Business Sales Companies - Unethical Sales Techniques

I would like to bring your attention to the fact that certain companies are targeting small business owners who are 'selling up' in this recession. These companies, such as RTA Business Sales, Meridian and Sovereign, take an 'up-front' fee after just waving the contract at the business owner, get the owner to sign without giving them a chance to read the contract; and then, typically, place just two adverts on a couple of websites. When the business owner gives up and sells through another route, these Business Sales Agents threaten litigation and extort money out of the business owners. I say 'extort' because their contracts have been found, in court, to contain unfair terms.

I am in the process of being shafted by these people, paid up front to sell the business plus VAT, then conned into getting a energy certificate by one of their sister companies, then not a word from them in 8 months, my business finally had to stop trading and now they say i owe them nearly £1200 for them not selling my business! None of this was explained in the initial brief with the rep, it was just sign here and here and dont worry, PLEASE, PLEASE put the word out and alert people to these con artists..

RTA Business Consultants are quite simply not fit to do this job. The sales staff over promise, and then never deliver a prospective buyer, ever. And when you cancel, you get a tirade of abuse and threats of blackmail from Paul O'Reilly. And before you know it, you have a court summons on your desk.
So do not ever sign, do not ever agree to meet. They are simply not able or ever want to sell your business, but live on out of court settlements.

Outrageous fees. Why do we pay them up front 30%? No one else does this, ever. This is not standard practice anywhere, but it does tie you to them, just how they like it. And when you sign, you awake from a mysterious ghostly moment, and then realise what you have just done.

Last October 2013, I was recommended to RTA and a senior Business Consultant Mike came to visit me. Mike gave his brilliant sale patter, telling me the business would be sold as quick as 3 months and he has sold another business within six weeks (what a joker) and has a couple of potential buyers. Our business would be advertised in all the major national papers and magazines and their website.
RTA wanted us to have a contract for 12 months at a cost to us £12, 000. I managed to get a six months contract for £6, 000.
I sent RTA the floor plans and measurements, a week later they sent their photographer round to take pictures but it was not good at all, RTA decide to use our own professional pictures instead.
In six months:
• Not a single buyer as promise by RTA sale consultant
• 8 hits on the RTA website, 2 downloads in six months
• Never seen any advertising in any of the major national papers or magazines
• Very difficult to talk to someone at RTA, kept getting pass round and holding for ages
• Emails ignore or takes days to get an answer
• Promises after promises not worth the paper it is written on
I would never ever recommend RTA for several reasons, first they demand very high fees upfront, broken promises, useless customer service, it is just a website and that is all.
If you need to sell your business always go to commercial agency, they would never charge upfront fees and will push hard to sell (it their way of making money).

Thanks, I've read enough of complaints made against RTA and 2 other agents, to be fair to RTA, their agents whom we have met was very pleasant, not pushy or demanding.
But asking upfront fee of around £3500.00 is a bit much. We were told that he will find out the lowest amount we can afford for a deposit The staggering amount of 10% commission for real estate fee is very high, so on that basis we want out. Luckily we have not signed the contract yet. we never signed on first visit, but gave them 3 days before our final decision.
And now reading 3/4 of complaints, I am glad of all the blogs.Thank you . Eugjac

I just had a visit from the sales guy, and when he mentioned the upfron fee, he said it as 1 7 5 0, not one thousand seven hundred and fifty, which sent alarm bells for me going. Got him down to £500 but still never signed

please tell me what we can do about this company, as they are conning people with their sneaky sales tactics, bad attitude and no cooling off period not even 1 hour.
I have experienced bad salesmanship from RTA, and I am now unfortunately stuck in a contract with them even though i tried to cancel within a few days. They even had the cheek to say that they can terminate the contract if they think we might prevent a sale or if we become a nuisance which means I will still have to pay them the £1500 fee. I said I would take them to court, but he basically laughed and said go ahead we will win. I am really stressed about this and there is nothing I can do, as all the people complaining are stuck in the same boat and no one is able to stop these terrible tactics or shut them down for good. I understand that YES we signed, but the rep also lies and doesnt go through the contract properly or even let you read through. WHAT CAN WE DO?

I also have problems with a similar company called Hilton Smythe i paid them an upfront fee of £700 i heard very little of them for 12 months apart from them hounding me to reduce me asking price i have now been taken to court due to me requesting to leave them but unfortuntley under there conditions i have to pay them the best part of £1000, when i first originally used Hilton Smythe Commercial they claimed this wouldnt be the case an they were unlike other agents when in fact they must be the worse as iv had to pay all this money and not even had one bit of interest.

I feel that before public ridicule is accepted a full investigation must be complete, There does appear to be problems with certain companies within this domain, But we feel for somebody to be slated for extorting money is absolutely pathetic, Before agreing to your terms you should allow your-self adequate time to read any contract placed in front of you and for anybody to blame the way it is pushed on you is absolutely crazy. We personally have never felt threatened nor have we felt the need to sign a contract there and then, the contract is there to prevent any wrong doing from both parties and it allows you both security within your agreement, if the party decides to break this agreement they would be liable to compensation, this is a legal biding contract which believe it or not gives you better security than the person issuing it, WHY? Because the courts have been given power to deem a contract unfair

We placed a small internet business for sale and paid £500 up front. Business valued circa £15k...commissions if sold £3k plus vat...sharks! However we had a couple of enquirers, but all ended coming in directly as RTA didn't answer the phone, didn't respond to messages...Genuinely if I knew then what I know now...sell your businss on EBAY, Daltons Weekly, Local paper...but do not use RTA...their customer service is terrible!
We had an offer (very low) but due to ill health it was considered, RTA would not reduce their commisision claim as they have to cover their overheads...3 phone calls and an internet ad!...they offered us a 33% reduction in commission if we paid the sales commission in advance...even without a sale...when questioned...what if the sale doesn't go through...the poorly trained rep said...they'll probably refund it mate...Wouldn't trust this outfit to sell a used car never mind a business

I signed with RTA in 2009 and have had no replies to any enquiries or complaints I made in writing to ask where and when they were advertising my business. I have had not one communication from RTA in respect of any enquiries on my business.
I have had email correspondence directly with a potential buyer informing me that RTA did not answer, nor return, her telephone calls.
Today I have received a letter from RTA demaning a £600 cancellation charge.
Please. DO NOT do business with RTA.
Google "RTA complaints" for further evidence of this seriously unpleasant and nasty business.

I signed up to RTAbusinessesforsale in 2012 and I have never received any feedback from them EVER. Every phone call has been me to them to chase up progress, even when they 'claim' that there has been interest, they have never referred this information to me. It has only transpired there was interest after numerous calls to them. They never seem enthusiastic when I do call and their only ever advice is to reduce the cost of the business to get interest going. I am now also advertising my business on other websites, funded solely by myself and not through another agent and I'll see how things go from there.

RTA took over £1000 pounds from our small family run business back in 2008 and we never heard from them again, we did not receive any potential buyers or correspondance from them from the day they sent a divvy rep round . well after two years sold our business to friends.Today we recieved a letter telling us they require £5460 ! like hell your gonna get it.Our agreement was for 12 months only the representative knew this we have witnesses to this fact too.
We too will go to court and we will try and get our money back plus compo for the inconvieniance .
