ORION AT ROSWELL VILLAGE Unprofessionalism

After I moved out last year on June 2010 from the Orion Roswell Village complex in Roswell, Georgia 30075, I had no bad experiences other than dealing with the unprofessional, rude and never available property manager named Monica Francis.
On March 2011, I checked my credit report as I do every year and to my surprise, there was a collection on it from Hunter Warfield, INC / Orion at Roswell Village. I immediately contact the leasing office to inquire about this, since no one had previously contact me by mail or phone to advice in this case that I owe money from the complex.
I was informed that the charges where for four stains in the carpet, 1 missing key, a dirty bath tub and damage paint on the ceiling above the fire place. I explained to the person helping me on the phone (Connie) that the ceiling had collapse after I complaint several times to the leasing office manager Monica Francis that the rain was filtering from the roof to my apartment ceiling.
I also told Connie that the collapsed ceiling had damaged my leather sofa, information that Monica Francis already knew by a letter and pictures hand delivered to her, but noting was done and that the key was provided three days after I turned in the apartment to a Larian Hunter. I also mentioned that I have the receipts from the cleaning crew that cleaned the empty apartment and rug before the apartment was returned back to them as I have previously done in the past.
I also commented to Connie that when the apartment was returned, I asked the leasing agent at the time for the apartment exit walk-through just to make sure that no surprises would surface after I moved out. I was told that they did not had personnel available at the time and that they would do the walk-through with in the week and if I was not contacted, everything was okay and that anyways all rent and fees were paid for and up to date.
Unfortunately sometimes life is unfair, Monica Francis don’t work for that property any more and making an appointment to go and explain my situation to the new manager would cost me time and more money. So, I have decided to pay the collection agency the $248.00 that the Orion at Roswell Village say I owe them and safe my self from having a bad time talking possibly to people that can’t do anything about it.
In exchange I am writing my version of what had happened to make my incident public. I also would like to make public that Monica Francis was the most undesirable person to deal with as per my personal experience as well as also mentioned by other leasing agents in the past that requested a transfer or had just resign because of her.
Taking the word of the leasing agent cost me $248.00, so please people, it is better to have everything in writing. For me, this was a lesson learned! I would also like to think that this incident happened due to the unprofessionalism of Monica Francis and not as a personal issue she might have had with me due to the several complaints I had about her poor qualified service as a complex manager.

Here is a website link that states the FACTS of signing or cosigning an apartment lease and the ramifications if you don't fulfill the terms agreed upon. These are standard in nearly EVERY apartment lease you LEGALLY sign or cosign for.

To Carlos:

I am sorry to hear about your bad experience with Orion and glad it was just $248 and not more. I have never said apt complexes, collection agencies or debt collectors are always right or ethical. There are always a few that spoil the whole industry but for the most part there are hard working Americans who do an honest days work in those types of profession.

I don't know this Monica lady but I can assure you if what you say is true, sooner or later their lack of ethics will be exposed. What I really am impressed is the way you took responsibility and admitting you should have had everything in writing before leaving. So many people on these message boards make excuses that they were verbally told this or that and then complain when they get a bill. Like I always say if you don't have it in writing it never happened.

You did the right thing by reporting your apt issues with management and also by keeping your receipts for the cleaning but in the future you might want to make sure that not only do you report the problem to the apt manager but to their corporate headquarters as well. If you get no response or the issues weren't resolved then your next course of action would be tenant/landlord court in your city. You file for a hearing in small claims court where a judge will hear both sides (WITHOUT ANY LAWYERS INVOLVED) and if you are deemed to be in the right the courts will hold your rent in escrow until the apt complex fixes the problems to your satisfaction. This way your complaint is legally documented and there is no dispute as to who is breaching the lease contract you signed.

Also another tip I suggest to everyone who is renting when it comes to moving out, the lease is specific as to the procedures to follow. NEVER trust the word of an apt manager that they will do the walk thru themselves and if nothing is found to be wrong you won't be charged. THAT IS A LIE! There is always something they will find wrong and charge you for it. It happened to me years ago.

If the apt manager promises you to do a walk thru but never does or simply refuses to do one then proceed writing them and their corporate headquarters a NOTARIZED, CERTIFIED LETTER BEFORE leaving stating that you have made an effort to make an appt for the inspection but it has been denied. Also have a witness with you at the leasing office when you speak to the manager and make reference to it in your letter.

Make sure to point out the dates and times you are available again to do the inspection before vacating. Close it out by stating that you have given them the multiple options for doing the walk through with you but if they don't perform one before vacating the premises then any charges they supposedly incurr are invalid and you will not be responsible for their lack of due diligence.

This way you are protected because the certified letter (ask for a return signature from the post office upon delivery) you sent them is a legal document showing the manager neglected to follow procedures per the lease.

Again sorry to hear about your bad experience and I'm very glad to hear it's over with now and it didn't get any worse. You've admitted fault on both sides and that's why I give you credit for standing up and taking responsibility for your actions.

ORION AT ROSWELL VILLAGE VERY POOR CUSTOMER AND UNPROFESSIONAL APTITUD

I spent 10 years living on the complex ORION ROSWELL VILLGE ON ROSWELL GA, now after several mistake, errors and un-professional customer service we decided to moved out .I found out i had a debt to this apartments community and sent my to this AWFUL AND UN-ETHICAL BUSSINES hunter warfield for $ 329.05. this debt was for the carpet, that amount was paid immediately in full on 07/13/10 and the due day was 07/20/10, after two months they sent me to colletion without check verification.They destroid my credit record.When i called the hunter w there where so rude and very poor customer service skills. i called the apartments and said that was no debt, amount paid on full on 07/15/2010 cero balance.employee name Lisa James, Hannah, Julianne and the manager Paul Washington need customer service trainnig to do better job. I know alot of people living on this apartments and making complaints without answers.Also the manager on this apartment act whitout knowledge on the manager position and un -professional manner her name Monica and couple employee too, names Stephanie, Colleen.So we need to take action of this situations and report to right agency.Why we need to support this situations ? this situations are un-acceptable, we need to sue this tape of bussines, we need respect.please call me to find out and help me with this situation.SO PLEASE DON'T VISIT ORION ROSWELL VILLAGE ON ROSWELL GA THEY HAVE VERY POOR CUSTOMER SERVICE, THEY SEND YOU TO THE COLLECTION AGENCY WITHOUT VERIFICATION ALSO THEY HAVE ALOT OF COMPLAINTS.

Mr. Martinez:

I agree. Businesses need to understand what true customer service is about BUT it doesn't apply to debtors. A debtor is NOT a customer and that's where people seemed to get confused.

Now I am not saying collection agencies have a right to treat you like garbage because they should ALWAYS be professional but attitude goes both ways. The debtor has to take some responsibility for acting foolish which happens most often than not.

I have owed money to plenty of former companies I did business with due to either hard times or lack of opportunities to make more money. When it comes to being a debtor it's the temptation of taking the easy way out always that is a factor. If they don't get their way all of the sudden they're running to the FTC, Attorney General or BBB making false statements and wasting tax payer money on investigations.

Believe me I understand there are debt collectors and collection agencies out there that should be shut down for their illegal tactics but you can't lump all of them in the same boat. There are some reputable ones. Everyone makes mistakes but it's the way you handle yourself that makes the difference. Remember there are two sides to every story.
