Business Response After completing an in-depth review of the account, it was determined that this was not a voluntary repossession. A voluntary repossession would be bringing the vehicle to a branch location or provide an address where the auto can be found and that was not given in this instance. Mrs *** was over 70 days delinquent and was advised of the amount necessary to bring her loan current, she instructed Pen Air to come get the vehicle. We looked for the auto for 13 days, until it was located at a different address than was on file. Upon retrieval of the vehicle it was determined that the auto was vandalized. Upon submission to the auto auction for sale Pen Air gave authorization for a diagnostic to determine the extent and expense of the repairs. Pen Air received an email from the auto auction indicating the expense to repair the engine was $3,118.00 as well as all other damage to the auto totaling $1,529.00. The auto was sold at auction on April 18, 2018 for $4,085.00 as outlined in the explanation of deficiency The Credit Report is reporting the charge off amount of $15,021.00. Balance of loan at repossession $20,594.17 Sold at Auction -$4,085.00 Credit & Rebates -$1,488.03 Total $15,021.14 (Charged off Amount on the Credit Report) This loan has not been sold to a 3rd party collector nor does the credit report indicate this loan has been referred or sold to a 3rd party collection agency. Based on the calculation of fees listed above and instructions listed in the Credit Reporting Guide, it has been determined that Pen Air is able to charge interest and fees on a charged off loan and the loan amount is reporting correctly to the Credit Bureau. There is no additional benefit from the government or any tax authority for Pen Air Federal Credit Union on this loan. Pen Air always encourages our members to make payment arrangements on any charged off debt and we are only attempting to collect the amount due on the loan that was charged off. Voluntary Repossession It was voluntary however even according to your own words the vehicle was inoperable due to VANDALISM! So a African American lady from YOUR company arranged a towing company to pick it up... my former address at the time was Baypine villas Drive.. you guys (to company) only knew where To help get the vehicle was because I VOLUNTARILY gave him the new address because I COULD NOT DRIVE THE CAR MYSELF. Late payments; After I explained to PEN Air that my vehicle was vandalized I explained to them that I filed an online police report and I also informed my insurance company, *** Without even looking at the vehicles *** only paid me a little over $600. At the time I did not have money to repair the engine and pen air wouldn't give me a loan for car repairs.. let's call a spade a spade. I'm an African American woman.. so of course you guys wouldn't help further. The balance of the loan was just under 15,000 during the voluntary repossession. I called the credit union after the car was auctioned and asked how much and why would YOUR customer SERVICE rep tell me $12,000? Credit report Yes, now since my complaint my credit report now says Pen Air instead of a third party collector, however you are also trying to charge me over $17,0000 an amount that keeps growing on a charge off, Resolve It took you way too long to respond to this complaint, I believe it was in effort to conjure up this false narrative. Great job but not true. You're a corporation of course you can write and type any document you please to fit your false narrative. My resolve remains the same. I owe a little over $3,000 I'd like to pay it and move on. It is my prayer that whoever is manufacturing this lie someday received the same treatment and experience the same helplessness that I feel.
