On 10/24/2011, a about 5:05pm, I called Toriano to make an 80 dollar payment, which I was supposed to do on Friday but I was unable to call then. Toriano informed me that since my account is 31 days past due, he was unable to accept that amount because it would not change my due date, and that I would have to pay 180. I said I don't have that much in my account right now, let me make a phone call and I will call you back in a few minutes. I ended up calling back around 5:40. My husband was also on the phone because he had a few questions. When Toriano came on the line he immediately started yelling at me saying that my account is unacceptable and how I need a plan and what am I going to do to get this under control. Which, I do not believe is any of his business.
At this point my husband steps in at this point to ask his question and to tell Toriano that he was going to get a loan to pay off the past due. Toriano says that we're not going to get a loan and that he's just going to send someone over to pick up the truck. Toriano then spends the next 20-25 minutes yelling at my husband, and trying to give my spelling lessons because he says my husband, who is 43 mispronounced a word. Then Toriano decides to get bold and called my husband a cop-out and saying he was soft, and yes, my husband did tell him that he would kick his butt if he was here because he was being disrespectful. Torianos' response was "I get off at 6:00, our address is 121 South Main Street. Come on down, your not going to do anything because your a coward." I don't understand why this man is acting as if I owe him anything, and I feel that it is RATHER unfortunate that this company would have someone so unnecessarily unprofessional working there for 6 years. I can only imagine the way he has been treating people, and obviously getting away with it.
Also, I had to get work done to my truck, literally after I bought it and dealer refused to fix them even though he signed a document saying he would, Toriano said that if the receipts totaled more than my monthly payments then that amount would be deducted from my payments. Later it changed to "Oh I said the payment would be deferred to the end to the payments." THEN it changed to "Oh I said one of the biweekly payments". I told him that he should make up his mind and be specific when he's talking to people. He tells me I'M being disrespectful.
I do not understand why every single time I talk to that man it has to be a confrontation. He is not the only debt collector I have dealt with, and none of them have ever asked me what specifically I am going to do to resolve my debt, then when I tell them say that's unacceptable and that I need to tell them something or else. Also, my payments per month are only supposed to be 358.18, so why is he trying to make pay 400 per month when I've told him cant afford that. I should not have to go through this crap EVERY SINGLE TIME I call there.
Also, this man keeps on calls my work harassing me about a payment. I have told him three times already not to do this because I am not a permanent employee there. I am a temp thru an agency, and that I cannot discuss with him any personal matters with him on this phone, and I reminded him that he has no less than three other numbers that I can be reached at. He words to me were: If you do not want me to call you, then you have to call me. Then he proceeds to yell at me asking why didn't you call me yesterday, or the day before that. It is not his business why I was unable to call, but I did let him know that my mother is in the hospital, which she is. Also, I asked him if he even bothered to call my cell phone, he said yes, I just called it, which was a lie because I have my phone with me and he did not. Also, I asked him what's supposed to happen if I lose my job because he keeps calling here harassing me. He replied again that if I dont want him to call me then I have to call, and yell at me about a payment. My boss could here him from her office. I do realize that I am a bit behind in my payments, and although, again, the reason why is absolutely none of his business, I did tell him. I feel like he is deliberately calling my job after I have asked him not to so that I will get fired and have no way to make payments, and so that he can repo my truck. Also, I never gave him the number to my work, so I need to know how he got the number. I only told him the name of the agency I am employed thru.
Also, I have been asking for months now, for a listing showing the payments I have made, the amounts and dates they were made, but havent got it. You would think that someone who's been doing their job as well as that say they are would have had that tome a while ago. But as soon as I start asking well why am I being charged and extra 6.95, which I was first told that it was a late fee, then it changed to a over the phone payment fee) there's a big problem.

Wow… it’s now 2023 and this scam of a company is still in business! All employees are rude AF. I purchased my 2017 Kia Optima in October of 2019… NOTHING but issues since. Oil consumption problem.. product improvement recall on the engine. Long story short they ended up putting a junk yard engine in my car.. still the same issues. Payment was $340/mo when i bought the car… they harass me for $500+ a month and threaten to deactivate my vehicle unless it’s paid. Not to mention, after 4 years of payments they’re telling me that i owe more now than what i purchased the car for. Like HOW?!?! Make it make sense. After reading these comments and knowing they are still operating an ILLEGAL lending business i WILL be following through with legal action. DO NOT DO BUSINESS WITH HERITAGE ACCEPTANCE!

