Jan-Pro Franchising Franchisee package

I am writing to formally express my concerns and dissatisfaction regarding my experience as a franchisee with Jan-Pro of Central MS since my purchase in 2021.

I invested $3,000 towards a total package price of approximately $5,500, with the expectation of receiving monthly earnings of around $911. Unfortunately, I have not had any accounts that meet this expectation. Recently, I lost an account due to complaints that I believe were miscommunicated. I was not provided with a copy of the complaint, and my conversations with the client contradicted what the office had communicated.

Despite my efforts to rectify the situation—submitting proof and photos of the work I had completed—I was informed that the account was taken away without being replaced. My attempt to discuss this issue during a meeting with you was met with criticism rather than constructive feedback, and I have received no follow-up or resolution to my concerns.

After months of trying to communicate with you through emails, calls, and texts, I was surprised to hear that I need to undergo retraining without any prior notice or clear communication regarding my performance. This lack of professionalism and responsiveness is unacceptable.

I urge you to reconsider the handling of my case and to provide clearer communication and support moving forward. I am committed to upholding the standards of Jan-Pro, but I need better guidance and resolution to continue successfully.

It’s clear that your experience with Jan-Pro Franchising has been anything but smooth, especially considering the investment you made with the expectation of receiving regular earnings. Losing an account due to unclear or miscommunicated complaints, and then not having it replaced, is certainly frustrating. You've been left in the dark despite providing evidence of your work and making attempts to resolve the issue. The lack of communication and professionalism, particularly the surprise notice about retraining without prior discussion, only adds to the disappointment. Hopefully, they reevaluate how they've handled your case and start providing the support and transparency that you deserve as a franchisee.

Jan-Pro Franchising Franchise

Jan pro of Atlanta is a scam company, they got me for $23000. They will literally tell you a lot of lies and promises that they can’t keep. Dealing with that franchise company is a nightmare. The sale people lie, the Vice President lies, they are nothing but blood suckers. Please be careful young entrepreneurs! Do not invest your hard earned money with that company. Look at their reviews and will see how many complaints and law suits the have against them. They will blame you, and in your face so they can keep your money. They need to shut this company down. It should be illegal for them to be in business and arrest the owner and the Vice President.

Jan-Pro Franchising Unreliable franchising office

Good Morning,

I have been a franchisee for Jan Pro since July of 2018. Since then I have gained accounts and lost accounts due to misconceived lies and unaccountable management. I previously had an account with Estes Trucking Company. Unfortunately I suffered a death in my family that meant I needed to take 48 hours off due to funeral arrangement preparation. I was lied on about the amount of time I had to take off. Not to mention my operation manager disrespected me verbally and then had the nerve to tell my higher ups that I missed 72 hrs instead of 2 days. Leading up to the day I asked him for help in locating someone and was not helped at all.

Fast forward another one of my accounts moved their location and went through renovation services. I was never told about this change by the office. When I told them they didnt know as well. The trying part isn't the miscommunication though. It's the idea that I was never properly given a replacement account. When I did bring it up I was told I declined 3 accounts. Which is another lie. I was told about 2 accounts and declined both due to distance. At my meeting with Jason I was informed about a new account matrix that's generated often but never received any email. As you can see this is nothing new and my distrust in the management in Edison has stopped me from reinvesting and making the best out of what I thought was a great franchising opportunity.

Jan-Pro Franchising Ripped off

Go I am certain that Jan Pro is a wonderful company as my Professor suggested to me to buy into. And I did in 2021 of July in East Hartford, CT. I was full of dreams and really liked the operations Manager, thought the guy was cool. Since being in New Haven, I was informed that a new operations mgr was coming. I waited over 60 days close to 90 and the 89th day I get a call from this guy stating that he tried calling me for days mind you all calls I save and have record of and he did not when I did speak with him, I told him I am not satisfied and wish to have my money back. The main operations mgr in east Hartford told me if I'm not pleased, then sell my company. Not only have I not received the equipment I bought, I have to date no business (6/2022). My advice to any minority, get an attorney before signing anything in CT with JAN PRO. I am out of a business and if I wanted to go to another commercial cleaning business I cannot because of the contract I signed. Is this not clear BULLYING and major RACISM! I even tried contacting the Florida office so that I could get another location and they gave me some pointers

Desired outcome: I want my money back only because the people i have to deal with in CT are never going to treat me with the respect and fairness needed to be a successful business person

Jan-Pro Franchising Discrimination against employees!!!

I work at the CVS in Wilkes Barre, PA and I've witnessed discrimination against a Jan-Pro employee. The new manager of the building has hired her son and his best friend to work here and they haven't been dong their jobs correctly since. Us, CVS employees and the security guards has made several complaints but no changes were made, things just got worse. After the last complaint one of the lead Jan-Pro employees finally stood up to the manager and told her about her son's failure to do his job and she fired him. Later on, I personally heard her say "We finally got his black a* out of here."... I did not report this to my employers because I'm afraid much won't happen and I'll end up being fired next.

Desired outcome: There should be some type of investigation and she should be fired as well for making such hurtful remarks.

Jan-Pro Franchising Cleaning using minors to clean daycare

I have videos from past year of service, kids cleaning my daycare running thru it at 2 am I have had crew after crew replaced, they use all my cleaning products sweepers etc and do not check on who they hire, I have over 40 emails to the franchise owner Nancy Dillard who does nothing about it, I'm fed up and sending these videos of children cleaning to someone who will shown what Jan pro is doing, minors under 18 cleaning is not permitted with your company as I already called about that

Jan-Pro Franchising When this transaction occurred I had to pay the same sales and marketing fees that the previous franchise owner had to pay

I got ripped off by jan-pro of Cleveland. Like so many other people I to fell for there Deceit, Fraud and Missrepresentation. I was given accounts that pay less than minimum wage. I was also given accounts that belonged to previus people. When this transaction occurred I had to pay the same Sales and marketing fees that the previous franchise owner had to pay. They take from your paycheck and at the end of the month you owe them as if you are paying for a job. Then when you buy things from them on items from your business on one day they split it up on 2 different billing accounts to steal more money from you by charging you different sales taxes. These blood suckers need to be exposed and taken down by the law because they prey on the poor and uneducated. JanPro are Predatory Lenders

I totally agree. It started off good I was making money my first 7 or 8 months. then one of my accounts moved to another building where a janitorial service was already in place . that was June of 2020. it too them until the end of August to replace that account. they replaced it with 2 small ones which only paid around $500. a month when the one I lost was paying around $850/month.

Needless to say with all the fee sand royalties i was making somewhere around $ 112. down from $700 and still had to pay off the previous franchisees fees. In June of 2020 JanPro sent me a payment for $ 35.00 needless to say all I could do is laugh. December of 2020 they sent me a payment for $00.00 that was the last straw. They don't replace accounts in a timely manner and they don't care about franchisees but they do expect you to service accounts your not getting paid for. SLAVE LABOR. i refuse to clean anyone's building for peanuts while someone else gets rich.

Jan-Pro Franchising They ripped me off badly and I never received a dime from them

This business is called Jan-pro, this company steals from their Franchisees, they overcharge them money for the items of cleaning, janpro cleaning systems has a particular lady by the name of office manager who stole 3 computers from office depot and ups.

If I were you I would not purchase a cleaning franchise from these people I would go to another company, at the end of the month you could have paid 4, 000 for example to them for a franchise and bring home 100 dollar paycheck. they even have customer who come in raging about there paychecks I know because I use to use there franchise, and they ripped me off badly and I never received a dime from them.

the regional director is the person who is suppose to direct the company’s cleaning company, and secure a site for you to go and clean, and they are extremely expensive.

Commercial cleaning franchisees sue

Several pending court cases, which are all seeking class-action status, challenge the business model on which some of the largest commercial cleaning franchisors have operated for decades.

Lawsuits have been filed against Jani-King International of Addison, Texas; Coverall Health-Based Cleaning System of Boca Raton, Florida; and Jan-Pro Franchising International of Alpharetta, Georgia.

