These fools have been calling me like clockwork. They are accusing me of writing bad checks and not paying a company called CASH NET. I've asked them for their physical address so I can give their information to my attorney. When asked for this information, I am immediately yelled at and called names. They state by law that they do not have to provide me...

DM & Associates fraudulent practices

This company keeps calling me about some bill my sister allegedly owes. They will not stop calling me, even though I have asked them to stop calling many times. I have advised them that I have no contact with my sister and that she does not reside in my household, but still the calls keep coming. This is bordering on harassment, and I am considering legal action. When I called them again today, I had to virtually threaten the people I spoke with just to get the name of their firm. I intend to file complaints with as many agencies as I possibly can about their rude, aggressive, and fraudulent practices.

I just received a call from someone claiming to be a courier who wanted to know when he could come by my job or home with an sheriff and have me sign a subpeona/summons. He left a number with a case number for me to call if I wanted to settle out of court. I humored him by calling, I'm sure. I know that my county courts didn't issue anything, because it wouldn't be a courier bringing anything for me to sign; any paperwork for court. The fake courier couldn't say he was Officer so&so, because it's against the law. When I asked the caller what was his name and the courier company's name, he hung up. When I called the number he gave me, I asked the operator what was the name of this company I was calling and he gave me some fake name of a company (Pine Recovery & Asso.). I know it was fake cause I checked before he transferred me to whom I needed to speak to. Then Mr. Osbey answered. What a coincidence! DM & Associates

Below is a template of a Cease and Desist letter you can use to get rid of these fools. It is important to send it certified and registered and the calls should stop. If they don't, you have the legal right to sue them under the Fair Debt Collection Act. Save or get your phone records, and, record their calls - (inform them at the beginning of each call that you are recording them). Some states have laws that require this notice to be given.

Re: Telephone Number or Account Number or Reference Number...

To Whom It May Concern:

This will serve as your legal notice under provisions of federal law, the Fair Debt Collection Practices Act (FDCPA), to cease all communication with me in regard to the phone number referenced above. If you fail to heed this notice, I will file a formal complaint against you with the Federal Trade Commission who is responsible for enforcement, the States Attorney General office and/or the American Collectors Association.

We have decided that we do not desire to work with a collection agency under any circumstances. We will contact the original creditor to resolve this matter directly, as circumstances warrant.

You are also notified that should any adverse information be placed against my credit reports as a result of this notice that appropriate actions will be taken. Give this very important matter the attention it deserves.

Sincerely,