They repossessed my car on a Wednesday. I Paid a $50 good faith fee, the same day they took my car.The next day I had to fill out paper work and email check stub, I.d,references etc. once they received that I had to wait on them to send me a barcode to make my payment. They sent me the barcode on Friday and I made a full payment to bring my account to current. On Monday my car was transported to an auction. They told me they needed to check the gps and to make a key and then I could go pick up my car. It’s now Saturday I still don’t have my car and it still haven’t been checked in. It’s a lot more to this story but this was long story short. Scam of a company

They did me the same way back in September it took almost a month to get my car back and they had all payments the day after they shut my car off.. my car went to the auction n I had to pick it up from there

I was told at the time u signed a contact that my payments would be $470 a month $250 every two weeks but some months they call me say I have to pay more on longer months and adds up to over $700 a payment a month they tricked me into this contract because I really needed transportation at the time. I'm on SSID so it's already a Burden

This company is a bunch of thieves they are doing crooked business that should be illegal, I purchased a car from a dealer a little over two years ago and I was told by the dealer that the APR is a little higher than usual but because my credit score is low was the reason but if I am to make my payments on time the first year that they would help me get a better loan, so I signed the loan papers and I wish every day since that I never did, this company have no morals or human dignity or values after making my payments on time without ever missing a single payment for two years that's 24 months my credit score was improving and I decided to shop around for something better than the 22.99% APR they were charging me and I found a couple of options that are much much better actually around 9.99% APR that much better but I came to find out from the new company that was supposed to pay off my loan and lower my payments that Heritage Acceptance was actually taking all my payments for the first two years and applying them towards my interest balance only and little to nothing was going towards my principal loan amount in short basically I found out that after making timely Payments for two years thats 24 month and 48 payments my balance is the same as it was the day I walked out of the dealer how did that happen? Well basically they took all my payments and covered only my interest balance on the full 4&1/2 years loan basically took their money that they haven't even earned yet because I only had the car for two years yet they took the full 4 years of interest and why would they do that you may ask basically so you can stay enslaved to them and you can't find a better Leander out there and if you try to transfer your balance you basically will have to pay interest on your full balance all over again.
I don't know if that's legal or legit but it's the truth stay away find other lenders there's a ton of them out there get a cosigner or take your time and don't rush.

Ok so our payments are due on friday and cause on thier end dont go thru till Monday so they say we have late fees and patrick and his supervisor are not helpful and they harrase us call all hoirs of the night and my mom this company is legit a poor excuse of a business and needs shut down i think we need to go higher and get this place shut down cause they dont help us they dont agree with anything and they change the money we owe when its its supposed to be 160.00 every two weeks

They are s##ty! If your one day late they calling you! If you don't answer they start calling friends and family like that's really going to help! A company full of ####ing harassers ! June and her s###ty ### attitude I can't stand talking to her don't tell me to call for options when I did call u had none ! Can't wait til this car is paid off or I can get another one! Only had the damn car for 2 years this month and my engine went out the first 9 months bull####!

this company is bogus selling lemon cars with this high ### interest rate . looking to get out this debt right now. the car truck i have is falling apart and im about ready to give them this ### back! i been to several dealerships and they all said the same thing heritage acceptance f'd me over .im looking for a new car now and when i do they can come get this peace of crap. remaining balance and all ! Correction to my earlier statement. He did make payments on the car after it was totaled. He make payments for over a year until he couldn't afford it anymore. They took the car and probably scraped it for some money. Even after making payments and whatever they got for it after taking it, they said he owed an amount that was over the original loan by a good amount. And over time when he couldn't make payments(after they took the car) they would threaten him and talked to him in a very unprofessional way.

Correction to my statement earlier. He did make payments on the car after it was total. He made payments for over a year before he couldn't afford it any more and they came and took the car and yet still after making those payments and them probably scraping the car for some money, they said he owed over the the original loan amount.