That business model, developed by Jani-King’s founders in 1974 and since copied by competitors, is promoted as a low-cost business opportunity. Each franchisor sells off regions of the country to master franchisors who then sell unit franchises to individuals–mostly minorities and immigrants–who pay franchise fees of $2, 000 to $5, 000, plus “finders’ fees” for a specific amount of monthly business. At Coverall, for example, a franchisee would pay a total of $10, 750 for a franchise package that provides $1, 500 of commercial cleaning business each month. The Coverall regional franchisor then provides all the training, obtains and distributes all the cleaning contracts, sells required supplies and insurance coverage and does all the billing and collections–services those with a native language other than English might find useful.

But the lawsuits, filed recently in Massachusetts against all three companies and in Pennsylvania, Minnesota and California against Jani-King, contend that the cleaning companies misrepresent their offerings, because they do not have sufficient customers to guarantee each franchisee the amount of monthly cleaning business they purchase. Instead, the lawsuits allege, they breach their contracts by underbidding the amount of time and staffing required for each job, refusing to allow franchisees to inspect cleaning jobs or bid sheets before accepting or rejecting a job, offering geographically inconvenient jobs and unjustly taking jobs from one franchisee to re-sell them to others.

Perhaps more damaging is a second contention–that these so-called franchisees have so little control over their livelihoods, they should be re-classified as employees of the janitorial franchisors and, therefore, entitled to minimum wages, overtime pay, unemployment benefits and worker’s compensation.

Lawsuits over misrepresentation and breach of contract are nothing new. According to its 2008 FDD (Franchise Disclosure Document), Coverall has settled 26 such cases in the past 10 years, admitting no guilt, but paying former franchisees settlements of $3, 575 to $450, 000. Many of the 52 pieces of litigation listed in Jani-King’s FDD also ended in settlement payments. Commercial cleaning franchise contracts are usually written only in English (Coverall has offered a Spanish translation since 2004) and are so complex that the state of Maryland adds a warning page about potential risk factors to their FDDs, said Dale Cantone, Maryland’s assistant attorney general. The Federal Trade Commission distributes a 19-page booklet of cautions for people considering commercial cleaning franchises.

What is new is the second charge, that commercial cleaning franchisees are merely buying themselves low-paying jobs and should be treated like employees. In 2006 the Massachusetts Supreme Court ruled that a Coverall “franchisee, ” Rhina Alvarenga, was actually an employee and therefore entitled to unemployment benefits after Coverall removed her from a nursing home cleaning account. Attorneys representing Jani-King, Jan-Pro and other Coverall franchisees cited that decision in their complaints. “It’s possible that the business model under which they’ve operated could be ruled illegal, ” said one of the attorneys.

Shannon Liss-Riordan, an attorney with the Boston firm Lichten & Liss-Riordan, who has filed lawsuits against Jani-King, Jan-Pro and Coverall, said, “It’s heartbreaking to meet immigrants who have put their entire life savings into these franchises thinking they will have businesses to support themselves and their families. Instead, they are buying jobs that are terrible, that pay less than minimum wage. When they do get a check, the franchisor has taken out so many deductions, for royalties, supplies, management fees and bogus insurance policies, that they receive very little. I’ve seen pay stubs that say the franchisee owes the company money.”

The other side responds

Representatives of the janitorial franchises disagreed. Jacqueline Vlaming, Coverall’s general counsel, said, “Every franchise owner who runs it like a business can make money. Ninety-nine percent of the people who buy a Coverall franchise are committed to it.” Ron Rosenwasser, of Friedman, Rosenwasser & Goldbaum, of Boca Raton, who represents Jan-Pro, said, “We have thousands of franchisees who work hard and develop their franchise; others fail because they do not work the territory or are distracted by personal problems.” And Don Burleson, executive vice president of Jani-King, said, “We have over 12, 000 franchisees worldwide who have been operating for decades and have many success stories.”

All three top cleaning franchises claim to have thousands of unit franchisees. Jani-King and Jan-Pro, in fact, trade titles as the country’s fastest-growing franchise. But when Franchise Times made random phone calls to “active franchisees” listed in FDDs from all three systems, we found only a handful of people who said they were still happily working the franchise.

Since they operate through regional master franchisors, Coverall, Jani-King and Jan-Pro do not file FDDs that list all their unit franchisees. Their master franchisors are required to file their own FDDs, including franchisee listings, in registration states. New Venture of San Bernardino, a Jan-Pro regional franchisor in California, lists 94 franchisees in its most recent FDD.When Franchise Times called 39 of them at random, only three we reached said they were still active (two said they were making money and a third said she was “doing all right, but I’m not glad I got into this.”) Of the rest, 10 phone numbers had been disconnected or reassigned, seven phones were never answered, 11 people never returned our messages, four people spoke only Spanish and four others said they had left the franchise because they never made any money.

Out of 17 franchisees listed in Jani-King’s Los Angeles/Colton region, we reached only two that were still active. An Ohio woman listed as a current Coverall franchisee said, “I gave them $16, 000 and didn’t get squat. After two years, the most I made was $600 a month.”
Celeste Iles, of Rialto, California, said, “I paid Jan-Pro of San Bernardino $5, 000 for $1, 600 worth of work every month. Before I paid the money, I was told that I’d get accounts in the Rialto area and that I could decline jobs in cities I didn’t ask to be in. Once I started, they offered me one cleaning account in Chino, which is 25 miles away, and others 15 to 20 miles away. When I turned those down, they said the offers fulfilled their contractual obligation. They did give me a few little accounts, but I never got my maximum volume.I cleaned one building diligently for over a year. Suddenly, the person in the Jan-Pro office said my level of cleaning went down and I lost the account. When I went back to the customer, they told me they never had a problem with me. I discovered that Jan-Pro would take accounts away from one franchisee to sell them to another franchisee.”

Gerardo Vazquez, of Bloomington, California, said he, too, had purchased a franchise that was supposed to generate $1, 600 worth of business each month from the San Bernardino Jan-Pro office. “But the office would underbid each contract, and no matter how hard I worked, I never made more than $4 to $5 an hour.” After Vazquez posted his complaints on Internet blogs, he was contacted by so many other Jan-Pro franchisees, they decided to file a class-action lawsuit. He is now one of the 12 lead plaintiffs involved in Liss-Riordan’s Jan-Pro lawsuit, filed last December in federal court in Massachusetts.

Fulton Connor, Jan-Pro’s master franchisor in San Bernardino and San Jose, denied that his office underbid contracts. “Some people, like Mr. Vazquez, took too long and were not following the cleaning schedule. In general, our franchisees are happy. I’ve had owners thank me because they were able to buy homes for the first time in their lives.”

Jan-Pro CEO Richard Kissane called the lawsuits “witch hunts” and said, “We have only one lawsuit in our FDD. If we didn’t have wonderful relationships with our franchisees, we’d have lawsuits out the yin yang.”

Liss-Riordan said, “The reasons we see so few complaints from commercial cleaning franchisees is that immigrants are often nervous about exercising their rights in the U.S. legal system. They don’t know who to contact or they’re embarrassed about losing so much money.”

That may soon change. Thomas Pahl, of Foley & Mansfield in Minneapolis, who specializes in class-action cases, filed his case on January 27, 2009, on behalf of 52 Jani-King franchisees who were referred to his firm. In that case, Jani-King, represented by the Minneapolis firm of Faegre & Benson, won motions to dismiss 11 of the plaintiffs because their claims were too old and to move the action from state to federal court. But a request to dismiss the case altogether was denied.

The companies’ business model might have worked a few years ago, before all three had recruited so many franchisees, the attorneys for the plaintiffs agree. Now they’re so desperate for cleaning contracts “they’re racing each other to the bottom, making bids so low it’s not possible to do this work and make a living, ” said Liss Riordan. “If we’re successful, ” she added, “we’d like to see cleaning work done by employees who receive the benefits of employment.”

Jani-King’s Burleson predicted a different outcome. “I don’t believe there’s any merit in these lawsuits, ” he said. “There’s nothing different now. We’ve been doing the same thing for decades.”

