Complaint #: 868923

Dear igal:

Thank you for contacting the ohio attorney general’s office.

We have been corresponding with milestone auction regarding your complaint. A copy of their response is enclosed. According to their letter, unfortunately, the business has not agreed to resolve your complaint.

Our informal dispute resolution process is voluntary and involves compromise by both sides. Despite our best efforts, a favorable resolution cannot always be reached through our office. We recognize this is not the resolution you wanted. However, the information that you have provided will be retained in our complaint system and may be used to help us identify patterns of bad business practices.

If you wish to pursue this matter further, small claims court may be an option if the amount involved is under $3, 000. If over $3, 000, you may wish to consult with a private attorney to discuss your options.

We regret we cannot be of further assistance in this matter. Please feel free to contact us in the future should you have any other concerns.

Very respectfully yours,

Dear ms. Mehta,
My name is eric, i have been handling all of the insurance claims initiated by milestone auctions. When i had contacted mr. Maoz, he was instantly abrasive about the situation. When i attempted to explain how the auction industry differs from the retail industry, he was very quick to interrupt. The fact remains true that once we receive payment from a buyer, it is dispersed among the consignors and therefore we are not just holding on to the money as if it were us that sold it on our own behalf as we do not purchase items to add a mark up for retail sale. So that was not a lie.

Now, while i am not trying to discount the possibility that the packaging could have been the issue, it seems a bit odd that only 1 of the 14 items in that package was damaged. After i initiate a claim through ups, depending on the total of the item, it is up to ups to determine how to go about their investigation of the claim. In this case, ups decided to attempt an investigation of the original packaging for said item(S). After keeping track of the only open claim that we had for a couple weeks, i called ups about the status of that claim. They told me that it had been denied because the receiver had not retained the original packaging. They were unable to determine the exact cause of damage for that item and therefore denied the claim. After the one attempt i had made of contacting mr. Maoz via telephone, i was not inclined to contact him again. The ups website is great for checking that status of a package in transit as well as status of insurance claims. With a bit of diligence on his part, he could have found that out with just the tracking number, shipper or receiver.

At this point, i'm not sure what more info i can provide about this particular case other then what we have provided. If you have any further questions regarding this matter, feel free to contact me at our shop.
Thanks,
Eric

Dear miss mehth,
Thank you for attention

Before telling you the event of this case from the beginning, there is now an absolute fact that the damaged to the item occurred as a result of bad packaging on the part of milestone auction, as their claimed was denied by ups on this ground on july 8th, 2016; which milestone never inform me about. This shows that they have no regards for me as customer, or the case. Again to emphasize my point, the damaged was the fault of milestone auction, not ups. Therefore, milestone auction should take full responsibility for this case and reimburse me for the amounts that is owed to me.

An now

Dear mr. Dewine, the information provided to you by the representative from milestone auctions is one more bogus request. I find it inconceivable that they would continue with the same lies they have been telling me from the beginning of this case. Secondly, i was never informed of the inform by milestone auction of any of the actions that was described in their response letter to you. This all new to me. The fact is, ups does not deal with the receiver since the complaint is done by the shipper. Ups never got in touch with me as he mentioned. And their response of "because the money that he had paid for his items had already been dispersed among our consignors from that auction" is a slap on the face and an insult to any one inteligence to give this for reason. It is a joke of lower mental state'. Never heard such uncany responce ! Ups have never got in touch and never will since the claim must be done by the shipper !

I battle with them for 4 months and one of their responses i got from him is "i am not going to pay you fom my pocket." in the numerous conversation i had with the owner
He called only once after i told him that he is stealing my money and i have nothing to do with the outcome of his claimed with ups he said " you think i am evil i have another case with ups."
A sick lied that endured from march to june 14 where it was the first time he ever contacted ups.

Milestone is l blantly lying on his behalf. He is the one that oblige to be in touch with ups since he send the package, i payed him the cost for insurance which he submitted on june 14 only. This after 4 months on lying after my
Ultimatom to him a day earlier in my last plea june 13
That i will not wait any more for the out come. Of ups clame and i am bringing it to the internet world to whom it may concern.

Leave this a side for a moment.
His claimed was denied on july 8 on the ground that the shipper did not pack it correctly which he never inform me and kept silence like nothing is the matter and i will never will hear from him and never heard a word from him
.
The letters below will clarify the whole story of lies and deception even to you if he answer you that i have to talk to ups he invented another fraud on top of the ather. His response to you that i should talk to ups.
Although i did several time tried but i was told clearly that they have no business with me but the shipper.
They even refuse to tell me the outcome .And only after i told them that the shipper will never will get in touch with me then they told me he was denied on the ground of his bad packing..
And the proof iof his intention. To keep silent that after the denyel he never inform me and belive that my money in his pocke is his privilage.
Some one in the justice deparpment shoul sue him for his iligal beheviore
And i hope the justice will prevail
Thank you