I purchased a mobile home through these rip off artists. When we bought our home, we were initially told that it was a 1997 model only to find out later that it was a 1992, 5 years older then we agreed to purchas.We were also promised a payment book when we signed the 1 and only document that they provided us with. Well we never received a payment book or a monthly billing statement. then after 8 years of living here, I started to notice bad repairs that were made just to cover up damage, but not actually fix the problems. Like they painted over Black Mold instead of cutting the infected area out and replacing it. I have also been requesting documents like a monthly billing statement and a 1098 E interest statement for the last 8 years, all request have met with a flat out refusal, telling me that they are a financial lender not a mortgage company so they are not required to provide me with those documents so I refused to pay my trailer payment until I received them. Then the documents that they sent me were merely typed numbers on company letter head. They were not the properly formatted documents that the Truth in Lending act requires a lending institution to supply to the borrower. They also own the trailer park that we live in. For 6 of the last 8 years that my family has lived here, we have had to deal with a raw sewage leak. The sewage has been flowing freely across our lot to the point that my family can not even enjoy spending time out in our yard. I have reported them 3 times to the health department and I am still refusing to make my payment until I receive the proper documentation. Up until last month we made our payment every month and now I welcome the chance to go to court. Here at my trailer park I have started a petition to file a class action law suit against MH Acceptance corporation which is their new name for their predatory lending practices. They changed it in 2011 but didn't tell us until last year. I would welcome anyone who would like to join in on this action. You are welcome to join even as a car buyer. After reading all the posts about this company, they cheat everyone. Preying on the less fortunate and I want them stopped. I am still looking for an attorney but the more people that want justice the more lawyers will want to jump on this case. Contact me via this site if you are interested.

My husband had bought a car from Quick Auto in 2005 or 2006 when he was young. They didn't verify or make sure he was insured before allowing him to leave with the car. He couldn't get insured after leaving with the car because the place was closed until Monday, so he was going to call Monday after work but had to drive the car to work uninsured, bad I know but when you need to get to work and your boss is a hard a** you do what you have to. He was driving home after work to call but was cut off on the freeway and went through a fence and hit a tree thus totaling the car. The person who cut him off took off so he couldn't file a claim on their insurance. They took the car because he didn't want to pay for a totaled car. We set up a payment plan with Heritage because we didn't see the papers about the court date until it was too late due to our roommates. We set up a $50 a week payment, the interest rate they gave us was 8.6%, and there was a fee to call in the payments and late fees if you missed a payment. We fell behind so they garnished his wages. Once we started paying again the amount we owed was over the original judgment amount, due to the interest rate and late fees. We set it up to where they would take the payment out of our bank account but they kept trying to take money out too early in the morning when the paycheck hadn't cleared yet and constantly trying until it did clear, not only creating a fee for us to pay them for it coming back insufficient but also the bank for overdrafting and it also cause us to lose the account with the bank because they did it so much but we kept making the after by calling which like I said earlier you get charged for. We have since stopped paying they because after months and months of paying them $200 sometimes more a month the amount was barely going down and when we talked to the lady in charge of his account about the amount not really deceasing she rudely said we need to pay them more but in a way that made it sound like we personally owed her the money . They used to call his cell phone, my cell phone and his parents house phone all the time, but for some reason there hasn't been a call for awhile. My opinion of this company is that they are taking advantage of people, they make rates and fees so high that people will have to pay for years and years and years or file bankruptcy.

I totally agree with all of you about their better then everyone attitude that they have. They are a company that preys on the less fortunate. if you all think you have a problem with them because you bought a car through them, then defiantly do not buy a home through them. I bought a mobile home through them in 2005 and was promised a payment book when I signed the papers, that was lie #1. I have been trying to get them to give me a monthly statement since, they told me that they don't do that, lie #2. They also own the trailer park that my home is in and 1 month my wife forgot that lot rent had gone up $5.00 only after the check was cashed did she realize that she forgot to put the extra $5 on the rent. The following month we added an extra $5 to the lot rent payment, at the end of that month we received a notice that we were $5 short on our rent so my wife added another $5 to the next months rent. Then these idiots sent me a summons stating that if I didn't pay them $375.00 that they would take me to court and have me evicted from my home, I called them asking what this BS was all about and the told me that the charge was due to compounded late fees on the $5 mistake. I started laughing and told them I would see them in court then. Guess what? I still live here, I went to court, went in front of the judge and told him that this all started over a $5 mistake and before I finished the judge stopped me and totally started to yell at their attorney about wasting his time over $5. I tried not to but I started laughing right in the court room, but that wasn't the best part. The best part was when the judge found out that we actually over payed by $5. Then my neighbor had a sewage leak which was flowing freely across my yard. After 6 years of them telling me that they fixed it when all they did was bandage it, lie #3 I sent them a final notice in certified mail stating that if a reputable plumber was not called and the problem fixed that I wouldn't be paying any lot rent until the issue was fixed, then I called the health department and got an inspector out ASAP. The problem was fixed the very next month.Now after 8 and a half years I still have not received a payment book or any type of statement concerning my loan payment, which after extensive research I have found out is against the law, I again sent them a letter stating that I will not make anymore payments until I receive it. Then there is lie number 4. They told me that because they are not a mortgage company that they didn't have to provide me with a 1098E form for interest payed on my loan. Either they're stupid or just outright lairs but they do. I have now been talking with an attorney on filing a class action law suit against Heritage for failure to disclose Federally required documents and also for predatory lending. My advise to everyone is, don't worry about filing a claim with the BBB, they are only a consumer reporting agency not an action taking agency. Use google search, find out what your rights are as a consumer and act accordingly. There are a ton of lawyers out there that will help you faster then the Better Business Bureau will and they will jump at the chance if there is more then 1 case involved. find others that have had the same problem with Heritage and sue the crap out of them.