I worked for Jan-Pro for 6 months in 2009 inspecting jobs and making sure the clients we had were getting cleaned. I would do somewhere between 10 to 15 inspections a day. The whole time i had worked there a fellow by the name of Dana Humphrey was stabbing me in the back to management. He is a snake and two faced. He talks about his cleaning contracter...

Jan-Pro Franchising franchise scam

I paid $9, 000 and signed a $5, 000 note in August 08 for a contract "guaranteeing" me $60, 000 in gross annual billing. The master franchisee rushed me into two major account, both severely underbid, prior to me being trained. Both accounts were taken away from me within 30 days ans subsequently passed around to several other "new" franchisees. My total billing was around $5, 300 and I was told that "my contract had been fulfilled" and any new accounts I would receive would be charged to me. Finally, in October 08, I completed my training and then got a few accounts, but they still only totaled around $16, 000 for the year. This year will be even less.

The management skills of the owner are awful. They have had 6-7 operations managers in less than two years. Some of them don't know which end of the mop goes on the floor, but they are still hired as the experts. Most of them get tired of the lies and deceit and simply quit.

At my request, a friend went "franchise shopping" and was told that it would be no trouble to get him $125, 000 in gross billing for the $20, 000 he told Jan-Pro he was ready to invest. He even got their lies by email. THEY WILL DO AND SAY ANYTHING TO GET YOUR MONEY - that's the bottom line. Run! I haven’t saw a god side to it yet. I haven’t made one dollar but worked another owners contract. Their excuse we got sued but they refuse to provide me with any proof. Have called since then for other accounts . They always say there’s none available. It’s so much I can go on and on . My best advice is run! (NewOrleans Louisiana)

This company sucks, they employed illegal at certain pay rate within a month they lower down their rate from $9-$8, they also ask employees to take the dirty rags home to wash them other wise they will get fire, the Colombian supervisor is always harassing the women, he calls them after work hours to find out what they are doing,

I have the same situation about JAN-Pro San Antonio, Texas at the Isom Road, is a big scam but you know why many peoples d, ont said nothing, because they d, ont have a legal documents for work at USA, and they d.ont speak english.big scam, mean taken money from poor peoples.hello Janice be ready for the worst. In all fairness, since the article was published almost a year ago, the local Jan Pro franchisor has come back and offered me additional accounts, but I refused them due to my not being able to climb stairs. In spite of all this, I would actually clear almost $25 per hour if I were doing all the work myself, which you have to admit, is a pretty good part time job, so be the judge on whether or not it suits you. No where close to what I paid for, but it is what it is . . .

Jan-Pro Franchising Fraud

I worked at Jan-Pro of Tampa Bay and lived the horrible things that were done to poor innocent franchise owners. They would convince people to buy a franchise and illustrate a perfect picture of what they would be earning as independent business owners. It is sad how many give up their life savings to this company in hope of getting the American Dream in return. While I worked there I had to help one particular individual with a room to live in. I actually had her living in my house because after she invested $18, 000 in a franchise that would give her $6, 000 net/monthly she ended up getting less then $1000 from her investment. I just hope that if this company is going to sell franchise to stop their little games and stop stealing peoples money. They are quick to take your money and get you signed but after you buy with them and need help they forget that these people are actual business owners and treat them as if they were employees working for jan-pro. STOP STEALING ALREADY!

If you have been ripped-off by jan-pro you can also file a complaint with the Federal Trade Commision. There website is www.FTC.Gov

You should also file a complaint with the Atorney General. The more people complain the faster we can JUSTICE.

Jan-Pro Franchising SCAM

Jan-pro is a BIG SCAM. They will be very nice to you up to the point that you give them your money, then it all changes from there. This is not a business you are basically working for Jan-Pro like an ill treated employee. The contracts are underbid and the operation managers lie to franchisees all the time. If Jan-Pro cannot find a contract for a new franchisee they will take it away from an existing franchisee, this means they make money (sales and marketing fee) more than once on the same contract. I know some people who make less than minimum wage on some contracts they actually have to take money out of their pockets at the end of the month. If you want to sign up with Jan-Pro say goodbye to your money and hello to a headache.

I’m gonna be honest, it sounds like an issue with how you run your business, not Jan pro’s model. You should be talking to the clients and getting satisfaction reports, they’re the ones who cancel contracts on you. You should be managing employees, you handle your own taxes because that’s your business. Jan pro can not manage your expenses or your employees expenses, payroll and tax is your responsibility because it is your business.

As far as managing clients and employees, you should be checking what is getting done to make sure the job is getting done properly and on time. Not only that, you should be making time to meet with clients every so often to talk to them. At the very least, an email and some kind of reports to see if they’re happy with the service. If you don’t talk to them and they don’t like how things are getting done, of course they’re gonna want to cancel. You otherwise have a contract in place to protect the business.

Stay away from Jan Pro, the office of 1148 Ambassador Rd services the Baltimore metropolitan area are like vampires. Once they get into your property they don't want to leave. We were told we would be able to cancel a contract yet later they tried to hold us by stipulation in the contract. After they failed to execute the terms of their contract their reply was it was a typo. The business practices are unethical, aggressive and based off of company profits. After further investigation it turns out the whole franchise operates this way while abusing its franchisees they fine them based off of promises that they can't deliver and create great hostility. They state they will continue to bill us, a church, even though we are now cleaning are own facility. Our interaction with them has been most unpleasant so before you fall for their false claims of state of the art equipment, medical grade products and customer satisfaction think twice, pray and stay away from Jan Pro.

jAN PRO IS nothing but a scam. I have gained nothing but stress from these people (headoffice). I have even developed mentail illness (severe anxiety) because I feel like I am always walking on eggshells. I work so hard and i know that my services are good yet for some reason my job is not good enough. I feel like I am always threathened by them and this is no way to live. we have invested so much money into this business and that was the worst mistake becuase we have lost contracts due to stupid excuses that could have been easily resolved. Also, my husband is on the business licese and they told me they did not want anything to do with him. this is because he is more agressive with them and blunt. Also, they told me that they do not wish to speak to my husband. they have no right telling me this. he is on the license and he can talk to them if he wishes to do so. Jan pro is always looking for weak owners. once they find your soft spot they will try to bring you down and take full advantage of you. If you are aggressive then they don;t like you. Ive had them even take money from my paycheck to pay another franchise owner that took over the account due to a transfer. their reason was beucase the owners spend extra time cleaning the facility so they took it out of our hard earned money. DO NOT INVEST YOUR MONEY with them them becuase it is not an investment. BEWARE!

Wow, it's crazy how so many of us have the same exact problems with Jan Pro! I lost 2 accounts as well shortly after the accounts were paid off! With no explanation from the client, only a call from Jan Pro asking for the keys. They say you're the Franchise owner, but they are sneaky. They go behind your back and talk to your clients and if a problem arises, the client contacts them and not you so you're left blind sided! There has to be something we all can do about there scam because people are going to continue to loose money with Jan Pro' s scam!

i hate jan pro. i agree with a lot of people on here. when they want you to sign up with them they lie to you and all are nice and then once they take your money its a 360 turn...they treat you like ### and never take your side for anything. i have to agree that they have personal relationships with the customers. i believe they took one of my contracts on purpose and gave it to someone else and they didnt pay me for one month of work becuase they said i provided poor service even though i never recieved ANY complaints! ###. I dont even feel like a franshise owner to be honest just a reagular cleaner and they make you feel that way too, they put you down and treat you like dirt. I HATE THEM!

