I need the original agreement that BOA sent out for their Gold option Fixed rate loan. I need this agreement for my lawyer to look over. I feel like I've been robbed. I took this loan out as a fixed rate loan for a period of 5 years to payoff. BOA sent me a letter stating that the account was changed to a high interest rate revolving credit account. At this rate I will never be able to pay them off. Can someone please send me the original agreement? Send it to me at [protected]@charter.net.

Thanks,
Steve

My husband lost his job in the area we live in May of 2009. He had to travel 400 miles away from home in order for us to be able to make our monthly mortgage payment. This meant his two daughters got to see him two weekends out of the month for over 1.5 years. We started to try to apply for the HAMP program in May of 2010. We were strung along and waited for an answer for 4 months. We then decided the best option for us would be a HAFA short sale since there was still no work in our area and our home was worth about 50% of what we owed on it. We are in the state of Nevada which has been hit hardest by both unemployment and the housing crisis. We applied twice but were declined due to the fact that we were still current on our mortgage. So we had to stop paying. Then in November 19, 2010 my husband was laid off from his job completely. We lost 75% of our income and could not pay our mortgage. We re-applied for the HAFA program showing that he had lost his job and was on unemployment. We have waited twelve weeks to hear back from Bank of America to see if we could qualify or not. Today I finally call and am told they have declined us due to the fact that our income is too high and that our monthly mortgage payment is only 28%. That is completely false and obviously the "underwriters" did not look at the file at all or review the 39 pages of information I sent, which included the letter or layoff, the weekly unemployment amount and the fact that my husband has been laid off of work for three months. I have been told there is no direct contact number for the underwriting department and that they are a back office only so I have no one to call and no one to help. I can try to reapply and wait another 12 weeks, during which time I am sure that we will go into foreclosure. We have repeatedly tried to do the right thing and have been screwed over and over by Bank of America! It is extremely obvious to my that they do not want to help borrowers and would rather we just go into foreclosure anyway.

Due to fininancial hardship i had filed modification a year ago. with many attempts and phone calls i did not get any help but instead they have increase my monthy payment instead of reducing.

the monthly increase are include property tax and insurance. I had informed the bank that i will paid the property tax direct to L.A County tax and I also purchased home insurance. They have send me letters said that my account is default but I paid my monthly mortage payment on time. ( had never missed a payment ) i have also paid the 1st installment of property tax this NOV/2010 which the bank claims that had paid as well. I called the bank and a representative told me to call LA county tax for a refund, but county tax informed me that they had been credited to the bank. why would i have to pay back the bank when they already rec'd refund from tax collector.

I was scammed this week by someone who knows that the banks do not do a complete and thorough check of deposited checks so that the customer gets screwed. What a joke that the banks do not wait an additional 48 hours or so to determine that the check is valid before they deposit into my account for use. Yes, I was nieve but if all banks did their due dilligence it would stop this fraud in its tracks and put these criminals out of business at least as far as this scam goes. Do we all need this money so soon as to create this fraudulent atmosphere for criminals to thrive.

This bank let me get around $800 in the hole before shutting things off & telling me. I'm sick/disabled & at the time didn't even live on a very fixed income. If I wouldn't have gotten a tax check about that time I suppose I'd be in jail?

I went to the bank in person to fix this mess. While I was there I wanted to pay off my car loan too. I fixed the mess. I paid off the car loan. And I left.

Next thing ya know I get a bill for $300 (car payment). They claimed my last car payment bounced & they didn't catch it while I was standing there right in front of them trying to pay everything off so I still owe $300.

I called their customer service & a lady said I was right...it was their mistake & I shouldn't have to pay for it. She promised to drop it off & gave me a confirmation #. But I kept getting this bill. So I called back & regardless what their customer service lady told me...per management...their error or not I still had to pay another $300.