I had a problem with these jerks as well. They are a Scam and I am talking to a lawyer to file a lawsuit against them and file complaints with the better business buera. They are rude and unprofessional. They come off as "financial BULLIES" now that contracts have been signed. They also sold me a lemon. However I will be going down there to make all my payments in person and I want to see how they treat me in person then. Totally Unacceptable! I don't know who these people think they are but in the end I will have a lawsuit in against them if they ever threaten me or my family, they will regret it .

I financed a car with these idiots in March, I made my first payment 10 days before what the dealer had told me was the due date. I was informed it was two weeks late when advised what my paperwork showed I was told I was a liar. During the next several months they have changed my payment date without notice then charging a late fee.
I recently received a call threatening me and my family with physical violence. I advised them I have decided to file Chapter 7to come pick it up. I was then informed if I did causing him to loose $ I would.d regret it.

Worse car loan company EVER! They screwed me over since I was 19! I am now 33 & they are still haunting me! I was definitely dumb & young when I got caught up with this company. I had two cars w/them bc I was desperate & dumb, each car had issues! Transmission & engine problems! I worked out of town & almost got fired from my job on several occasions because my car from them was very unreliable & always in the shop. I actually went through depression because this company. They would make me take out an additional loan for the new engine even though it should've been under warranty. If I could start my life over again I would 100000% never ever use them. When I see their name on the back of other cars it gives me horrible flashbacks & I feel so sorry for them. I wish I had more brains back then & people to warn me.

I have many problems with attitude at this place. I use to pay my account at Walmart till they pissed me off. Now I mail my payments in, but yet they still ### cause they don't get it on time. There is a no winning situation with this company. I will never use them again.

This is a very horrible company. I pray to God that He shut this company down for good. They don't deserve customers. Janice the supervisor is very rude. I bet she is lonely and single. Elizabeth who just started is starting to be rude. WARNING DO NOT GET A VEHICLE FINANCED THROUGH THIS COMPANY! STAY AWAY! God please shut this company down. I made a payment with Francis and asked her when our next payment was due and she says two weeks from today(meaning when my husband gets his next check) so I think everything is fine until low and behold she calls the next week and wants another payment! She claims the last only caught us up for a week. I got so sick of her month I hung up so what does she do, she starts calling our contacts. It is really sad because if she calls and we don't answer she starts blowing up out froends and family phone. Not to mention someone took a payment out of my mother's checking account that was not authorizes! I called and the women I spoke to wasas shocked as I was to why the took a payment without anyone saying to and reversed it back into my mom's account but of course when Francis got wind of this she tried blaming me sayimg I told them to keep the atm cvard on file to use for every payment. This was not something I would ever do and og course there was no recored call stating I agreed to this. It also made no sense considering our payments are due on saturdays and this one was taken out on tuesday. We made the misake of getting another car from them but we now have a different rep and he is fine but I can not stand talking to Francis. She is so rude and says stuff that is none of her concern. She was really mad when she found out we got another car and said why on earth would you get another car if you can't afford the first one, well why would your company approve us for another car? As if it is any of her business anyway which is what I told her. I can't wait until the car she is a rep with is paid off.