Please Do not buy a Franchise with this company of Augusta, GA. They promise you things and don't stand up to it. From a friend of mine they lost a lot of money with these people. This company is nothing but a scam and give people jobs that not worth working. The list of numbers they give you to call sometimes don't be the right numbers to other franchisee.Basicially, Jan-pro(Franchisor), is like a general contractor, who gets you accounts to clean for anything from $200.00 dollars a month to $1000.00 and up, ( alot of under bidding goes on as well)you the franchisee(self contractor)goes out and cleans the under bid account(s) for much less then you think you are getting paid, first off jan-pro charges a big percentage for royalities, insurance, management fees, etc...(trust me they don't manage nothing)

also, since you are basically a self-contractor, when you receive your check no taxes are taken out just jan-pro's cut, so that way they send you a 1099 tax form at the end of the year, which means you have to pay a sh-t load of money for taxes, while they use you as a tax write off, also jan-pro has a form of modern day slavery going on...what I mean by that is if you worked the whole month of January, you wouldn't get paid until the end of febuary, and by then you would be getting utilities cut off, and you would be behind in bills, etc...

Also, even though they market that they grow your business for you they don't once you get your accounts that you signed up for they send you out a certified letter stating that they have 'FULFILLIED' their legal obligation..even if you lose some accounts, they still won't give you more accounts to replace those accounts, even if you lost them and it wasn't your fault.

Also let's say you think you are making $5000.00 a month, your nor, because they are taking their cut out, and ' uncles sam' will take his, remember that and if you do the math on that type of income you will owe the irs more than $10, 000 in taxes, even if you have all of your business receipts... IN A NUTSHELL, ... DO NOT INVEST IN A SO-CALLED COMMERCIAL CLEANING FRANCHISE...

I worked for Jan Pro for over 2 years. It is an organized maffia or at least that is what it feels like. You as an account holder have no say in anything, and if you make a mistake, they will confiscate your account only to sell it to someone else. You have no say in, no options to rectify any problems. There are always fees they invent that you have to pay and you have rights to argue, differ because that can result in losing your account. I lost two accounts and I wasn't even allowed to have a meeting to discuss the problems! Hate Jan Pro..they will rob you blind and you work for nothing.

The New Master Owners in Georgia are Great. He started cleaning at 17 and worked his way up the ladder. Ive owned my Franchise for a year now and followed his advice and hands on training at night, Yes the Master owner helped me clean all night for as long as I needed him. I Have lost no accounts and have 4 employees and am buying my families first home this year. Just thought I would share a positive. God bless

BOSTON – Today the Massachusetts Supreme Judicial Court smacked Coverall janitorial franchise system with a huge bill for labeling its employees as franchisees.

The high court ruled that the franchisor must pay back franchise related fees, including franchise fees, promissory note payments, additional business fees, and payments for insurance.

Experts think the ruling that franchisees can be disguised employees will ripple down to other franchise systems and other states.

Coverall argued that the franchisee should only be allowed to collect fees directly related to the misclassification. Because the additional fees Pius Awuah sought were the result of his contract agreement with the franchisor, Coverall asserted that they should not apply to the damages he sought.

Coverall SJC Decision
U.S. District Court Judge William G. Young ruled (pdf) that the misclassified employees could collect wages, insurance premiums and other employment benefits, but the attorneys for the franchisees weren't satisfied. Shannon Liss-Riordan of Lichten & Liss-Riordon stated that her clients should also be paid all fees. She said, "By requiring companies to fully reimburse employees for all the fees they incurred as a result of misclassification, the court will send a message to employers that wage law violations will not be tolerated."

The judge then certified the Awuah v Coverall case to Massachusetts highest court after determining that state wage laws require employers to cover certain statutory costs of doing business, and that shifting such expenses to a misclassified worker constitutes damages incurred. Because the Supreme Judicial Court had no controlling precedence, Judge Young submitted pertinent questions to give the court the opportunity to set a precedent in defining the damages that should be available to the employees misclassified as independent contractors.

On one pertinent question addressing whether Coverall could deduct franchise fees from the employees' wages, the state's Supreme Court concluded, "No. . . the Wage Act forbids the deduction."

Prior to the decision the case had brought criticism from the franchisor community. Coverall attorney Michael D. Vhay of Boston's DLA Piper stated that broadening the damages beyond wages and benefits would produce a flood of litigation and drive franchisors from the state because they would be unable to collect fees from franchisees.

Steve Calderia, CEO of the International Franchise Association said, "On behalf of the franchise industry, we urge the court to fully take into account the unique attributes of franchising and the federal regulatory oversight of the franchise business model."

Following the court's decision, Liss-Riordan said, "Today's ruling from the SJC is a long-awaited victory for potentially thousands of cleaning workers throughout Massachusetts. The court determined that Massachusetts wage laws and public policy prohibit employers from selling jobs to employees." Liss-Riordan added that the commercial cleaning industry has been plagued by companies such as Coverall that claim to be franchisors but are really employers who make their money by profiting off of their own workers. She said, "This ruling will allow commercial cleaning to be performed in Massachusetts by legitimate employers who do not charge their workers for their jobs. The ruling will have huge ramifications on the commercial cleaning industry, as well as potentially other industries, and the ruling will likely have ripple effects in other states."

To the voice of lies, I see that you are here again. Basically the voice of lies is saying that it's ok for you to get ripped-off. What kind of people run jan-pro. Who is voice of Lies ? Voice of Lies is Just someone trying to do Damage control.

Meanwhile more people keep posting and complaining. More lawsuits keep getting filled. I just heard of another lawsuit being filled. I bet they will try and settle that out of court to, to keep it out of the records.

What I'm dealing with now, Sate of Illinois, tax time is Jan Pro had us incorporate.

I paid them a fee for that.

The State thinks I'm a big corporation, when I just clean 5 businesses.

Jan Pro deducts a percentage for fees, royalties, and yet I got a couple raises, which JanPro took their portion.

There is no capital.

I can't afford to hire help.

They got their fleet for office workers, which not lying one night after hours, I saw them with the company car at the laundromat in Justice, 79th street. I bet using personal use.

I pay for any supplies, equipment, wear and tear on my car.

Vasquez nailed it!

Looking at my fees, Jan Pro takes out, national fee, business fee, in the$100 range.

I said something few years prior and one of the office people saw this, rated me out.

Pers Ops manager in Burr Ridge Illinois confronted me but it's true everything Vasquez said!

Misclassificatiin.

We have to buy the job, the supplies and equipment.

Jan Pro can take that job and sell to another franchisee. This has happened to me 5× under sweat equity where Jan Pro keeps 100% profit for 6 months.

Before the time is up they have to pay they sell the job to someone else.

We don't own anything, any business, Jan Pro does

There's nothing to report at tax time what we paid as fees and royalties.

Is Jan Pro reporting this income.

Where I'm at they bought a fleet of company cars for their cushy office workers.

Beautiful office off of what franchisees are making.

If I’m supposed to be a franchisee, why am I paying for insurance is such a ridiculous rate just doing basic shopping for business insurance I can get a policy covering my business up to $2 million for $40 a month this company is ripping me off as well is ripping other franchisees. After all of my expenses I’m making less than minimum wage total ripoff I’m pretty sure what they quoted me the job with pay that they’re getting double the amount and taken half of my money which would put them in a win-win situation the need to stop being so greedy and spread the wealth

I work for jan- pro in Couradalene Idaho. She had me working more then eight to ten hours a day. When I told her that I can only work four hours a day. She had a fit. She told me that if she knew the she would have not made me work all those hours. I am semi-retired and now she is treating me like I am a disabled freak. When she hired me I was only doing one building, then she keep adding. Now she is saying that people like us should be dead. So if your disabled watch out people are not your friend.

