GEICO - Insurance

Hey Dimitrius, can you forward my earlier communications to your team to make sure they get the message but I have since been working on escalating the matter and wanted to put you and Chelsea and Xavier on notice. I also would like to request the name of your direct superiors. I am getting in touch with a little higher but direct accountabilty has historically been more effective. Tomorrow, when you meet you need to run your numbers are review my independent assessments I had done on the car to verify your findings, and the sooner you meet the better, because I will be escalating the matter and building my case first thing in the morning until I hear word back. Corporate and legal are going to be copied on many follow up messages, and since it seems like on your end its the eleventh hour, I owe it to myself to make sure that I am treated fairly and made whole and unethical tactics don’t get swept under the run, not on my watch, not after 3 months admititaly because of an admin error on behalf of your team. I will get in touch tomorrow, but I urge you to decide as early as possible because the more time I have the in the morning the more widely my claim will escalate and spread also while I build my case in accordance with the policy I signed with Geico. That policy contract binds Geico as much as it binds me, and according to the policy, you have no right to skew the numbers to your benefit, especially when this isn’t a close call. My car is worth 50K, I can have it fixed for 14K. Selfish focus on salvage value still doesn’t get you your numbers. Please refer back to the independent adjusters and appraisers I had personally evaluate the car once I started sensing irresponsible behavior as a representative of an insurance company that was supposed to make me whole but has financially and logistically.

I hope to hear news that a negotiation is underway and an actual assessment of a mint car with 4,000 miles driven on it per year is worth more than your wishful thinking guys who are incentivized by having a car like that salvaged. But it’s wrong, it’s sketchy, and I’m not going to stand for it any longer. If no resolution can be found tomorrow, ill will be escalating the matter further, which is costly and litigious, and isn’t productive but I owe it to stand up for myself. Again, please relay this message to your peers so maybe there might be a sense of urgency.

And if you have any doubts I am a licensed Attorney for over a decade barred in New york state and my registration number is 5201959.

I need to make a complaint about the service I am receiving from a team of adjusters that have been so abhorrent to me as a customer, it’s either a case of negligence or inexperience. My car has been held up because on an administrative error on their part for almost three months while I’m still paying insurance, and rental car out of pocket. What’s worse is that they have come to a decision to total my car, clearly under unethical pretext. My car is 3 year old bmw 5 series with 12000 miles, and comparable cars sell for around 50k. The damage has been appraised by multiple parties and its between 12 and 19.

I understand they have a formula that they have been twisting trying to value my car at scrap value of 24k and suggesting there is 20K of repairs when all the damage is superficial and I already agreed with a body shop to do for 14K. In no way does it meet the threshold to deem the car a total loss, by percentage or by calculating the cost of fix plus salvage which does not meet that standard unless blatantly unethical and illegal practices are being employed by this group of three people including dimitrius, Xavier, and Chelsea.

Below is the letter that I wrote them because it’s the eleventh hour and it seems that they have decided to deem my car a total loss, but I would like to escalate the issue before that decision is finalized so as to avoid legal action because I have not only not been made whole, I have been dealt with irresponsibly, unethically, and potentially illegally, all of which is costing me a lot of money that I can not afford. Please call me asap before this decision is made. My number is [protected]. Below is the message that I left them yesterday after constantly being cordial and reasonable without any respectable reciprocation. I am an attorney, and I want to negotiate the terms in a reasonable manner. I even told them I would pay out of pocket the difference to make their math work, but I realized they didn’t even read the the 4 third party reports from professionals appraisers and independent adjusters, all finding information consistent with the points I have been trying to get across. Please help me escalate this asap before this team makes any further mistakes.

I understand that you will be discussing whether to declare my car a total loss tomorrow. I have already submitted two letters from third party appraiser that appraised my car between 46-50. To justify declaring a total loss, the cost of repair + the salvage value must exceed Actual cash value.

It’s been determined by your people that the salvage title is worth 24K and I can get the car fixed for under 14K, which means the cost of repair + salvage value does not exceed the actual cash value for the car, nor does it actually come close.

To justify a total loss, the car’s actual cash value would have to be worth less than 38K for a less than 2 year old BMW 5 series that’s been driven under 6,000 miles per year. This is not a borderline case. Please refer to the the third party appraisal that I have submitted to support my claim. Please also refer to your own Geico adjuster estimating the damage at around 12K and third parties the same. The damage was entirely superficial with no mechanical damage.

Also please consider that the car has been in limbo for almost 3 months now and I have been paying my monthly insurance, which should not be happening, and renting cars paying out of pocket, admittedly because there was an administrative problem within the company. Although the details of the delay were not specified I was told flat out that the delay was due to a mix up of documents or something to that effect.

The customer service and treatment of an insurance company whose purpose is to make me whole, has been abhorrent, unethical, and violates a number of Georgia statutes and industry standards.

Having said that, I urge you to consider all of the information available to you, submitted by me, and the rules and standards of your business and make arrangements to have the car immediately repaired, and to compensate me for the loss incurred for having to pay for insurance and rental fees due to an internal administrative error within the department.
