COMPLIANCE CONCERN:
I work in the compliance industry so felt it necessary to inform you of how Subaru of Fort Myers, FL has handled the situation of the cancellation of theft contract through Truwarranty. I bought a Subaru from them on December 31st and declined any extra service contract or warranties at the onset EXCEPT for gap insurance. However, the finance person tacked it back on during the closing transaction. When discovered, I went back to the dealership on January 1st (day after I bought the car) and cancelled the 3 warranties/contracts - theft was one of those contracts. About a month or so later, I was told by Subaru the theft contract was a non-cancellable contract but that is inaccurate per Truwarranty, the contract, and Florida law. Therefore, I cancelled AGAIN on February 21, 2023. Truwarranty has been extremely helpful in this process and stated that she processed a portion of the money back to Subaru to pay us back for cancelling the contract. That was back in March. We have emailed and called them numerous times and NO ONE will call back or respond via email. By Florida Law, they are required to cancel and process the refund if done within 60 days. They are refusing to do so and Truwarranty already paid them money back to do so. With me canceling the contract and not paying me back per the law means they are stealing money from customers who know have a canceled contract and no refund. That is fraudulent behavior. The next step is to retain a lawyer, but wanted you to be aware of the situation since you are doing business with them.