I have lost contracts through Jan Pro. The latest, is Monday at 1:30 pm Jan Pro is having a walk through at Pediatrics on Demand in Oak Lawn, Ill with another franchisee.
They only started paying me on this account 2 months ago and I got the account last February 2013.
What they are doing is called :"sweat equity" where they keep all of the profits for 6 months. They pay nothing for labor.
They are now reselling this account to another franchisee.
They also 1099 me, claiming they paid me all of those profits, when in fact they deduct 40-60% of every check.
Jan Pro does not help anyone, they just resell your account to someone else

I work For a master franchise in the Jan-Pro system and have been with them for over 10 years I have seen people come and go I have also seen people that have started out with the smallest package and built their company up over the years and are billing over 200 thousand a year. The system works if you do it right and work as a team Jan-pro can not do it for you. These people are business owners not employees. I have seen people fail for different reasons. It saddens me that their are so many people out here that are downing Jan-Pro when they only know 1 side of the story when we have tried to work with people that are struggling and go out to the accounts with them and work with them and help them figure out why it is taking so long for them to do to see if their is a faster way that they can get through the account and still complete the scope of work. Their are a lot of people out here that don't want to take responsibilities for their own actions or their employees actions and don't run this as a business or don't even show up but they want to scream and holler when they lose that account. Also in the US you can put in a lawsuit for the coffee you spilled on yourself while you are in a restaurant doesn't mean you are going to get anything out of it. I have heard of all kind of lawsuits being brought against Jan-Pro but haven't seen anything yet and this has been going on for years. Jan-Pro has a set up just like McDonald's, Subway and other franchising companies and if you do the program and work with them you WILL succeed I have seen it over and over again. To each their own with this lawsuit if you can pull it off good luck but just like anything do your research and talk to them about it also. Everone makes mistakes and no company is 100% fail prof but if you put in the time to learn about WHY these people are complaining on both sides you may learn something cause I can put you in touch with people in our system who have failed miserably and was upset but when they took a look at the WHOLE picture the ended up coming back and buying another unit franchise from us. Life is not always what you expect it to be but if you take responsibilities for your actions you may just learn a valuable lesson in it all

As a franchise OWNER, we expect to get at least 50% on return which does not happen. The restaurant industry is set up totally different than janitorial. We get charged such things as admin fees for each account and don't ever use. We have to do our own books. I can go on and on about what is wrong with Jan Pro. Had I known better, I would not have bought a franchise from them. I still own my company's name. I went and purchased my own insurance. I am about to pull away from them. People leave for good reason. I personally had a family member who made 6 figures. He left because of how they do business. I had a jealous field representative try and take a contract from me and actually made me lose others. I would not have known had my contract exposed what was happening. This speech is cute but not valid.

I was a Jan-Pro Franchissee. I had moved here from another state and did not know the area needed work and bought a franchise. I have 20 years experince in this industry and have started and ran very strong successful janitorial firms. At least 3/4 of their accounts are under bid. They take out 21% of the top in fees. Then on new business they take 26% a month in comisson fees. That is a total of 47% off the top. They make a killing of the insurance without a license to sell such. They monopolize on supplies in many of the territories reselling to the franchisees with a mark up and may I note with out a resale number. They tell the consumer that we are their crews / employees. When the C-fees are almost paid they will begin to try to sell the consumer that they have someone that can do a better job for them. This clearly interfering in a business relationship and a fraudulent practice in the fact that they turn around and collect these c-fees all over again. I have letters from customers that serve as documentation of what they said and have done. The basis of the whole module is full of conflicts of interest and unfair and deceitful business practices. They totaly misrepresented and lied or I would have never invested. Everyone, needs to go to the US Department of Labor. Many of you that have been franchissees have been destroyed by the Jan Pro scam. Therefore, it has been dificult to obtain proper representation. The US Department of labor will establish many things. 1. We have been employees and not true sub contractors by every examination of the law, as a result they are actually responsible for withholding taxes and can also be fined 100% for every dollar owed. 2. We that have suffered as a result of their behaviour need to organize for a common cause and begin to build a record amongst every one you can contact in your local states, this needs to be brought to together and will easily be the foundation for a clase action lawsuit. 3. I know it is hard but stop just looking out for your own individual good and for once look at the greater good of all the people, do not settle out of court we need case law established against them. 4. The franchisee cleaning industry can be good for alot of people but there has to be some strong legal boundries and checks and balances of power instituted before it can work. Things have gone far enough that there needs to be legislation past restricting them. There needs to be a nation wide union established. There is alot of work that needs to be done but most off all to accomplish all there is a need for leadership in each individual area. Summary: Set a platform and agenda, come together for a common cause, build the record this is important to getting the attention of law makers and the justice department, bring in checks and balances (they should never be able to to recharge C-fees for any account. If they transfer an account in the name of protecting the brand name they should not be able to recolect c-fees. The union would serve as a protect against the unfair practices they constantly engage in. Franchisees dont get stupid just because they may be loading you up this month does not mean anything becasue it is a matter of time till they rotate accounts on you as well. I would love to see the franchisees walk out colectivly in a strike formate. I wonder how they would view and treat them them. HMMM! My attorneys that looked at the case have said that they believe these jokers have actually committed felonies and could go to prison. We have to bind together and fix this. There is lives being ruined, marriages being broken, childrens lives being torn apart, homes being lost, cars repoed as a result of their actions. I has to stop with no toleration. We can do it together but will accomplish little apart and on our own.

Jan-Pro Franchising Deceit and Fraud

I got ripped off by jan-pro. Like so many other people I to fell for there Deceit, Fraud and Missrepresentation. I was given accounts that pay less than minimum wage. I was also given accounts that belonged to previus people. They take out 18.7% from your paycheck. Now If you finance part of your plan they will take 26%. Many people have also told me that they take accounts for no reason. Then they would give them to the new people.They will keep charging you for that account. Now they can collect money from two diffrent people from one account. I have met people who did not get there business palns completed. After a certain amount of time you are supose to get your money back if they dont fullfil your plan but nobody ever gets there money back. I was finally sick and tired of making less than minimum wage. I tried getting my money back but they told me that if I didn't like it I could just turn in all of my accounts. I was told that I would loose all of my investment and get nothing back.
At the end of every month when i would go to pick up my paycheck. i noticed that other people were either very angry or very sad. Eventualy we all got together and we started seeking legal action. BOSTON – Today the Massachusetts Supreme Judicial Court smacked Coverall janitorial franchise system with a huge bill for labeling its employees as franchisees.

The high court ruled that the franchisor must pay back franchise related fees, including franchise fees, promissory note payments, additional business fees, and payments for insurance.

Experts think the ruling that franchisees can be disguised employees will ripple down to other franchise systems and other states.

Coverall argued that the franchisee should only be allowed to collect fees directly related to the misclassification. Because the additional fees Pius Awuah sought were the result of his contract agreement with the franchisor, Coverall asserted that they should not apply to the damages he sought.

Coverall SJC Decision
U.S. District Court Judge William G. Young ruled (pdf) that the misclassified employees could collect wages, insurance premiums and other employment benefits, but the attorneys for the franchisees weren't satisfied. Shannon Liss-Riordan of Lichten & Liss-Riordon stated that her clients should also be paid all fees. She said, "By requiring companies to fully reimburse employees for all the fees they incurred as a result of misclassification, the court will send a message to employers that wage law violations will not be tolerated."

The judge then certified the Awuah v Coverall case to Massachusetts highest court after determining that state wage laws require employers to cover certain statutory costs of doing business, and that shifting such expenses to a misclassified worker constitutes damages incurred. Because the Supreme Judicial Court had no controlling precedence, Judge Young submitted pertinent questions to give the court the opportunity to set a precedent in defining the damages that should be available to the employees misclassified as independent contractors.

On one pertinent question addressing whether Coverall could deduct franchise fees from the employees' wages, the state's Supreme Court concluded, "No. . . the Wage Act forbids the deduction."

Prior to the decision the case had brought criticism from the franchisor community. Coverall attorney Michael D. Vhay of Boston's DLA Piper stated that broadening the damages beyond wages and benefits would produce a flood of litigation and drive franchisors from the state because they would be unable to collect fees from franchisees.

Steve Calderia, CEO of the International Franchise Association said, "On behalf of the franchise industry, we urge the court to fully take into account the unique attributes of franchising and the federal regulatory oversight of the franchise business model."

Following the court's decision, Liss-Riordan said, "Today's ruling from the SJC is a long-awaited victory for potentially thousands of cleaning workers throughout Massachusetts. The court determined that Massachusetts wage laws and public policy prohibit employers from selling jobs to employees." Liss-Riordan added that the commercial cleaning industry has been plagued by companies such as Coverall that claim to be franchisors but are really employers who make their money by profiting off of their own workers. She said, "This ruling will allow commercial cleaning to be performed in Massachusetts by legitimate employers who do not charge their workers for their jobs. The ruling will have huge ramifications on the commercial cleaning industry, as well as potentially other industries, and the ruling will likely have ripple effects in other states."

