Total Woman Gym Fraud & Forgery

1/15/2010 I signed up for a month to month commitment of $48 per month. On 4/6/2010 I called to cancel my account. The woman said it wouldn’t be a problem, come in and fill out a form. On 4/7/2010 my husband went in to cancel the account as it was his credit card on the account. They told him that he could not cancel the account because we were locked into a 12 month agreement. My husband told them absolutely not, we never agreed to that, and they said they would contact “corporate” regarding the matter. On 4/8/2010 we received a letter in the mail from “corporate” stating it could not be canceled and they attached a copy of the contract which was nothing like what we had signed. We had kept our customer copy of the contract which is a yellow sheet as well as the credit card receipt still stapled to it. On our contract, it clearly states that it is a month to month commitment and we can cancel at any time. My husband, myself, and a witness went in on 4/8/2010 to confront Total Woman Gym & Day Spa with our contract. The operations manager was polite and took a copy of our contract and compared it with theirs. She noted that there were obvious discrepancies with the contract. The customer copy was the top paper which is yellow and their company keeps the other two which were on the bottom. It’s clear that someone has gone back and added as well as marked off areas in which we did not agree to after the fact. I also asked about an area where there are initials required, I questioned whether the person who signed me up was supposed to initial there. She stated that no, those were supposed to be my initials which they are not. The operations manager said she would talk to “corporate” about this matter and get back to both my husband and myself. On 4/9/2010 I called the main number on Total Woman Gym and Day Spa in the hopes that the number was the main office or “corporate”. Instead, it was the Placentia, CA location but I explained what was happening and they were trying to be helpful. I spoke to a woman there and thoroughly read through my entire contract as well as the fraudulent copy. She agreed that something definitely was not right and that it does sound like information was added after the fact. She also said that I needed to speak to the manager at Brea Total Woman Gym & Day Spa, not an operations manager. I called the Brea location and spoke to an Annett which is the manager and who was very rude. Her explanation is that our copy wasn’t completely filled out and that she trusts the integrity of her employees, in other words saying that no one added to the contract after the fact. Despite the manager saying this, it does not explain why someone marked off the 12 month agreement, signed it, dated it, marked off all boxes pertaining to the 12 month agreement, added a start and end date, etc. On 4/8/2010 I called the Los Angeles Police Department regarding the issue. An officer was sent to my home to review the contracts and after looking them over he agreed that it looked like forgery. He said to file a forgery report with the Brea PD. While speaking to the manager of the Brea Total Woman Gym & Day spa, I told her this. She proceeded to say that they will cancel my account, have spoke to “corporate” and everything is handled.

Total woman has been closed in Ventura for quite a while yet they have continued billing automatically even though they said with the shutdown, billing would stop. They lied. They transferred the membership to another gym 10 miles away and said nothing. I think their employees must be trained by used car salesmen. They get a job in a gym to help others with health, but get corrupted by the system. Very sad. How can they live with themselves?

I think you were just a bitter member who didnt get it your way and decided to post a nasty review, I love total woman, I have no problems with them whatsoever, the staff is great, the classes, the spa, no complaints, well maybe one...how about a pool? =)

Total Woman Gym Unethical Billing Practices

This company does not honor its month-to-month contracts, makes it impossible to cancel membership, continues to accrue monthly fees (despite no use of facilities) and the script is "please send us your cancellation form".

I have done this THREE times since January and now OWE $700 for not setting foot through the door. ON A MONTH-TO-MONTH contract which I paid 1st and last fees at conception.

Beware.

I completely agree with the above complaint. The billing practices are unethical as they come. You are asked to sign a contract via an electric pen pad as they pretend to summarize what you are signing. YOU ARE NOT GIVEN PAPER TO SIGN AND READ. It is, indeed very difficult to cancel and furthermore, they are BEYOND unhelpful with any issue brought to their attention. Absolutely ZERO on customer service/customer retention. They will charge you without your consent and raise your membership whenever they feel like it...no opt out time? hmm...seems illegal, doesn't it!? Why would anyone feel compelled to sign up during a "sale" if you rate isn't even guaranteed? how creepy is that?! I am done with them. What a disgusting company.

Everyone should read their agreement before signing it, and if you dont all your fault. I hate when ppl say "who reads their agreement" of "what in the fine print" if you do it right the first time you wont have any problems. just saying . I always read or ask questions before signing and so far have not had a problem with my gym

Total Woman requires that all cancellation requests be submitted in writing. Total Woman does not accept phone cancellations. This information is clearly stated on each and every membership agreement. To help accomodate our members Total Woman has 4 ways to cancel a month to month membership. If you are in fact an open ended (month to month) member you can 1. Visit the local facility and sign a cancellation form 2. Fax your written cancellation to [protected] 3. Email your written cancellation to MemberServices@totalwomanspa.com or 4. Mail a written cancellation certified return receipt to our Member Services Dept at 4530 E. Thousand Oaks Blvd, Ste #200 in Westlake Village, CA 91362.
