In June 2014, my wife (who's a Filipino citizen) and I signed a contract to purchase a motorcycle from Suzuki Moto-Makati (SMM) in Makati, Philippines. By the end of July, BPI approved our loan application to finance the purchase from SMM. On Aug 19, 2014, Mr. Fran Archie of SMM informed me that the motorcycle we wanted to purchase (2014 Suzuki Bandit 650S), was recalled by the manufacturer and no longer available. Since we did not want another model, SMM agreed to refund our deposit of 104, 700PHP.

As of Oct 29, 2014, it as has been 70 days since SMM agreed to refund our down payment and we still haven’t received it. Every week, the sales woman, Arianne Canaria has a different excuse as to why it will take another week. The last time we spoke with her, she completely forgot why we were entitled to a refund and asked my wife to write a letter to that effect. We had to remind her that it was SMM who couldn't deliver the product and that we did not breech or renege on our contract.

How do we get our money back and to whom do we file a formal complaint? We have proof of all monies exchanged and email correspondence to prove we are entitled to a refund and have been trying to get it since Aug. The owner’s name is Mr. Reynaldo Odulio

Bhushan, I wasn't addressing you. I don't even know who you are. I think you commented on the wrong narrative. Anyway, I solved this problem by filing a formal complaint with DTI and contacting the Suzuki Corporate Customer Service Supervisor. I got my money back in less than 30 days. It took my wife three month before she gave up and passed on the problem to me.

As I said in my complaint, my wife tried for three months to get a refund to no avail. I finally decided to file a formal complaint with the Philippine Dept of Trade and Industry (DTI) and Suzuki's Corporate Office Customer Service. The dealership's General Manager, Bobb Orbe got involved. He facilitated the return of our money in less than 30 days. I don't hold grudges. If/when I return to the Philippines, we'll have to stop back there because they did have the kind of bikes I like. Problem solved.