Morales is demanding damages and attorneys'' fees and payment of $32, 094.05 for labor and materials for service she allegedly performed. On October 19, 2007, JPI filed a Motion for Extension of Time and has not filed any response to the Complaint.

Climaco Guzman and Cielo Guzman vs. Jan-Pro Cleaning Systems, Inc. and Carol McLennan (Case No. C. A. P96-4703, Superior Court of the State of Rhode Island, and Providence Plantations) was filed on September 4, 1996. Mr. Guzman, a JAN-PRO unit franchisee, brought this suit against Jan-Pro Cleaning Systems, Inc., a Rhode Island regional master franchisee, and Carol McLennan, who at that time was the regional master franchisee''s vice President, alleging breach of contract and fraud because of the defendants'' alleged failure to provide Mr. Guzman with the customer accounts provided for in Mr. Guzman''s Unit Franchise Agreement. The Trial Court ruled in favor of Mr. Guzman and awarded Mr. Guzman damages of $120, 00 0 and attorneys'' fees of $7, 500.

The Coverall case is still going on. Infact the Supreme court has now taken over that case and they will decide how much Coverall will have to pay for hurting all those people. You are trying to confuse people and use the same tactics that the cleaning franchisors use Deceit and Lies! The jan-pro case has only been around for a little more than 2 years so quit trying to confuse people. The coverall case has gone for a little bit longer. However as long as these fake cleaning franchisors keep ripping off people and families. They will keep getting sued. Just look at all the lawsuits coverall, jani-king, jan-pro, cleannet, stratus have!

Commercial cleaning franchisees sue

Several pending court cases, which are all seeking class-action status, challenge the business model on which some of the largest commercial cleaning franchisors have operated for decades.

Lawsuits have been filed against Jani-King International of Addison, Texas; Coverall Health-Based Cleaning System of Boca Raton, Florida; and Jan-Pro Franchising International of Alpharetta, Georgia.

That business model, developed by Jani-King’s founders in 1974 and since copied by competitors, is promoted as a low-cost business opportunity. Each franchisor sells off regions of the country to master franchisors who then sell unit franchises to individuals–mostly minorities and immigrants–who pay franchise fees of $2, 000 to $5, 000, plus “finders’ fees” for a specific amount of monthly business. At Coverall, for example, a franchisee would pay a total of $10, 750 for a franchise package that provides $1, 500 of commercial cleaning business each month. The Coverall regional franchisor then provides all the training, obtains and distributes all the cleaning contracts, sells required supplies and insurance coverage and does all the billing and collections–services those with a native language other than English might find useful.

But the lawsuits, filed recently in Massachusetts against all three companies and in Pennsylvania, Minnesota and California against Jani-King, contend that the cleaning companies misrepresent their offerings, because they do not have sufficient customers to guarantee each franchisee the amount of monthly cleaning business they purchase. Instead, the lawsuits allege, they breach their contracts by underbidding the amount of time and staffing required for each job, refusing to allow franchisees to inspect cleaning jobs or bid sheets before accepting or rejecting a job, offering geographically inconvenient jobs and unjustly taking jobs from one franchisee to re-sell them to others.

Perhaps more damaging is a second contention–that these so-called franchisees have so little control over their livelihoods, they should be re-classified as employees of the janitorial franchisors and, therefore, entitled to minimum wages, overtime pay, unemployment benefits and worker’s compensation.

Lawsuits over misrepresentation and breach of contract are nothing new. According to its 2008 FDD (Franchise Disclosure Document), Coverall has settled 26 such cases in the past 10 years, admitting no guilt, but paying former franchisees settlements of $3, 575 to $450, 000. Many of the 52 pieces of litigation listed in Jani-King’s FDD also ended in settlement payments. Commercial cleaning franchise contracts are usually written only in English (Coverall has offered a Spanish translation since 2004) and are so complex that the state of Maryland adds a warning page about potential risk factors to their FDDs, said Dale Cantone, Maryland’s assistant attorney general. The Federal Trade Commission distributes a 19-page booklet of cautions for people considering commercial cleaning franchises.

What is new is the second charge, that commercial cleaning franchisees are merely buying themselves low-paying jobs and should be treated like employees. In 2006 the Massachusetts Supreme Court ruled that a Coverall “franchisee, ” Rhina Alvarenga, was actually an employee and therefore entitled to unemployment benefits after Coverall removed her from a nursing home cleaning account. Attorneys representing Jani-King, Jan-Pro and other Coverall franchisees cited that decision in their complaints. “It’s possible that the business model under which they’ve operated could be ruled illegal, ” said one of the attorneys.

Shannon Liss-Riordan, an attorney with the Boston firm Lichten & Liss-Riordan, who has filed lawsuits against Jani-King, Jan-Pro and Coverall, said, “It’s heartbreaking to meet immigrants who have put their entire life savings into these franchises thinking they will have businesses to support themselves and their families. Instead, they are buying jobs that are terrible, that pay less than minimum wage. When they do get a check, the franchisor has taken out so many deductions, for royalties, supplies, management fees and bogus insurance policies, that they receive very little. I’ve seen pay stubs that say the franchisee owes the company money.”

The other side responds

Representatives of the janitorial franchises disagreed. Jacqueline Vlaming, Coverall’s general counsel, said, “Every franchise owner who runs it like a business can make money. Ninety-nine percent of the people who buy a Coverall franchise are committed to it.” Ron Rosenwasser, of Friedman, Rosenwasser & Goldbaum, of Boca Raton, who represents Jan-Pro, said, “We have thousands of franchisees who work hard and develop their franchise; others fail because they do not work the territory or are distracted by personal problems.” And Don Burleson, executive vice president of Jani-King, said, “We have over 12, 000 franchisees worldwide who have been operating for decades and have many success stories.”

All three top cleaning franchises claim to have thousands of unit franchisees. Jani-King and Jan-Pro, in fact, trade titles as the country’s fastest-growing franchise. But when Franchise Times made random phone calls to “active franchisees” listed in FDDs from all three systems, we found only a handful of people who said they were still happily working the franchise.

Since they operate through regional master franchisors, Coverall, Jani-King and Jan-Pro do not file FDDs that list all their unit franchisees. Their master franchisors are required to file their own FDDs, including franchisee listings, in registration states. New Venture of San Bernardino, a Jan-Pro regional franchisor in California, lists 94 franchisees in its most recent FDD.When Franchise Times called 39 of them at random, only three we reached said they were still active (two said they were making money and a third said she was “doing all right, but I’m not glad I got into this.”) Of the rest, 10 phone numbers had been disconnected or reassigned, seven phones were never answered, 11 people never returned our messages, four people spoke only Spanish and four others said they had left the franchise because they never made any money.

Out of 17 franchisees listed in Jani-King’s Los Angeles/Colton region, we reached only two that were still active. An Ohio woman listed as a current Coverall franchisee said, “I gave them $16, 000 and didn’t get squat. After two years, the most I made was $600 a month.”
Celeste Iles, of Rialto, California, said, “I paid Jan-Pro of San Bernardino $5, 000 for $1, 600 worth of work every month. Before I paid the money, I was told that I’d get accounts in the Rialto area and that I could decline jobs in cities I didn’t ask to be in. Once I started, they offered me one cleaning account in Chino, which is 25 miles away, and others 15 to 20 miles away. When I turned those down, they said the offers fulfilled their contractual obligation. They did give me a few little accounts, but I never got my maximum volume.I cleaned one building diligently for over a year. Suddenly, the person in the Jan-Pro office said my level of cleaning went down and I lost the account. When I went back to the customer, they told me they never had a problem with me. I discovered that Jan-Pro would take accounts away from one franchisee to sell them to another franchisee.”