They did send me a lien release before they realized I still owed $300. So I've got a free/clear title. But I also have a $300 bill still sitting on my credit report. I haven't used them since & I wouldn't recommend them to my worst enemy.

I HAD been dealing with BOA for years without problems, bills paid on time or paid off early. I have taken loans out with them and paid them off over a year in advance. I took out a loan with them which was supposed to be 9.99%, instead, (this latest loan) was being charged 22%, quite a difference, agree? I called BOA and asked them if they had made a mistake and they told me, NO, that was what the rate was that was quoted to me, like anyone with a sound mind would take a loan out at that robbery price. Now I am being harrassed by I.C. Systems 8-10 times daily even though I am working with a debt solution company so as not to pay these thieving prices. It is getting very tiresome. I had a heart attack and a defibrillator implanted so, I get upset very easily. I have checked on both of these so called companies and found them both to have very unsrupulous business practices. BOA fits bank of america perfectly and I.C. systems is for, I SEE you have the same ethics.

They are not truthful in their dealings with the modification program. They are ruthless. My story is the same with anyone dealing with the modification process. The difference is, they claim that we owe twenty-three thousand. Prior to us falling behind in June of 2009, we were only a month behind with an ARM of 9.75%. Before they would even start processing the paper works we needed to come up with at least five thousand dollars worth, which we had "scrapped up" that was in oct 2009. In the meantime we were to pay 2362.00 (trial) for a few months or however long it took them to approve us. FED EX packets x 4 and FAXES x 3 (86-136 pages worth) claimed that they never received. March of 2010, we received a 1 page leter, indication that we failed to qualify for the program due to our failure to provide them with the necessary documents. They claim that they have several "Rebecca Higgenbathuam" which one? they ask. We obtained RALaw group and is currently trying to modifiy our loan. They accelrated our mortgage. I wonder what ever happened to our initial payment and trial payment posted to? Anyone has heard of RESOLVE? apparently they were retained by BOA, according to there letter to us just date 7-22-10, that they are attempting to collect our entire loan amount.

I've been a customer of Bank of America for almost 2 years, for the most part I've been happy with the service especially when dealing with the University Place branch. That branch has been the only reasons I've stayed with your bank facility. Here my complaint, your bank charged my account $150.00 (5 payments of $30.00) I believe for insufficient funds. This is not the first time this has happen and I shouldn't ignored it then. My mistake was to use Pay Bill to pay my bill on line and using the automatic account indicated in the pay bill section, however, unknowing I use that account number indicated on the Pay Bill section, I had money in my other account but your bank choose to charge me $30.00 for each of the bills I paid online.

I had used my debit card on 6/18/09 for some purchase and also made a cash withdrawl. I had a direct deposit go in 6/19/09. Although none of my purchases posted until 6/19/09 I was charged 5 overdraft fees, and the account never went negative.

Is this illegal to just garnish my bank account for the money owed?
I need some advise or some help on this matter!
I missed ONE payment and they are holding double the amount in garnishment from my daily bank.
Took all I had in there plus legal fees!
Is this legal?

I applied for a home modification loan April and after the mounds of paperwork I was approved and stated my trial payments may 2011 and told after three it would be done. That was a lie and I made trial payments until March 2012 and a notary came to the house and closes on the modification loan and told it was done and that was a lie. Every month I call in to make a trial payment they say we have to cross every T and dot every I. I told them in 6 months that should of been done. They ruin my husbands credit every month. I don't think I will long enough to see this over with. This is what I did . I sent a complaint to the Attorney Office of my state and I called the White house and they told me to contact Consumer finance. Gov and make a complaint on line and I called them and they told me they push these loans through. Their telephone number is [protected]. I got a call today from BOA and the Attorney Generals office in my state has told them they need to do something in the next 30 days so they gave me a special agent to take my case. I am 72 years old and I have spent hours and hours on this. I am normally a strong woman but it's no fun bucking heads with BOA. I hope this helps somebody,
