UniFirst - Employment

My name is Peter Desroches I am a disabled worker. I had worked at unifirst in stockton california as a janitor. In january thursday 7th I was fired at unifirst in stockton california. I was told to go home from my work work supervisor because I was having problems with wearing mask over my face to ware I could not cover my nose. I could of sworn I was fired? I came to that conclusion after I was told if I can't wear a mask fully over my nose then I can't be there. That means I was fired, so that same day I filed a complaint here and called hr and go figure left a voicemail for some fake hr legal representative. I said in my voicemail im looking into legal options if I can't get rehired. I also wanted to know my legal rights and more information on alternative mask wearing to enter the workplace. I never received an answer. Anyway 3 days later I returned to get my termination paperwork. I was then told by hr there that I wasn't fired? I then seen management and the plant manager close the conference door while I was talking to an hr employee. I was told to wait outside of the office. Minutes later I was then told by hr there that I can come back the next day on the 12th of january.
I came back thinking oh good I still have a job.. Nope instead I was then told I was suspended for 3 more days because of work performance regarding covid maintenance paperwork I have to fill out every day. I had to fill it out and do extra work like wipe down the entire plant with cleaner. I did that despite not having enough time in the day, this affected my health because im disabled. So I had forgotten to fill out the paperwork checklist regarding the daily wipe downs.
Its funny how management and hr cleverly used this job violation against me after I filed a discrimination report and i'm called unifirst human resources. This is harassment, discrimination and poor management as far as not providing an extra custodian to take care of this covid situation. Also I was never informed of any alternatives to mask wareing. Under federal law the disabled who can prove wearing a mask is harmful to them dont have to. Also an alternative must be provided at work places. The fact that unifirst believes they have the right terminate a disabled employee because I retaliated is down right illegal. Also in my employment contract there was never any mention of covid maintenance. Another fact there was me and still is another custodian there. Management had pretty much made my work load not even to hers. I had to collect all of the 100s of 1bs of trash which filled up four service carts a day past my head! I had to sweep up literally massive lots of garbage most of the time. I had to clean common areas like the stockroom. I had to clean piles of garbage left by employees and drivers outside. I had to collect pallets and remove them by hand outside because there was no room to use a pallet jack most of the time. Then if that wasn't enough uneven workload, I had to wipe down the entire plant! The other custodian only half way cleaned the production plant then spend most of her day inside the office cleaning. She was hired long before I arrived there. The disabled have rights an no one cares. This has to be illegal?

Desired outcome: lawsuit or employment reinstatement

UniFirst - Unlawfully termination

My name is peter desroches, my phone is [protected]. My email is [protected]@yahoo.com. I am legally disabled and reconized as disabled by california state and federal law. Today on 1/7/2020 I was terminated at the location of stockton california for not wareing a mask completely over my face. I have nervous problems which makes my breathing heavy, this is do to my disability. Now im looking into possible legal options. Currently I have evidence I am disabled. I have ssi social security reward letters stateing im able to work under the ticket to work program supplied by the social security administration. I do not have current up to date medical evaluations or treatments do to I must be treated for my disability. I refuse by law treatment there for any request for a doctors diagnosis treatment evaluation has to be nullified do to the fact its my legal right to refuse medical treatment for my disability. However I still need to get a doctor and get the current paper work for court since I now have to explore possible legal action against unifirst for my unlawfull termination. However it dosent have to come to legal action. All I want is my job back, I want a medical exception for wareing a face mask to where unifirsts policy on that can change for modified policy on face masks.. In other words im asking unifirst corporate to ware a mask below my nose and over my mouth. Also I have attendence issues do to being disabled. My health had deteriorated leaving me to being absent under sick pay and unifirsts absents policys. I need my absentances and record to be excused or erased. Also I want unpaid wages for any days and weeks that will occur for my unlawfull termination untill unifirsts legal depart agrees on my terms.

follow up on my termination: peter desroches here. turns out i wasnt terminated. I misread the order to go home. it was based on covid poilicys to go home that day. being stressed out because of this covid situation had alot to do with it.
