I purchased a warranty for my 2014 Mercedes CLS550 about 4-5 months ago, at least one week after purchase. The vehicle that I purchased was advertised as 145,000 on the dash by a dealership. It was a vehicle being driven by the sales rep while it was being sold. I guess you would say a demo vehicle but used. The vehicle was purchased from a auction and sold by the dealership brothers auto at that point when purchased by Brothers Auto it had 145,924 miles. I also a screenshot from the Dealer of that also. My bank Alabama credit union did all the paper work on my title. they also put the mileage listed on the advertisement on facebook market 145,000 miles. This was the miles that was reported to Endurance Warranty. This was the mileage also report to the carfax after registration. My vehicle develop some mechanical issues and the warranty company did not want to cover the problem do to mileage discrepancy on my carfax after I registered the vehicle, basicly stating that the miles could have been rolled back but the Mercedes dealership where I took it to repaired reported the accurate miles on my vehicle 149,264 not to much of a difference. I even contacted the dealership of purchase and they sent an affidavit for mileage correction. Endurance stated that they still could not prove the correct miles on it. They said initially that it would be a rewrite and not cover the problem, then later said that it wasn't qualified for a rewrite and they wanted me to sign a document releasing them of all obligation in order to recieve all the money I paid into the policy back. During this dispute they then later change their policy to check the the carfax prior to issuing the policy. This was something that should have been done first. This would have been fixed in the start of the policy. How convient for them to change the procedures after they try to cancel my policy. I have not signed the document and I am currently seeking legal advice on the matter. This is not right, I didn't have this problem with my previous vehicle that I still have with them. I am considering leaving them.

I am not lawyer but I would Advise any of these steps to anyone who has this problem. Document Everything: Make sure you have copies of all relevant documents, including the advertisement, the screenshot, the title, the affidavit for mileage correction, and any correspondence with the warranty company.

Consult an Attorney: Given the complexity of your situation, it would be wise to consult with an attorney who specializes in consumer protection or automotive law. They can review your case and provide legal advice based on your specific circumstances.

Review the Warranty Contract: Carefully review the terms and conditions outlined in your warranty contract. Check for any clauses related to mileage discrepancies, reporting procedures, or any other relevant information that may impact your coverage.

Communicate in Writing: If you haven't already, document your communications with the warranty company in writing. This includes emails, letters, and any other written correspondence. This documentation can be crucial if legal action becomes necessary.

Consumer Protection Agencies: You may consider filing a complaint with your state's consumer protection agency. They may be able to assist in resolving disputes between consumers and businesses.

BBB Complaint: You can file a complaint with the Better Business Bureau (BBB). Companies often take BBB complaints seriously, and it can sometimes lead to a resolution.

Review Other Options: If you're dissatisfied with the warranty company, you might want to explore other options for extended warranties or consider self-insuring by setting aside funds for potential repairs.

Desired outcome: Endurance needs to pay for my repairs