Gerardo Vazquez, of Bloomington, California, said he, too, had purchased a franchise that was supposed to generate $1, 600 worth of business each month from the San Bernardino Jan-Pro office. “But the office would underbid each contract, and no matter how hard I worked, I never made more than $4 to $5 an hour.” After Vazquez posted his complaints on Internet blogs, he was contacted by so many other Jan-Pro franchisees, they decided to file a class-action lawsuit. He is now one of the 12 lead plaintiffs involved in Liss-Riordan’s Jan-Pro lawsuit, filed last December in federal court in Massachusetts.

Fulton Connor, Jan-Pro’s master franchisor in San Bernardino and San Jose, denied that his office underbid contracts. “Some people, like Mr. Vazquez, took too long and were not following the cleaning schedule. In general, our franchisees are happy. I’ve had owners thank me because they were able to buy homes for the first time in their lives.”

Jan-Pro CEO Richard Kissane called the lawsuits “witch hunts” and said, “We have only one lawsuit in our FDD. If we didn’t have wonderful relationships with our franchisees, we’d have lawsuits out the yin yang.”

Liss-Riordan said, “The reasons we see so few complaints from commercial cleaning franchisees is that immigrants are often nervous about exercising their rights in the U.S. legal system. They don’t know who to contact or they’re embarrassed about losing so much money.”

That may soon change. Thomas Pahl, of Foley & Mansfield in Minneapolis, who specializes in class-action cases, filed his case on January 27, 2009, on behalf of 52 Jani-King franchisees who were referred to his firm. In that case, Jani-King, represented by the Minneapolis firm of Faegre & Benson, won motions to dismiss 11 of the plaintiffs because their claims were too old and to move the action from state to federal court. But a request to dismiss the case altogether was denied.

The companies’ business model might have worked a few years ago, before all three had recruited so many franchisees, the attorneys for the plaintiffs agree. Now they’re so desperate for cleaning contracts “they’re racing each other to the bottom, making bids so low it’s not possible to do this work and make a living, ” said Liss Riordan. “If we’re successful, ” she added, “we’d like to see cleaning work done by employees who receive the benefits of employment.”

Jani-King’s Burleson predicted a different outcome. “I don’t believe there’s any merit in these lawsuits, ” he said. “There’s nothing different now. We’ve been doing the same thing for decades.”

No you didn't your just someone at corporate who comes in here trying to do damage control. I have heard many complaints from people in Charlote.

To Lying Source. I see you can't handle the truth so now you try and say its hearsay. LOL What are you going to say when hundreds of us who got riped of go into court with proof! What are you going to say then?

The accounts that I cleaned never ever asked for me to be removed. Infact they wanted me to stay but I could not because jan-pro made it imposible for a hardworking man to stay in business. jan-pro makes there money by ripping off people.

1. jan-pro tells people that they can make $100, 000 Dollars a year. They tell you that you will grow your business and be able to hire people. Then they give you accounts that pay less than minimum wage. That is Fraud!

2.They take accounts away from people for no reason other than to rip them off. that is Theft!

1. First of all jan-pro did not do what they promised they lied to people to get there money. They told me that I would make $25.00 Dollars an hour. That was a big lye. They also underbid accounts so Low that they bid them to pay Less than Minimum wage!

2. Second they comited Fraud. I have talked to many people across the country and most had there accounts stolen. The operation managers would tell the cleaner that the customer wasn't happy with there work and that they would get them another account. So they would get the cleaner to turn in the keys. Later on the cleaner finds out that the customer had no complaints and that infact the customer was very happy with the cleaners work. This is a Racket that needs to be prosecuted.

3. Third Judges have already said that the way some cleaning franchisors operate are like Ponzi Scheemes and they have also ruled a cleaner an employee and not a franchisee this acording to the Law.

Stay away from Jan-Pro Franchising International, Inc./Lynx Franchising. As a master franchiser, I lost more than a million dollars. I entered into a 15 year agreement with them in June of 2008 and when my office building burned to the ground in December of 2010 and I lost everything, they offered no help or relief. Instead they fought to get more money from me, causing me to have to leave the franchise and forfeit the huge financial investment I had made. Nine years later, my partner and I are still suffering from our association with Carole Mclennan Goodcuff, Rich Kissane and Jacques Lapointe. They were not truthful about having no failures. The very expensive insurance we were required to obtain from their "Jan-Pro Award Winning Vendor" proved to be useless. Because their bookkeeping practices are shady, our insurance claim didn't cover the majority of what we lost in the devastating fire. Their franchise model preys upon minorities. They make promises of multiple revenue streams that don't exist. Unit franchisees end up making less than minimum wage after paying all of the required royalties and fees. Because of the ridiculous requirements placed on the unit franchisees per the Jan-Pro cleaning schedules, very few people are able to measure up. This allows for the churning of accounts where clients are passed from one franchisee to another to another.

As someone who used to work for JanPro selling unit franchises I can assure you their practises are far from ethical. After speaking up multiple times I was let go for not fulfilling my job requirements.
They also turn a blind eye to sexual harassment issues. They most certainly take it vantage of their franchisees in every way imaginable.

My husband was a franchise owner for 5 years. One of Janpros customers that we services was behind on his payments, he tried to make arrangements with Janpro but manager refused. The customer canceled services. Janpro then called me and said you owe us his debt of 25k. And if you want your money, you have to collect from the customer. I called the customer, explained the issue so he agreed to settle with Janpro.
Janpro manager kept my checks, 3 months worth, kept some of my equipment and collected from the customer, total of 39k when the customer was just behind under 10k. Janpro San Antonio manager brought all his family into the business and they get all the better accounts. I lost 5 accounts in 6 months(No fault of our own) and only replaced one. I called headquarters and all they did is send my email back to the office then that's when the retaliation began.

1st amendment, well there you go again, spewing the "garbage" over and over again... Still didn't answer any questions posed. Let me try this again and more direct.
1. How many cases do you personally have filed against Jan-Pro either directly or that you are "part of"? One
2. How many lawsuits have you won? None
3. Has there been any decision by the liberal, labor loving court in MASS. that I am unaware of? No.

1st amendment, let's see how many lawsuits that you are envolved in have you won? NONE! How many will you win? NONE! In regards to your comment that these class action suits have only been going on for 2.5 years, another lie, Awah which was the original case against Coverall that Awah lost by the way, was filed in 2004... That case was ajudicated in a way that basically said "no harm, no foul" or in your terms basically there was no proof of harm... Case was dismissed and poor Awah the "poster boy" for these cases was told to pay in excess of 250K in attorneys, filing and other fee's. Awah, went out and filed for bankruptcy protection... Which is exactly what's going to happen to you...

1st amendment, now there you go again spreading what your lawyers will tell you is "heresay". What that means is that you didn't first hand or personally experience that issue. YOUR issue was you were a poor business owner, you didn't perform, your customers asked for your removal from your accounts... 1st amendment, the only one that is fraudulant between you and Jan-Pro is YOU! Why don't you admit to these nice people that you cannot personally afford $400.00 per hour attorneys, that YOU and the others associated with these friviolous lawsuits are really nothing but pawns for BIG LABOR and SEIU who are the one's paying your and the other "plantiff's" attorneys bills for the past 7 years...

I and my husband have been with Jan-Pro Charlotte for 11 years and we have no complaints. We have 14 accounts and they are all local to us so we could still be near mom in her declining years . Our head guys went out of thier way to help us out. Thumbs up for them...

What was defensive about any of my comments? What is wrong with expecting people to abide by the contracts that they sign? It is bad enough that they can't even honor verbal contracts, but at least do what you signed up for. Most people don't have what it takes to run a business. There is nothing wrong with trying, but to blame someone else for their own failure, especially someone who had nothing to do with their complaints, is foolish. I accept my errors and learn from them.

