This factual complaint is being produced by America's Pro Se LLC on behalf of the victim customer in question. On August 9th and 10th at 8:49 pm on both dates Walmart illegally and unauthorized debits totaling $113.49 from the loyal customers debit card checking, not the customers credit card. The customer was alerted of this fraud transaction and to cancel the debit card used by Walmart, it was cancelled immediately to prevent any more fraud debits to the loyal customers checking. The customer emailed Walmart's so-called Exec Offices to alert them of this unauthorized debits, they refused to communicate. Twice after the loyal customer requested why this happened again Walmart deaf ears which is their norm.

Loyal customer then received an email after the customer filed a BBB complaint which Walmart demanded by closed, which was the case. Customer received an email from a Megan no last name stating Walmart has closed this issue, never produced a case or file number after it was requested. Customer filed a complaint to the FTC and received an email stating "sue us". Customer the received an email from a law firm they hired in SC to defend Walmart. Custoner retained America;s Pro Se LLC to assist as a Pro Se to sue Walmart as they requested happen. Plaintiff customer now alerted their lawyer in SC that Plaintiff has requested the three year online purchases so Plaintiff can prepare the law suit, lawyer in SC never responded nor produced it which violates the Rules of Federal Civil Procedure. Plaintiff customer as a legal courtesy as requested to do offer to their lawyer in SC and to Walmart the following settlement to prevent litigation and save Walmart of lawyer costs etc.

1. Walmart immediately refund the $113.49 back to the Plaintiff's customer checking they used to make the three unauthorized debits with written confirmation from their lawyer in SC.

2. Because of the major inconvenience caused by Walmart, for having the long use debit card cancelled because of the fraud debits and for the emotional distress of Plaintiff's account having this happen to a online gift card for $500.00 with written confirmation form their lawyer in SC.

3. Plaintiff customer would sign a release prepared by their SC lawyer so Plaintiff customer would not proceed on any legal action etc.

This was for Sept 19, 2023 by 5pm est for Walmart to accept via their lawyer in SC, again deaf ears from Walmart and their lawyer in SC. Thusly, the settlement offer was immediately terminated on 9/20/2023 as was alerted to Walmart and their lawyer in SC.

Walmart does not care for customers that have been harmed by Walmart, they stated "sue us" Plaintiff customer has done what they stated compensatory damages $75,000, with other violations imposed in the proper venue and jurisdiction, Walmart and their lawyer in SC have been served.

Stay clear of Walmart, if Founder Sam Walton was the CEO of his company this would never happen to customers, Costco is the best way to protect your customer rights from any illegal actions to a customer of their bank accounts.
