ON DECEMBER 3, 2011 WE PURCHASED A 2001 INFINITY QX4 VIN # JNRDRO9Y41W214326 FROM WHITTINGTON MOTORSPORTS LLC. WE ASKED IF THE VEHICLE HAS A CLEAN CAR FAX AND WAS ACCIDENT FREE DALE WHITTINGTON SAID IT WAS, AND PROVIDED US WITH A DOCTORED REPORT STATIN G THE VEHICLE WAS FINE. ON JUNE 11, 2012 WE RAN A CARFAX REPORT DISCOVERED THAT THIS VEHICLE WAS IN AN ACCIDENT, AND HAD A ROLLED BACK ODOMETER. WHEN WE ASKED THE DEALER ABOUT IT HE SAID THEY VEHICLE DID NOT HAVE A ROLLED BACK ODOMETER AND HE WOULD NOT BE WILLING TO DO ANYTHING ABOUT IT. MY NEXT CALL TO HIM ON JUNE 12, 2012 HE STATED THAT CAR FAX HAD MADE SEVERAL INACCURATE ENTRYS AND HE WOULD REACH OUT TO CAR FAX AND RESOLVE THEASE ISSUES.

JUNE 25 I RECIEVED NOTICE THAT CAR FAX WILL NOT DELETE THE ENTRYS FROM THE REPORT. PRIOR TO THAT NOTICE WE WERE IN TALKS OF A COLORATERAL EXCHANGE OR TRADING THE VEHICLE IN BUT, HE WOULD ONLY GIVE US $5, 000 FOR IT. SINCE WE FEEL WE WERE SOLD THIS VEHICLE UNDER FRAUDULENT TERMS, WE FEEL WE SHOULD NOT HAVE TO LOOSE $6, 000 ! AT THIS POINT WE WOULD JUST LIKE OUR MONEY BACK AND GO PURCHASE A VEHICLE FROM ANOTHER DEALER. WE HAVE MADE REPEATED CALLS TO THIS DEALERSHIP WITH NO RESOLVE. ALL THEY DO IS PUT US OFF. WE HAVE A COMMUNICATION LOG OF ALL THE CALLS THAT WERE MADE TO THIS DEALER. WE HAVE ALSO FILED A CRIMINAL INVESTIGATION COMPLAINT WITH THE NEW MEXICO ATTORNEY GENERAL, AND A CONSUMER COMPLAINT WITH THE NEW MEXICO ATTORNEY GENERAL. WE HAVE ALSO REPORTED THIS DEALER TO THE BBB. WE HAVE PROOF OFF ALL OF THIS! IF YOU WOULD LIKE TO SEE PLEASE EMAIL ME.

WHITTINGTON MOTOR SPORTS GAVE US A FULL REFUND! AND PAID THE CAR OFF. THANK YOU SO MUCH! THIS IS A VERY RESPONSIBLE DEALER

I totally on your side about this. a similar event happened to me. I purchased a 2005 Chrysler 300 from Whittington motors in Albuquerque NM. I was given a CAR FAX that showed the vehicle was clean! After purchasing the vehicle we signed an agreement that 2 weeks later i would bring the vehicle back in to the Service Dept so they can change somethings I requested on the vehicle. At that time I was given a notice that I needed to sign off on that showed the vehicle was in an accident and had fram damage. I asked for them to let me take the vehicle to my mechanic to look at before my 15 days were up. (15 day Warranty) He did give me one more day towards this and the vehicle actually checked out to be okay.
2 weeks ago I was involved in an Accident and the car was totalled. I did have my auto insurance but I also paid Dale Whittington extra for GAP Insurance. Now that we filled the report for the Gap Insurance to kick in, Guess What! We paid Dale Whittington for the GAP Insurance but he never paid it to the company. Therefore I do not have the GAP Insurance I thought I had and paid for! We tried to contact Whittington and guess what, He is out of buisness! He went Bankrupt. So anyone have any ideas of what I can do now?
