and demanded that my finance verbally agree with him that my finance had failed on the Wells Fargo contract he had signed. When I attempted to speak to the rep. he shouted I can't understand "with that woman yelling in the background." Jordan continued over and over to demand payment over the phone immediately. My finance continued to state he wanted it in writing. Jordan stated finally he would email and fax a statement. I then said I was calling Wells Fargo. Jordan continued to demand. My finance called Wells Fargo utilizing my phone, as Jordan continued speaking on my finance's phone. Finally Jordan hung up when he heard we were speaking with Wells Fargo. For at least half an hour, Jordan would not allow my finance to end the call, but hung up when my finance was speaking with Wells Fargo. Although the debt is legally owed, the method of acquiring the payment from my finance was on the level of extortion; otherwise known as "exaction." Exaction's formal definition is the infliction of something such as pain and suffering or making somebody endure something unpleasant. In this case, Jordan continuing to shout at my finance demanding payment over the phone and keeping my finance on the phone as a form of harassment fits this definition of "exaction." Please note, the company, who hired them is SquareTwo Financial. The original collector was Wells Fargo. Today my finance spoke to 2 representatives at Wells Fargo. One emphasized and stated she would be concerned as well if she received a phone call such as the above. She transferred my finance to Wells Fargo Collections, and this representative said there's nothing she could do, because the debt was sold to SquareTwo Financial. The fact is there is something she should do, provide the bank with feedback regarding how the business they sold the debt to treats the debtor. Does Wells Fargo want to be affiliated selling to business, whose law firm practices scare tactics and exaction? My finance stated to this rep. he thought Wells Fargo would want to know with whom they were affiliating themselves.

UPDATE: The debt was for about $3400. A settlement letter was sent for $2400. The settlement letter says it expires in December. My fiance did not not hear back from the Dec. 24th complaint made to the BBB requesting in writing from J.A Cambece Law Office, P.C. that once he paid it would be taken off his credit report and not sold to another. Due to the fact that J.A Cambece Law Office, P.C. harassed my fiance once with me on the phone, and days before on the phone alone with him, I feel there's a violation of the Fair Debt Collection Practices Act, that would be $1000-$2000 according to § 806 Harassment or abuse [15 USC 1692d] (5) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number on http://www.ftc.gov/os/statutes/fdcpa/fdcpact.sht. Would you suggest, my fiance certify mail Cambece the debt to be lowered for unfair practice. My fiance had agreed to $2400 over the phone, but that was before the harassing call I witnessed, and also now Cambece's settlement letter with the $2400 has expired. Also, please note, an attorney, who spoke to my fiance said Cambece is not required to send him anything in writing beyond a VOD. My fiance wants in writing; however, that Cambece will take the debt off the credit report once it's paid, because nothing should be assumed. If my fiance doesn't get this stipulation in writing, then the paid debt could possibly be resold or "misplaced." This stipulation in writing was requested in the BBB Dec. 24th complaint, and there has been no response from Cambece yet, thus the settlement letter has now expired.
