San Diego attorney Scott McMillan to remove public records sanctioning his conduct. The federal court dismissed the lawsuit and found it to be meritless. Scott McMillan with an office in La Mesa, California (east San Diego), then appealed to the Ninth Circuit. On January 27, 2020, the appellate court found the lawsuit aimed at censoring speech was meritless and denied his RICO appeal. Scott McMillan San Diego attorney must now defend why he brought an identical lawsuit in state court which is prohibited and a motion to dismiss based on the defendant blogger reposting public records. In another lawsuit, a Ninth Circuit judge berated McMillan in 2017 for filing a "silly" lawsuit against the ATF, not based on principle. See video clip. Scott McMillan also filed a declaration alleging ATF agents stole property as "war booty", vandalized property of his client's gun store, and intimidated him.

McMillan is being sued for fraud in federal court by a large firm; lawsuit survived motion to dismiss, and McMillan cross-sued the victim.