i have contacted the attorney general in Illinois and Indiana about the illegal collection practices of this company and also contacted the BBB they have a A+ on the BBB if no one complaints or take action this company will continue to do this, i have been yelled at, cursed at repeatedly and when i called for a supervisor she also yelled stating that it didn't happen with out asking when and the tI'me the situation accrued...they also gave out that I'm late on my car note to one of my references...trying to take action so this abuse will not continue...make complaints on BBB and contact the states attorney ...because this must stop

I will never take another dime from Heritage Acceptance of Elkhart, IN. If that Toriano is the man I talked to when they repo'd my car then yes he has something coming if he ever comes out of hiding. They repo'd my car a 2nd time the day I made the full payment and didn't release the thing for a week. Jensen is an arrogant snobish piece of slime that I almost said you know what the hell with it come take this car I only owe $480 TOTAL! After paying off 10, 000 plus on a 98 Mustang im paying for the last repo of which I paid the day the took it before they closed! I hope they are audited and close for good and all their employees never find work again because they don't deserve jobs treating and talking to people like that. And they call when you are on time with your payments, just because they are lazy and dont bother to check the cpu before they call to see if a payments been made they talk down to you and ask when are you going to make your payment. I said I did make my usual full payment, she said she didn't see it and I said check again and low and behold there it was plain as day. And the dumb broad didn't even bother to apologize for the inconvienence. NEVER TAKE ANOTHER LOAN FROM THEM EVER AGAIN! YOU'VE BEEN WARNED!

I would go there and wait outside for his ###, as he is most likely a misfit being paid min wage as they all do there, so as you speak with these people you can tell they have no education. but i really would go wait outside the door in the lot;. after making sure when he gets off, and comes out the door, i got called about late payments when in fact the payments were there just not put into their system, this ### calls me from there, and i really was going to wait outside the door, I have no respect for low educated fools who cant respect me.

Wow.. I've been going through the same thing with this company! My car is also a lemon! Toriano is very disrespectful! So is Janice... I can't understand why they are trained to be so rude! I made a payment using an Am Ex card. No one told me I could not use this card. I was at work this eveing when I received a call saying that they were repoeing my vehicle because they do not accept Am Ex and I HAVE to use my original debit card. I advised them that this is a new card and I no longer have that one. I also asked why the payment was called in over the weekend would they wait 4 days to call me, and then to call me at work and not on my cell or home phone. He stated that he did calll my other numbers, and yet I have nothing on either caller ID or voicemail? So, I went and bought a prepaid Mastercard debit card after work to make the payment AGAIN! I called the number and put the ext number in as I was instructed to do, and it went to a general voicemail box. The guy told me if I didn't make this payment (which I did) that they were repoeing my vehicle, yet they won't take the payment. I also sent in money orders (because I was waiting on my new debit card) and they stated that they did not accept money orders. I checked with Western Union and they cashed the money orders, yet they are calling saying that I never made the payment. I don't know what to do from here. I have tried to pay them and they have cashed some of the payments yet they say that I missed my payments. Any suggestions? I think I am going to go and try to refinance with my bank through a personal line of credit, but until then I need to figure out how to deal with this company.

i also think that it is a prejudice thing. i was told that i couldn't come in the office one day to make my payment by the managers mother who lives around there... thus giving me a $45 late fee. I have to sign a contract for the last 4 months but the managers never show up or never return my calls to sign it, now they are giving me an eviction notice because of $45 late fee. How stupid will that look in court? Go on... lol

I had a car fro them and it was a lemon... they gave a so called warranty on it and I ended up putting 2 engines in this car and had to pay for it out of pocket. totaling on almost 3 grand. So I gave car back. Now they calling my family harassing them and leaving bogus messages. treats to sue me and take my wages. They charged me 9k for a 97 car and I paid about 3k not including the engines that they was suppose to fix and cover. I am so piste. Now they say I owe them 9k grand and consistently harassing my family and friends.I'm gonna file bankruptcy. I can't afford anything. I got hurt and I'm unemployed and may have to file disability. Also I didn't have the car a month before the engine went out. and after that it went out again a month later after having it fixed.

I feel the same way about this rude company. I made my payment but wasnt aware that I had another deferred payment due They called me 3 days after the payment was made to tell me I made the wrong payment and I was 78.00 short. The representative was so rude I asked to speak to her manager and she was also rude. I went as far as the regional manager and she was extra rude. I think its a prejudice thing with these company.
