Attached please find some forwards between my agent, myself and Oceania Cruises over the past few weeks.

I have been requesting a full refund for the past three weeks from Oceania because of the War Zone that now exists and continues to exist in the Middle East. I had planned a trip on the Nautica throughout the Middle East, including Israel. Being Jewish immediately made me believe that we should not take the trip in the Middle East because all the Arab Muslim countries (including Turkey) support Hamas who want to destroy Israel and kill all Jews.

Ironically, Oceania informed me throughout this scenario that I can cancel, and if so, the penalty is 100 percent, loss of entire cruise fee of $12,600 approximately. No option was ever available to me, but to go on a cruise it created, but not the one I purchased.

Destination Israel was taken off the itinerary about three weeks ago, and now, by way of Carlos E. Ortega, VP of Global Guest Services email (copy attached), the balance of the cruise, but for the departure port, Dubai was removed from the cruise. I was informed by Oceania from the outset that it was considering its options and that an email providing a refund or credit would be provided to all guests. I never saw any email, but I did see Mr. Ortega's email a few days ago.

Oceania participated in bait and switch, leading me on to believe that I would receive an email providing me options, but it never came.

The bottom line is that Oceania has breached its contract with me since I did not purchase a cruise throughout Europe; and to compound the situation, Oceania has committed fraud by its bait and switch unlawful tactics compelling me to go through a war zone and end up in an Arab Muslim Country being a Jew.

To date, Oceania continues refusing to return in full my cruise fees of $12,600. I do not anticipate that Oceania will refund to me my cruise fees of $12,500, of which there is no justification for this unlawful position.

I request that Oceania forward this email to its legal counsel to provide a response to me supporting the basis for its unlawful position. Absent immediately receiving a full refund, I intend to prosecute an action against Oceania for Breach of Contract and Fraud, etc. I also intend to inform other guests on the Nautica of the illegal conduct undertaken by Oceania in this matter.

Very truly yours,

Frank Mulberg, Attorney

Good morning, Zadby,

Do you have a copy of our purchase contract with Oceana?

We bought one cruise, they lied and stalled for 3 to 4 weeks, waiting

For an email that was going to give us options: bait and switch.

This is a breach of contract and a misrepresentation, bad faith.

I bought a Middle East trip and now i have something that I did not purchase.

Can you put me in touch with a high level officer at Oceana. Also

Can you put me in touch with a high level officer in vacations to go.

I need to get in touch with other passengers on the cruise immediately.

Can you obtain that for me, an email address. I want to know who is on

The boat that is going to dubai.

I do not want to go to Dubai as I am Jewish and the Arabs are United and

Support Hamas who want to kill Jews.

Aside from a breach of contract by Oceana, the dept of state has informed citizens

To get out of the Middle East because it is in a war zone. Is Oceana serious about

What they want us to do.

I want a complete refund from Oceana.

Zadby, please forward this email to a high level officer at Oceana,

As well as a high level officer at your own company.

Can I be put in contact with your legal department to pursue a remedy?

Thank you.

The cruise line has changed the itinerary for the safety of the guests, so they are not canceling the cruise or offering options.

The cruise line will not give anyone a list of passenger's names as that would violate their privacy.

Zabdy,

Did you ever receive an email offering from Oceana that was supposed to be sent offering options?

Did you ask for a list of customers as I asked you to do?

Good afternoon,

I have followed up with the CruiseLine again. The agent stated effective today, Oceania is no longer offering the FCC option due to the fact that they have changed the itinerary to ensure guests safety during this cruise.

I requested for a supervisor for further assistance and they made the same statement. If you were to cancel the cruise the cancellation penalties remain in place.

Good afternoon, zabdy,

Attached is Oceana email, essentially, cancelling cruise since it nothing like the cruise I signed up for. Of course, they should have just cancelled the cruise given the explosive situation in the Middle East.

Please contact Oceana and request a refund, all money back., not because we are cancelling cruise, because Oceana has cancelled cruise by their own actions. We have many plans to attend to concerning money back for airline tickets, hotels, outside excursions, etc. Will Oceana reimburse us for any losses we sustain.

I also would like a list from Oceana of all customers not going on cruise because of new itineraries and explosive situation in Middle East.

Call me if you have any questions.

Best,

Frank Mulberg

I'm booked on the same cruise Nautica Nov 18, 2023. I have called Oceania to request a refund because the itinerary is not what I have booked for. Oceania refuses to refund because their excuse is that " they reserve the right to change itineraries". This is not fair for customers! I agree that this is indeed "bait and switch".