Wow! Voice of Reason your comments are quite defensive and unfair to many or all who are posting. Who would listen to your reasoning when you use statements such as - due diligence, do the homework, put the sweat in to be successful and you get what you deserve"(really?! that last one was the cherry on top of the cake). What about those of us who read and understood the handbooks - franchisee and franchisor obligation, and are still getting crap handed to us with a side of deal with it. I've brought in business whereas JanPro collected their royalties without having to sweat - only to have our Operation Mngr and/or Inspection Spcl try to rework the contract (adding flr work or cutting contract amount by 30-40%!) or coming in as supervisor with white glove. This only made JanPro look bad and MY contact wanting only to deal with me or my partner or our employees. Among other complaints that mimick those on this site, I've picked up a check from my franchisor on payday between 9-10am and traveled less than a mile to my bank (theirs too) only to have them tell me this acct does not have the funds to cover the entire check amount. Do I report them, No!, not that time. I went back to the office and work out a "fix" - so now for the last 8mos, I get not one check but two and I call before I deposit the second for safety sake. Why? you ask, because even this "fix" failed several times and when I did call JP Intl, they handed me policy and do not even consider helping - no reprimand -Nothing. I have over 25 Bldgs. so imagine my overhead. Some if not all of these franchisees have legitimate issues and your statements throughout this site does little to help in the process of getting info and making a good decision to purchase or not. People, I for one would do it all again but with 8yrs exp with how my office works, I'd pick another office to work out of. Btw, I came in already established (owner of local cleaning outfit for 5yrs but wanted to branch out beyond local cleaning status and get support with... invoicing and collecting payments, representation of an well known comp., admin and legal support etc. Wtih two more years to go in our contract agreement, I am committed to seeing it to the end. But will I renew? I think not. Will I lose MY contacts? I think not. I have an 8yr paper trail to help the owner see Reason and wishing us well. I've learned alot from JP but I have also paid my dues in full so fullfilling my contract with JP will be a breeze.

Jan-Pro Franchising Misleading and Fraudulent activity

There are a lot of complaints about Jan-Pro. If you've read any other complaints it indicates that they give you contracts to clean buildings, that are not even worth the pay; you're basically working for minimum wage and working triple to double the hours that you would if you just got a normal job. It's all true. And trust me, you won't feel like a business owner, they'll make you feel like you're a worthless worker.

They will offer you cleaning contracts but they will be so ridiculas, that you have to turn them down. If you're lucky enough to get a cleaning contract that's worth your time, it'll only a couple of years, because Jan-Pro collect royalties, not profits, it is in their economic interest to sell more franchises for a large fee and give your contract away. Nearing your aniverseray Jan-Pro will go out of their way to cause you to lose your contract. If that doesn't work than they'll entice the owner of the building by lowering their price and giving it to a new frachisee. Once your not cleaning any buldings for them anymore, then they will avoid all contacts with you. The receptionist will pick up your phone calls but will indicate that the person you are requesting is away and a international conferance and won't diclose to you when they'll be back. If you call back, in a couple a weeks...same story.

Now, if you know about the small business frachise act (SBFA) and you browse through the contract you signed with Jan-Pro, it's misleading and fraudulent, violating several things indicated in the SBFA

Jan-Pro isn't worth your money or time. You're better off investing your money somewhere else, especially if you're looking to invest long term.

Stay away from Jan-Pro Franchising International, Inc./Lynx Franchising. As a master franchiser, I lost more than a million dollars. I entered into a 15 year agreement with them in June of 2008 and when my office building burned to the ground in December of 2010 and I lost everything, they offered no help or relief. Instead they fought to get more money from me, causing me to have to leave the franchise and forfeit the huge financial investment I had made. Nine years later, my partner and I are still suffering from our association with Carole Mclennan Goodcuff, Rich Kissane and Jacques Lapointe. They were not truthful about having no failures. The very expensive insurance we were required to obtain from their "Jan-Pro Award Winning Vendor" proved to be useless. Because their bookkeeping practices are shady, our insurance claim didn't cover the majority of what we lost in the devastating fire. Their franchise model preys upon minorities. They make promises of multiple revenue streams that don't exist. Unit franchisees end up making less than minimum wage after paying all of the required royalties and fees. Because of the ridiculous requirements placed on the unit franchisees per the Jan-Pro cleaning schedules, very few people are able to measure up. This allows for the churning of accounts where clients are passed from one franchisee to another to another.

I AM A FRANCHISE OWNER HERE IN COLORADO SPRINGS CO. I AHVE 1 EMPLOYEE AND WE HAVE TO CLEAN 7 DIFFERENT PLACES IN 1 WEEK MOST OF THEM ARE TWICE PER WEEK AND JAN PRO ALWAYS KEEPS 20% OF ALL MY CONTRACTS AND WHAT EVER I HAVE LEFT I HAVE TO PAY MY EMPLOYEE . I HAVE RECEIVED COMPLAINTS OF MY EMPLOYEE THAT WHAT I AM PAYING HER IS TOO LITTLE BUT I CANT AFFORD TO PAY HER MORE I JUST DONT WANT HER TO QUIT I AM AN ELDERLY PERSON AND SHE IS THE ONLY 1 THAT HELPS ME CLEAN ALL THE BUILDINGS FOR EXAMPLE OUT OF ALL THE 7 BUILDINGS I ONLY GET PAID $1123 PERO MONTH AND OUT OF THAT JAN PRO STILL TAKES 20 % AND I HAVE TO BUY MY OWN SUPPLIES AND PAY MY EMPLOYEE I PAY HER $600 PER MONTH I KNOW THAT IS NOT EVEN THE MINIMUM BUT I WOULD LIKE JAN PRO TO PAY ME MORE SO THAT I CAN PAY MY EMPLOYEE BEFORE SHE QUITS

This person is just right.
They did the exact same thing to me in San Diego Area.
Right after my second anniversary date, they took my place from one day to another, saying just excusses of bad cleaning, but they were able to SELL ME another place.
They already had a new franchisee to buy the place.
I had to pay them over $11.000 thousand dollars for that place, and after two years of payinG 18.7% commision each month, wich equals two months of service per year, they just get another $11.000 thousand dollars from a new client and they will do the same thing after two years.
pLUS WHEN THEY SEND YOUR TAX FORM, THEY DON'T DEDUCT THAT 18.7% FROM THE FORM.
And it is true they tell you, that you are the business owner, but they treat you like you are a maid.
You will be lucky if you get along with Paul Mascarenas, the operations manager, who can sell you vaccums and equipment under the table for some cash! He is stilling his boss!

Jan-Pro Franchising Never got any accounts and after awhile they forgot who i was to them

I joined this company back in 2005. In 2006 I believe they called me only once and offered something that i couldn't possibly take. Now after few years without a single call offering me anything, they forgot who i was. I am an absolute victim of their negligence. In the beginning they will tell you very nice stories, How easy this would be and good investment of your money and then you sign with them that is it. The end of story. You get nothing. To this day i wonder if there is any legal action i can take against them. If anybody who stepped in my shoes before and got out of it or if there is anything that i could do to at least prevent others do the same mistake, let me know!

They say on the newspaper (miami herald) since I live in so. fla;you could get started with under 1000.00 but then what?
You have to pay for the accounts yourself?
Somebody pls ilustrate me on this as i'm totally in the dark here.

Wow. I have always wanted to own a cleaning business but I never thought I'd have to be cleaning the toilets myself. If you can't afford to pay employee's, then it doesn't sound like a good opportunity to me.

My husband and I bought into the franchise about three years ago and we are very unhappy. somehow our district office in des plaines, il. changed hands with new owners. now, we are not allowed to use jan-pro's name on anything and told all the franchisee owners that they have to close their business accounts and get a new one. (this was mandatory or they said they wouldn't pay us) plus, we are not allowed to use the word cleaning no where on the title of our business account. this sounds illegal... like their trying to avoid something dealing with taxes. how come we are no longer able to wear or use the brand name for our business checking;but yet is still being charged royalty fees?

Don't buy anything from them.
After you pay your franchise they will take your place to sell it to another person.
They keep accepting new investor, but they have no places to give them so they take current client's places to sell it to new clients.
Plus if you owe any financed amount, you have to stikll pay them and they will be getting money from two different persons in one account.

Thank you for sharing your experiences because I would be a victim jon-pro franchising. They called me that I could be franchsee for 2500 CAD training and material costs...Anyways, before deal any scam business google it..
